Condiciones Compradores
1. Los lotes se adjudicarán al mejor postor.
2. El precio de remate se incrementará en un 23,50% en concepto de honorarios de intermediación de la sala (20,5%) y el porcentaje de plataforma "Live" (3%). Se aplicará además el 21% de IVA sobre la comisión de sala cuando no se esté exento del pago de esta tasa.
3. El subastador será la persona designada por ALETHEIA SUBASTAS* para este cometido y será el único juez en cuanto a la adjudicación de los lotes y sus precios de remate. En el caso de que un lote plantease problemas de adjudicación en cuanto al precio de remate o identidad del comprador, el subastador decidirá la adjudicación o podrá subastarlo de nuevo en la misma sesión.
4. Las pujas deberán realizarse conforme a la siguiente escala y se redondearán a la baja aquellas que difieran para que dicha puja cumpla con este requisito:

5. ALETHEIA SUBASTAS* admitirá pujas por escrito hasta las 14:00 horas del día de la subasta, en caso de admitirse pujas a partir de dicha hora ALETHEIA SUBASTAS* no se hará responsable de posibles errores que surjan debido a esta circunstancia. Dichas pujas deberán ser formalizadas en los impresos facilitados para ello por la sala, prevaleciendo siempre el número de lote sobre la descripción. En dichas pujas, la sala representará al comprador hasta el máximo señalado en su oferta, adjudicando los lotes en el precio más bajo posible. En el caso de que existan dos ofertas por una misma cantidad, tendrá prioridad la depositada con fecha anterior.
6. ALETHEIA SUBASTAS* se reserva el derecho a admitir pujas telefónicas dependiendo de los criterios que considere oportunos, siempre con previa presentación por parte del cliente de las garantías suficientes que igualmente habrán de ser formalizadas en los impresos facilitados por la sala. Una orden para realizar una puja telefónica implica que el pujador se obliga, al menos, a cubrir el precio de salida. La sala no se hace responsable de la falta de contacto telefónico o la pérdida del mismo. En ese caso la sala cubrirá el precio de salida por el pujador.
7. ALETHEIA SUBASTAS* podrá no aceptar pujas de clientes cuya solvencia no quede debidamente acreditada, así como no adjudicar los remates.
8. Los datos sobre los lotes publicados en el catálogo responden al criterio de ALETHEIA SUBASTAS*, y como tal criterio, no deben ser tomados como un hecho. Los compradores deberán formar su propia opinión antes de la subasta por lo que los objetos a subastar serán expuestos públicamente con una antelación mínima de siete días. ALETHEIA SUBASTAS* no aceptará ninguna responsabilidad en cuanto a la exactitud de su catalogación.
9. Los lotes adquiridos por los compradores se entregarán en el estado observado en la exposición, sin aceptar devoluciones por restauraciones, desperfectos, roturas, etc., aunque no se hayan hecho constar en el catálogo. Solo se aceptarán cancelaciones de la venta, por lo tanto, cuando las piezas hayan sufrido algún tipo de deterioro desde el día en el que se cierra la exposición y los siete días posteriores a la subasta. En el caso de la venta de relojes, no garantizamos el correcto funcionamiento de la maquinaria, aun cuando indicamos que está en estado de marcha ya que esto indica que se puede poner en funcionamiento, pero no que trabaje con precisión.
10. El pago y retirada de los lotes se efectuará en un plazo no superior a siete días a partir de la subasta. ALETHEIA SUBASTAS* no se hace responsable de los posibles deterioros ocasionados en las piezas tras ese plazo:
- – Transcurrido dicho plazo se devengarán unos gastos de custodia y almacenamiento de 2 € diarios por lote.
- – El cliente deberá abonar todos los gastos bancarios en caso de realizar el pago por transferencia bancaria, aceptándose solamente aquellas transferencias en las cuales el importe recibido coincida con el de la factura de compra.
- – La retirada de las piezas adquiridas se efectuará en las oficinas de ALETHEIA SUBASTAS* Los compradores deberán hacerse cargo de la organización del transporte de los lotes, en el caso que no pudieran recogerlos ellos personalmente, siendo por cuenta del comprador los gastos de envío de los mismos y de su exclusiva responsabilidad el extravío o los daños que pudieran ocasionarse durante el transporte.
- – Transcurrido un mes a partir de la subasta sin que el comprador haya procedido a abonar y retirar los lotes adjudicados, ALETHEIA SUBASTAS* podrá dar por rescindida la venta sin perjuicio de las acciones legales que le correspondan y sin que el comprador tenga derecho alguno a su reclamación.
