BOLOGNA Annibale II Bentivoglio (1511-1512) Duchy - CNI 250 AU (g 3.46) RRRR Annibale Bentivoglio, son of John II, succeeded in seizing, with his partisans, Bologna, which he ruled for a year. He certainly knew he was unable to maintain that position unless he convinced Julius II to recognize it, so after an initial fasedi open rebellion, he sought an agreement with the pontiff. Despite his efforts, Julius II had no intention of coming to terms with him and, with the military help of the King of Naples, managed to drive him out as he had done his father. It is likely that Hannibal, unable to issue coins in Julius II's name without his permission, issued some independently. The punch used to imprint St. Peter was changed significantly after the arrival in Bologna of the new cardinal legate Giovanni Medici. While previously the robe was depicted as long to the point of hiding the feet, it was later shown shorter, with the ankles uncovered. Since it is unlikely that Giovanni Bentivoglio II issued anonymous ducats without his own coat of arms or that of the pontiff at the end of his rule, it is believed that this golden bolognino must be attributed to Hannibal II. And those with the short robe without any armlet are assignable to the Vacant Sees following the pontificate of Leo X. A coin of great rarity and superb quality, especially the D/, which has reliefs practically intact and perfectly impressed. The only specimen, other than this one, that we have been able to find , turns out to be the one in the Künker auction of 2022, mis-catalogued under Clement VII and which, in BB+ conservation, realized 3200 euros + fees. - qFDC/ M.of SPL

CONDIZIONI GENERALI
La Nomisma S.p.a. (di seguito “Nomisma”) effettua vendite all’asta di beni sulla base esclusivamente delle presenti condizioni generali di vendita (di seguito le “Condizioni Generali”). Eventuali condizioni generali applicate dai clienti non saranno pertanto applicabili e rimarranno inefficaci.
La Vendita all’asta dei beni raggruppati in lotti è effettuata in locali aperti al pubblico. Le vendite si effettuano al maggiore offerente e si intendono per “contanti”.
Nomisma agisce in qualità di mandataria in nome proprio e per conto dei proprietari dei beni posti in vendita. La vendita deve considerarsi avvenuta tra il venditore e l’acquirente. Ne consegue che Nomisma non assume nei confronti degli acquirenti o di terzi in genere altre responsabilità all’infuori di quelle derivanti dalla propria qualità di mandataria. Ogni responsabilità continua a gravare in capo ai venditori dei beni. L’Aggiudicazione del Direttore della vendita (o il Banditore) determina la conclusione del contratto di vendita tra il venditore e l’acquirente.
1. LOTTI POSTI IN VENDITA - STATO DI CONSERVAZIONE
I lotti sono venduti nelle condizioni in cui si trovano (“as is”). Le descrizioni e le illustrazioni contenute nei cataloghi, nel sito web o in qualsiasi altro materiale illustrativo, sono puramente indicative e non potranno generare affidamenti di alcun tipo negli aggiudicatari. Previo appuntamento sarà possibile visionare i lotti nei giorni antecedenti all’asta e così fino all’inizio della medesima con lo scopo di esaminare l’autenticità, l’attribuzione, lo stato di conservazione, la provenienza, il tipo e la qualità e gli eventuali difetti degli oggetti posti in vendita e chiarire eventuali difformità rispetto a quanto indicato nel catalogo. L’interessato all’acquisto di un lotto riconosce con l’iscrizione e/o la partecipazione all’asta di aver avuto la possibilità di esaminarlo approfonditamente, eventualmente con la consulenza di un suo esperto di fiducia, per accertarne tutte le caratteristiche.
Nomisma non garantisce in alcun modo i contenuti di perizie su monete o altri oggetti posti in vendita, tra i quali a titolo meramente esemplificativo e non esaustivo: orologi, gioielli, penne e libri, effettuate da soggetti o enti terzi; tali contenuti saranno puramente indicativi.
Dopo l’aggiudicazione non sono ammesse contestazioni al riguardo di contenuti di perizie su monete o altri oggetti posti in vendita, tra i quali a titolo meramente esemplificativo e non esaustivo: orologi, gioielli, penne e libri, effettuate da soggetti o enti terzi.
In particolare ed a maggior precisazione delle presenti Condizioni Generali, per quanto ai seguenti determinati oggetti eventualmente posti in asta, si precisa quanto segue:
a) Orologi.