11. PERMISOS. Todos los clientes deberán informarse si las piezas adquiridas necesitan permiso de exportación, CITES u otros permisos antes de su retirada de la sala. Correrán por cuenta del cliente las tasas que deban abonar en cada caso. Es responsabilidad del cliente obtener dichos permisos y la no concesión o el retraso en conseguirlo no le eximirá en ningún caso del pago de la pieza, que deberá realizarse durante los siete días posteriores a la subasta.
12. INFORME DE ESTADO disponible bajo petición.

Condiciones Pujadores
1. El cliente deberá facilitar de crédito/débito y de su entidad bancaria un certificado de solvencia, indicando los siguientes puntos:
1.1. La trayectoria del cliente en dicha entidad es satisfactoria y de varios años.
1.2. Su capacidad económica puede hacer frente a los pagos de las facturas que resulten de sus compras en nuestra Sala.
1.3. Nuestras formas de pago son las siguientes:
> Transferencia bancaria
> Efectivo (conforme al artículo 7 de la Ley 7/2012, de 29 de octubre)
> En sala
> Cheques emitidos por entidades españolas
2. Cualquier cuestión litigiosa que pudiera surgir entre las partes respecto a la interpretación, cumplimiento, efectos o resolución del presente contrato, se someterá expresamente a la Jurisdicción de los Tribunales de Madrid capital, con renuncia, en su caso, del fuero propio que les pudiera corresponder.

4. DERECHO DE ADMISIÓN:
ALETHEIA SUBASTAS* se reserva el derecho de admisión, basándose en lo criterios que la propia sala considere oportunos.
Condiciones Vendedores
1. El cedente deposita los bienes para su venta en subasta en un precio de salida establecido de mutuo acuerdo. La cifra de salida constituye el precio mínimo de venta.
2. El cedente garantiza que es el propietario de los bienes depositados o que está válidamente autorizado por el legítimo propietario, pudiendo, por tanto, disponer de ellos libres de reclamaciones, cargas y otros gravámenes.
3. El cedente concede a ALETHEIA SUBASTAS* pleno derecho a fotografiar y reproducir los bienes cuya venta les sea encomendada.
4. ALETHEIA SUBASTAS* es titular de una póliza de seguros para la cobertura de los posibles daños o pérdida de los bienes en ella depositados quedando garantizado el valor pactado como precio de salida, deducida la comisión de la sala.
5. Si el cedente, por propia iniciativa, procede a retirar los lotes antes de la celebración de la subasta, deberá abonar a ALETHEIA SUBASTAS* los honorarios de intermediación que se hubieran hecho efectivos en caso de su venta en el precio de salida, es decir, el 31,67% + el I.V.A correspondiente.
6. Serán por cuenta de ALETHEIA SUBASTAS* los gastos de recogida (dentro de Barcelona), seguro, almacenaje y fotografía. Los gastos de devolución de las piezas serán por cuenta del vendedor. Dicho seguro no cubre en ningún caso deterioros producidos por termitas o polillas. Si las piezas depositadas en nuestra sala no tienen previsión de salir a subasta, transcurrido un plazo de 60 días desde la fecha del albarán de entrada sin que el cedente haya procedido a su retirada, ALETHEIA SUBASTAS* no se hará cargo de posibles daños o deterioros.
7. En caso de que se estimase necesario, de mutuo acuerdo entre el cedente y la sala, la limpieza o restauración de alguno de los bienes o la consulta con expertos ajenos a la sala, los gastos derivados de los mismos serán por cuenta del cedente, aun en el caso de que los lotes resultaran in-vendidos.
8. A las obras de autores sujetos a la Ley 3/2008 de la Propiedad intelectual se aplicará la deducción correspondiente cuando proceda, que será por cuenta del vendedor.
9. La organización de la subasta correrá a cargo de ALETHEIA SUBASTAS* que fijará la fecha y hora de la misma, los lotes que incluye, su orden y la descripción de los mismos, con el fin de obtener el mejor resultado final.
10. ALETHEIA SUBASTAS* deducirá del precio de adjudicación los honorarios de intermediación en la venta, que serán del 18,50% sobre el precio de remate, más los impuestos correspondientes.
11. La liquidación de las obras adjudicadas se efectuará en el plazo de 30 días a contar desde la fecha de la subasta y siempre que los lotes hayan sido abonados previamente por los compradores.
12. Salvo indicación en contra por parte del cedente, la sala podrá adjudicar los lotes in-vendidos después de la subasta respetando el precio pactado con el cedente.