Le descrizioni degli orologi sono state fatte dai nostri esperti in tutta fede e coscienza ma ogni descrizione, così come ogni nostro parere, è da intendersi come assolutamente indicativa e non esime il potenziale acquirente da una verifica personale diretta secondo le indicate disposizioni di accesso ai beni.
Nomisma non garantisce il corretto funzionamento dell’orologio anche se nella descrizione si sono tenuti criteri di attendibilità e rigore elencando sia pregi che difetti, evidenti e no. Ogni orologio è venduto nello stato di fatto e di diritto in cui si trova e non saranno accettati reclami successivi sull’originalità delle varie componenti. Perciò si consiglia comunque all’acquirente finale una accurata revisione dell’oggetto presso centri autorizzati.
Durante la vendita per motivi organizzativi non sarà possibile esaminare gli orologi. Si consiglia vivamente i potenziali offerenti a prendere preventivamente all'asta un appuntamento con Nomisma onde esaminare direttamente e possibilmente con un esperto di fiducia gli orologi d’interesse.
Fermo ed impregiudicato tutto quanto sopra in ordine alle condizioni degli oggetti ed alla loro descrizione, Nomisma è a disposizione per inviare, previa richiesta da far pervenire almeno 7 giorni lavorativi preventivamente all’asta, ulteriore materiale fotografico o video così come è disponibile a colloqui telefonici esplicativi.
Le carature indicate nelle descrizioni sono da intendersi come stimate e non si garantisce la caratura precisa.
b) Gioielli.
Le descrizioni dei Gioielli sono state fatte dai nostri esperti in tutta fede e coscienza ma ogni descrizione, così come ogni nostro parere, è da intendersi come assolutamente indicativa e non esime il potenziale acquirente da una verifica personale diretta secondo le indicate disposizioni di accesso ai beni.
Si consiglia vivamente i potenziali offerenti a prendere preventivamente all’asta un appuntamento con Nomisma onde esaminare direttamente e possibilmente con un esperto di fiducia i gioielli d’interesse.
Durante la vendita per motivi organizzativi non sarà possibile esaminare i gioielli; ogni Gioiello, infatti, è venduto nello stato di fatto e di diritto in cui si trova e non saranno accettati reclami successivi.

c) Penne.
La descrizione delle penne è stata fatta con attenzione ma si consiglia fortemente i potenziali acquirenti ad una visione diretta delle stesse onde accertarsi dei difetti descritti e della loro autenticità. Ogni penna, infatti, è venduta nello stato di fatto e di diritto in cui si trova e non saranno accettati reclami successivi.
Durante la vendita per motivi organizzativi non sarà possibile esaminare le penne.
Nomisma è a disposizione per inviare, previa richiesta da far pervenire almeno 7 giorni lavorativi preventivamente all’asta, ulteriore materiale fotografico o video di ciò che potrà essere d’interesse così come è disponibile a colloqui telefonici per descrivere il materiale.
d) Libri.
La descrizione dei libri è stata fatta con attenzione ma si consiglia fortemente i potenziali acquirenti ad una visione diretta degli stessi onde accertarsi dei difetti descritti che possono variare secondo i diversi pareri. Ogni libro, infatti, è venduto nello stato di fatto e di diritto in cui si trova e ad aggiudicazione avvenuta non saranno presi in considerazioni reclami riguardo mancanze, difetti o errori di classificazione.
Durante la vendita per motivi organizzativi non sarà possibile esaminare i libri.
Nomisma è a disposizione per inviare, previa richiesta da far pervenire almeno 7 giorni lavorativi preventivamente all’asta, ulteriore materiale fotografico o video dei libri d’interesse così come è disponibile a colloqui telefonici per descrivere il materiale.
I lotti posti in vendita sono da considerarsi come beni usati d’antiquariato e come tali non qualificabili come “prodotto” secondo la definizione di cui all’art. 3 lett. e) del D.Lgs. 6.09.2005 n. 206 (Codice del consumo), qui richiamato a solo scopo indicativo ma non cogente.