Transcurrido un mes desde el día de la subasta sin que los bienes in-vendidos hayan sido retirados por el cedente, ALETHEIA SUBASTAS* queda autorizada para volver a incluirlos en una subasta deduciendo un 40% del precio de salida inicial. En caso de que el cedente no desee volver a subastar la pieza y haya transcurrido un mes desde la subasta sin haberlo retirado de la sala deberá abonar unos gastos de almacenaje de 6€/día desde dicha fecha.

Los lotes adquiridos por los compradores se entregarán en el estado observado en la exposición, sin aceptar devoluciones por restauraciones, desperfectos, roturas, etc., aunque no se hayan hecho constar en el catálogo. Solo se aceptarán cancelaciones de la venta, por lo tanto, cuando las piezas hayan sufrido algún tipo de deterioro desde el día en el que se cierra la exposición y los siete días posteriores a la subasta. En el caso de la venta de relojes, no garantizamos el correcto funcionamiento de la maquinaria, aun cuando indicamos que está en estado de marcha ya que esto indica que se puede poner en funcionamiento, pero no que trabaje con precisión.
10. El pago y retirada de los lotes se efectuará en un plazo no superior a siete días a partir de la subasta. ALETHEIA SUBASTAS* no se hace responsable de los posibles deterioros ocasionados en las piezas tras ese plazo:
- – Transcurrido dicho plazo se devengarán unos gastos de custodia y almacenamiento de 2 € diarios por lote.
- – El cliente deberá abonar todos los gastos bancarios en caso de realizar el pago por transferencia bancaria, aceptándose solamente aquellas transferencias en las cuales el importe recibido coincida con el de la factura de compra.
- – La retirada de las piezas adquiridas se efectuará en las oficinas de ALETHEIA SUBASTAS* Los compradores deberán hacerse cargo de la organización del transporte de los lotes, en el caso que no pudieran recogerlos ellos personalmente, siendo por cuenta del comprador los gastos de envío de los mismos y de su exclusiva responsabilidad el extravío o los daños que pudieran ocasionarse durante el transporte.
- – Transcurrido un mes a partir de la subasta sin que el comprador haya procedido a abonar y retirar los lotes adjudicados, ALETHEIA SUBASTAS* podrá dar por rescindida la venta sin perjuicio de las acciones legales que le correspondan y sin que el comprador tenga derecho alguno a su reclamación.
11. PERMISOS. Todos los clientes deberán informarse si las piezas adquiridas necesitan permiso de exportación, CITES u otros permisos antes de su retirada de la sala. Correrán por cuenta del cliente las tasas que deban abonar en cada caso. Es responsabilidad del cliente obtener dichos permisos y la no concesión o el retraso en conseguirlo no le eximirá en ningún caso del pago de la pieza, que deberá realizarse durante los siete días posteriores a la subasta.
12. INFORME DE ESTADO disponible bajo petición.
12. Aletheia Subastas se esfuerza por proporcionar la mayor cantidad de información posible, pero alienta la inspección en persona por parte de los postores. Las declaraciones sobre la condición de los objetos son solo una guía general y no deben considerarse como declaraciones completas de hechos, y no constituyen una representación, garantía o asunción de responsabilidad por parte de Aletheia Subastas. Todos los lotes se venden "TAL CUAL" según los Términos y condiciones de la subasta.
Condiciones Pujadores
1. El cliente deberá facilitar de crédito/débito y de su entidad bancaria un certificado de solvencia, indicando los siguientes puntos:
1.1. La trayectoria del cliente en dicha entidad es satisfactoria y de varios años.
1.2. Su capacidad económica puede hacer frente a los pagos de las facturas que resulten de sus compras en nuestra Sala.
1.3. Nuestras formas de pago son las siguientes:
> Transferencia bancaria
> Efectivo (conforme al artículo 7 de la Ley 7/2012, de 29 de octubre)
> En sala
> Cheques emitidos por entidades españolas
2. Cualquier cuestión litigiosa que pudiera surgir entre las partes respecto a la interpretación, cumplimiento, efectos o resolución del presente contrato, se someterá expresamente a la Jurisdicción de los Tribunales de Madrid capital, con renuncia, en su caso, del fuero propio que les pudiera corresponder.

4. DERECHO DE ADMISIÓN:
ALETHEIA SUBASTAS* se reserva el derecho de admisión, basándose en lo criterios que la propia sala considere oportunos.
Condiciones Vendedores
1. El cedente deposita los bienes para su venta en subasta en un precio de salida establecido de mutuo acuerdo. La cifra de salida constituye el precio mínimo de venta.
2. El cedente garantiza que es el propietario de los bienes depositados o que está válidamente autorizado por el legítimo propietario, pudiendo, por tanto, disponer de ellos libres de reclamaciones, cargas y otros gravámenes.
3. El cedente concede a ALETHEIA SUBASTAS* pleno derecho a fotografiar y reproducir los bienes cuya venta les sea encomendada.
4. ALETHEIA SUBASTAS* es titular de una póliza de seguros para la cobertura de los posibles daños o pérdida de los bienes en ella depositados quedando garantizado el valor pactado como precio de salida, deducida la comisión de la sala.
5. Si el cedente, por propia iniciativa, procede a retirar los lotes antes de la celebración de la subasta, deberá abonar a ALETHEIA SUBASTAS* los honorarios de intermediación que se hubieran hecho efectivos en caso de su venta en el precio de salida, es decir, el 31,67% + el I.V.A correspondiente.
6. Serán por cuenta de ALETHEIA SUBASTAS* los gastos de recogida (dentro de Barcelona), seguro, almacenaje y fotografía. Los gastos de devolución de las piezas serán por cuenta del vendedor. Dicho seguro no cubre en ningún caso deterioros producidos por termitas o polillas. Si las piezas depositadas en nuestra sala no tienen previsión de salir a subasta, transcurrido un plazo de 60 días desde la fecha del albarán de entrada sin que el cedente haya procedido a su retirada, ALETHEIA SUBASTAS* no se hará cargo de posibles daños o deterioros.
7. En caso de que se estimase necesario, de mutuo acuerdo entre el cedente y la sala, la limpieza o restauración de alguno de los bienes o la consulta con expertos ajenos a la sala, los gastos derivados de los mismos serán por cuenta del cedente, aun en el caso de que los lotes resultaran in-vendidos.
8. A las obras de autores sujetos a la Ley 3/2008 de la Propiedad intelectual se aplicará la deducción correspondiente cuando proceda, que será por cuenta del vendedor.
9. La organización de la subasta correrá a cargo de ALETHEIA SUBASTAS* que fijará la fecha y hora de la misma, los lotes que incluye, su orden y la descripción de los mismos, con el fin de obtener el mejor resultado final.
10. ALETHEIA SUBASTAS* deducirá del precio de adjudicación los honorarios de intermediación en la venta, que serán del 18,50% sobre el precio de remate, más los impuestos correspondientes.
11. La liquidación de las obras adjudicadas se efectuará en el plazo de 30 días a contar desde la fecha de la subasta y siempre que los lotes hayan sido abonados previamente por los compradores.
12. Salvo indicación en contra por parte del cedente, la sala podrá adjudicar los lotes in-vendidos después de la subasta respetando el precio pactado con el cedente.
Transcurrido un mes desde el día de la subasta sin que los bienes in-vendidos hayan sido retirados por el cedente, ALETHEIA SUBASTAS* queda autorizada para volver a incluirlos en una subasta deduciendo un 40% del precio de salida inicial. En caso de que el cedente no desee volver a subastar la pieza y haya transcurrido un mes desde la subasta sin haberlo retirado de la sala deberá abonar unos gastos de almacenaje de 6€/día desde dicha fecha.

Buyers Conditions
1. Lots will be awarded to the highest bidder.
2. The auction price will be increased by 23.50% for the room brokerage fee (20.5%) and the "Live" platform fee (3%). In addition, 21% VAT will be levied on the room fee when not exempted from this fee.
3. The auctioneer shall be the person appointed by ALETHEIA SUBASTAS* for this purpose and shall be the sole judge as to the awarding of the lots and their auction prices. In the event that a lot raises problems of adjudication regarding the auction price or the identity of the buyer, the auctioneer shall decide on the adjudication or may auction it again at the same session.
4. Bids shall be made in accordance with the following scale and any bids that differ shall be rounded down in order for the bid to comply with this requirement:

5. ALETHEIA SUBASTAS* shall accept written bids until 14:00 hours on the day of the auction, in the event that bids are accepted after this time ALETHEIA SUBASTAS* shall not be held responsible for any possible errors that may arise due to this circumstance. These bids must be formalised on the forms provided by the auction room, with the lot number always taking precedence over the description. In such bids, the room shall represent the buyer up to the maximum indicated in his bid, awarding the lots at the lowest possible price. In the event that there are two bids for the same amount, the one placed at the earlier date shall have priority.