2. RECLAMI
Se non diversamente disposto nelle presenti Condizioni, Nomisma prenderà in considerazione reclami solo in merito a contestazioni sulla autenticità dei lotti, sulla esistenza di gravi vizi o difetti occulti e/o sulla non conformità fra i lotti acquistati e quelli descritti in catalogo d’asta e disponibili per visione prima dell’asta. A tale riguardo, non verrà considerato difetto di conformità quello di cui l’acquirente avrebbe dovuto essere a conoscenza al momento dell’acquisto avendo avuto l’opportunità di visionare il lotto sul catalogo o durante l’esposizione che precede la vendita (i.e. il difetto che non poteva ignorare facendo uso dell’ordinaria diligenza). Eventuali reclami dovranno essere comunicati a mezzo lettera raccomandata A.R. entro 20 (venti) giorni di calendario dall’asta e comunque prima che Nomisma spa abbia effettuato il pagamento al conferente. In caso di contestazione, presentata e convalidata entro quanto prescritto, ogni obbligo o responsabilità sarà limitato al solo rimborso al compratore della somma da lui effettivamente pagata, esclusa ogni altra pretesa.
Non verranno accettati in alcun caso reclami:
per vizi o difetti espressamente citati in catalogo o facilmente riscontrabili dalla fotografia del lotto o dalla visione prima dell’asta;
inerenti a lotti multipli quali collezioni o accumulazioni di qualsiasi tipo;
inerenti a lotti esplicitamente richiamati in catalogo d’asta con la clausola “da esaminare”;
inerenti allo stato di conservazione dei lotti essendo la valutazione di tale elemento del tutto soggettiva ed essendo la vendita soggetta alla clausola “come visto e piaciuto”;
per vizi o difetti imputabili a condotta dell’acquirente successiva alla consegna del lotto.
trascorsi 20 giorni dalla data di svolgimento dell’asta.
Nomisma darà un riscontro scritto ai reclami entro 60 giorni dalla ricezione degli stessi.
Nomisma accetterà i reclami solo nel caso in cui a giudizio di due periti indipendenti nominati da ciascuna parte il lotto risultasse non autentico, affetto da gravi vizi o difetti occulti e/o per nulla conforme a quanto descritto in catalogo d’asta. In tal caso sarà dovuta all’acquirente solo la restituzione delle somme corrisposte per l’acquisto e la consegna del lotto essendo espressamente escluso ogni risarcimento o rimborso. In caso che il cliente dopo l’asta sottoponga una moneta alle società di grading, il giudizio di queste ultime riguardo alla conservazione ed in particolare per quanto riguarda, ad esempio, le definizioni di CLEANED, DETAILS ecc. non potrà essere oggetto di contestazione a Nomisma spa non dando il diritto di risoluzione del contratto.
3. LIMITAZIONE DI RESPONSABILITÀ
Nomisma non si assume alcuna responsabilità in relazione a qualsiasi danno che possa derivare all’acquirente, il quale si assume ogni rischio in relazione a qualsiasi danno potesse derivare da, o essere relativo ai, beni acquistati.
4. PARTECIPAZIONE ALL’ASTA
Per la partecipazione all’asta in sala, i soggetti che intendono concorrere all’aggiudicazione di qualsivoglia lotto, dovranno richiedere al personale di Nomisma l’apposito “numero identificativo” e comunicare le proprie generalità e la residenza anagrafica, con esibizione e copia del documento di identità e codice fiscale. Nomisma si riserva il diritto di richiedere ai partecipanti all’asta informazioni sulle generalità e sulle referenze bancarie, nonché il diritto, anche e non solo a seguito di dette verifiche, di vietare a partecipanti non desiderati l’ingresso in sala. Qualora il partecipante agisca in nome e per conto di un’altra persona fisica o giuridica, dovrà essere esibita idonea procura verificabile prima dello svolgimento dell’asta.
Per la partecipazione all’asta “on line” e/o “E-live” (in entrambe i casi anche per corrispondenza o telefonica) il partecipante dovrà sottoscrivere e far pervenire a Nomisma l’apposito modulo entro l’ora di inizio dell’asta di riferimento, accettando così di prendervi parte e impegnandosi a corrispondere il prezzo realizzato qualora gli sia aggiudicato il bene. In ogni caso Nomisma non sarà tenuta responsabile della mancata partecipazione qualora detto modulo non pervenisse in tempo utile, ovvero non fosse adeguatamente compilato. Il partecipante si impegna inoltre a controllare, al termine dell’asta, se le sue offerte sono andate a buon fine manlevando Nomisma da ogni responsabilità in tal senso. Le contestazioni dovute a negligenza, poca chiarezza o errore nella compilazione di offerte scritte per corrispondenza non saranno accettate. Nomisma declina ogni responsabilità nei confronti di chi partecipa all’asta nel caso di mancata esecuzione della partecipazione dovuta a eventuali disguidi che possono occorrere durante o precedentemente il collegamento telefonico e/o internet.
Per partecipare all’asta on line è necessario iscriversi sul sito https://nomismaweb.com; la partecipazione potrà avvenire esclusivamente on line tramite l’accesso a detto sito web di Nomisma e l’aggiudicazione avverrà al miglior offerente. I lotti, preventivamente visionabili sul sito di Nomisma e sul relativo Catalogo sono messi in vendita ad una base d’asta (stima) sotto il quale non potranno essere aggiudicati. La possibilità di fare le offerte è limitata ad una durata prestabilita, indicata di volta in volta, durante la quale sarà possibile, in qualsiasi momento, fare un’offerta massima per ogni lotto.
A seguito dell’aggiudicazione di un lotto, l’aggiudicatario riceverà le informazioni necessarie per il saldo dei propri acquisti e le modalità di ritiro o consegna dei lotti. Su richiesta ed a carico dell’aggiudicatario, Nomisma potrà organizzare la consegna a domicilio tramite corriere specializzato.
Il Partecipante è reso edotto pienamente di come Nomisma sia tenuta a rispettare la normativa antiriciclaggio nazionale di San Marino (L. n. 82 del 17 Giugno 2008), unitamente alle sue successive modificazioni ed integrazioni, e pertanto accetta incondizionatamente che in base a detta normativa gli sia richiesta la cosiddetta “Adeguata Verifica”, oltre alla consegna di documenti ed informazioni all’aggiudicatario; il Partecipante con la sottoscrizione ed accettazione delle presenti Condizioni si impegna anche a fare tutto quanto necessario acché Nomisma esplichi tale attività conscio del fatto che, anche dopo l’aggiudicazione ed il pagamento del prezzo, Nomisma avrà diritto a non rilasciare i beni se la “Adeguata Verifica” non sarà stata completata ex lege.
Nello specifico, la “Adeguata Verifica” consiste letteralmente in quanto segue:
identificazione del cliente e verifica della sua identità sulla base di documenti, dati o informazioni ottenuti da una fonte affidabile e indipendente;
identificazione del titolare effettivo e adozione di misure ragionevoli per verificarne l’identità, utilizzando informazioni e dati ottenuti da fonti affidabili, in modo che il soggetto designato sia certo dell’identità del titolare effettivo;
comprensione e acquisizione di informazioni sullo scopo e sulla natura prevista del rapporto d’affari o della prestazione professionale. In presenza di un livello di rischio di riciclaggio e di finanziamento del terrorismo alto, l’attività di comprensione ed acquisizione di informazioni sullo scopo e sulla natura prevista si applica anche alle operazioni occasionali, diverse dalla prestazione professionale;
svolgere un controllo costante del rapporto d’affari, anche esercitando una verifica sulle operazioni concluse in costanza di tale rapporto, in modo da assicurare che esse siano coerenti con la conoscenza che il soggetto designato ha del cliente, della sua attività economica e del suo profilo di rischio, anche riguardo, se necessario, all'origine dei fondi, e assicurarsi che siano tenuti aggiornati i documenti, i dati o le informazioni detenute. In presenza di un rischio di riciclaggio e di finanziamento del terrorismo elevato, il soggetto designato deve svolgere, con aumentata frequenza, una revisione dei documenti, dei dati e delle informazioni precedentemente ottenute e, se necessario, avviare ulteriori approfondimenti sull’operatività del cliente.
Le aste di Nomisma non sono soggette al Diritto di recesso essendo precedute dall’esposizione dei lotti che sono visionabili prima di effettuare le offerte, presso la sede di San Marino.