6. ALETHEIA SUBASTAS* reserves the right to accept telephone bids depending on the criteria it considers appropriate, always with prior presentation by the client of sufficient guarantees, which must also be formalised on the forms provided by the auction room. An order to place a telephone bid implies that the bidder is obliged, at least, to cover the starting price. The room accepts no liability for failure or loss of telephone contact. In this case the room will cover the starting price for the bidder.
7. ALETHEIA SUBASTAS* may not accept bids from clients whose solvency is not duly accredited, and may not award auctions.
8. The details of the lots published in the catalogue are at the discretion of ALETHEIA SUBASTAS*, and as such should not be taken as fact. Buyers must form their own opinion before the auction and the objects to be auctioned will be publicly displayed at least seven days in advance. ALETHEIA AUCTIONS* accepts no responsibility for the accuracy of their cataloguing.
9. The lots purchased by buyers will be delivered in the condition observed at the exhibition, and no returns will be accepted for restorations, damage, breakages, etc., even if they have not been stated in the catalogue. Cancellations of the sale will only be accepted, therefore, when the pieces have suffered some kind of deterioration between the day on which the exhibition closes and the seven days following the auction. In the case of the sale of watches, we do not guarantee the correct functioning of the machinery, even when we indicate that it is in working order, as this indicates that it can be put into operation, but not that it works accurately.
10. Payment and withdrawal of the lots shall be made within a period of no more than seven days from the auction. ALETHEIA SUBASTAS* shall not be held responsible for any possible damage caused to the pieces after this period:
- After this period, a storage and custody fee of € 2 per day per lot will be charged.
- The customer must pay all bank charges in the event of payment by bank transfer, only those transfers in which the amount received coincides with that of the purchase invoice will be accepted.
- The withdrawal of the purchased pieces will be carried out at the offices of ALETHEIA SUBASTAS* The purchasers will be responsible for the organisation of the transport of the lots, in the event that they cannot collect them personally, being the purchaser responsible for the shipping costs of the same and for any loss or damage that may be caused during transport.
- If one month after the auction has elapsed without the buyer having paid for and collected the lots awarded, ALETHEIA SUBASTAS* may terminate the sale without prejudice to any legal action that may correspond to it and without the buyer having any right to claim for it.
11. PERMITS. All customers should enquire whether the purchased items require export, CITES or other permits prior to their removal from the showroom. The customer shall be responsible for the fees payable in each case. It is the client's responsibility to obtain such permits and failure or delay in obtaining them shall in no case exempt the client from payment for the piece, which must be made within seven days of the auction.
12. STATUS REPORT available on request. Aletheia Auctions endeavours to provide as much information as possible, but encourages in-person inspection by bidders. Sellers Conditions

6. ALETHEIA SUBASTAS* will be responsible for the costs of collection (within Barcelona), insurance, storage and photography. The costs of returning the pieces will be paid by the seller. This insurance does not under any circumstances cover damage caused by termites or moths. If the pieces deposited in our auction room are not expected to be auctioned, after a period of 60 days from the date of the delivery note without the seller having removed them, ALETHEIA SUBASTAS* shall not be liable for any possible damage or deterioration.
7. In the event that it is deemed necessary, by mutual agreement between the transferor and the auction room, to clean or restore any of the goods or to consult with experts from outside the auction room, the costs arising therefrom shall be borne by the transferor, even in the event that the lots are unsold.
8. For works by authors subject to Law 3/2008 on Intellectual Property, the corresponding deduction shall be applied where applicable, which shall be for the account of the seller.
9. The organisation of the auction shall be the responsibility of ALETHEIA SUBASTAS*, which shall set the date and time of the auction, the lots included, their order and their description, in order to obtain the best final result.
10. ALETHEIA SUBASTAS* shall deduct from the auction price the intermediation fees for the sale, which shall be 18.50% of the auction price, plus the corresponding taxes.
11. The liquidation of the works awarded shall be carried out within 30 days from the date of the auction and provided that the lots have been previously paid for by the purchasers.
12. Unless otherwise indicated by the transferor, the hall may award the unsold lots after the auction, respecting the price agreed with the transferor.
Once one month has passed since the day of the auction without the unsold goods having been withdrawn by the transferor, ALETHEIA SUBASTAS* shall be authorised to include them again in an auction, deducting 40% from the initial starting price. In the event that the transferor does not wish to re-auction the piece and one month has passed since the auction without having removed it from the auction room, he/she shall pay storage costs of €6/day from that date.