Per la partecipazione alle aste, in qualsiasi delle modalità sopra indicate, Nomisma si riserva a propria discrezione il diritto di chiedere al partecipante, che con l’iscrizione accetta incondizionatamente, il rilascio di idonee garanzie per permettere al partecipante stesso di poter formulare offerte al fine dell’aggiudicazione di un bene oggetto dell’incanto. Si riserva inoltre di rifiutare le offerte di acquirenti non conosciuti o non graditi, a meno che venga lasciato un deposito ad intera copertura del prezzo dei lotti desiderati o fornita altra adeguata garanzia. Il soggetto che abbia cauzionato l’offerta e che non riuscisse ad aggiudicarsi il/i lotto/i non potrà in alcun caso rivendicare altre somme oltre l’ammontare del deposito medesimo, rinunciando espressamente sin d’ora a qualsiasi azione in tal senso. Per le aste in sala, Nomisma si riserva il diritto di negare a chiunque, a propria discrezione, l’ingresso nei propri locali e la partecipazione all’asta. In seguito al mancato o ritardato pagamento da parte di un acquirente di un lotto a lui aggiudicato, Nomisma potrà rifiutare qualsiasi offerta fatta dallo stesso o da un suo rappresentante nel corso di successive aste.
5. OFFERTE
Nomisma ha facoltà di ritirare dall’asta qualsiasi bene posto in vendita ed ha, inoltre, facoltà, a suo insindacabile giudizio, di abbinare o separare i lotti e di variarne l’ordine di vendita, purché i lotti non vengano posti in asta anteriormente alla data prevista. Il Banditore ha facoltà di accettare sia le offerte del pubblico presente sia quelle di persone non presenti, ovvero telefoniche, per corrispondenza o online, purché comunicate anteriormente all’asta nelle forme stabilite per l’asta stessa e rinvenibili sul relativo regolamento, come sopra disciplinato.
La base d’Asta è la stima indicata per ciascun lotto; non potranno essere in alcun modo accettate offerte inferiori a detta stima.
Gli scatti minimi sono regolati dal Banditore della vendita. L’aggiudicazione dei beni è fatta al miglior offerente, con apposita dichiarazione del Banditore che varrà quale accettazione dell’offerta, proposta dal partecipante all’asta. A parità di valore si terrà conto dell’ordine d’arrivo. I concorrenti all'asta per corrispondenza possono informarsi dell’esito delle loro offerte telefonando, a partire da tre giorni lavorativi dopo la chiusura dell’asta, allo 0549/904012. Nomisma spa non si assume alcuna responsabilità nell’informare i clienti dell’esito delle loro offerte.
Ove sorga contestazione intorno all’aggiudicazione, il bene disputato, ad insindacabile giudizio del Banditore, potrà essere ritirato dall’asta, oppure rimesso in vendita all’incanto nella stessa seduta, sulla base dell’ultima offerta raccolta.
Nomisma si riserva il diritto di rifiutare offerte provenienti da, o riconducibili a, soggetti che in precedenza non abbiano puntualmente onorato obbligazioni pecuniarie, anche a titolo risarcitorio nei confronti di Nomisma stessa.
Si premette che i valori di stima indicati nel catalogo sono espressi in euro e costituiscono una mera indicazione.
6. DIRITTI D’ASTA
Al prezzo di aggiudicazione, che avverrà alla terza chiamata, sono da aggiungere i diritti di asta in misura pari al 21,63% (ventunovirgolasessantatre percento). Qualunque ulteriore onere o tributo relativo all’acquisto sarà comunque a carico dell’aggiudicatario.
7. CONSEGNA DEI LOTTI AGGIUDICATI E PAGAMENTO
Fermo ed impregiudicato quanto previsto all’Art. 4 sull’”Adeguata Verifica”, i lotti aggiudicati dovranno essere inderogabilmente pagati e ritirati dall’acquirente entro e non oltre 24 ore dall’aggiudicazione, termine essenziale ad ogni effetto di Legge. Il ritiro dovrà avvenire presso la sede di Nomisma a cura e spese dell’aggiudicatario. Nomisma sarà obbligata a consegnare i beni aggiudicati esclusivamente a seguito del buon fine del pagamento dell’intero importo a cui è stato aggiudicato il lotto da parte del Banditore e dei diritti d’asta. A propria discrezione Nomisma potrà chiedere all’acquirente il versamento di un acconto per perfezionare l’aggiudicazione, il medesimo giorno dell’asta. Dall’aggiudicazione al ritiro i beni saranno in giacenza a rischio esclusivo dell’acquirente.
Il pagamento potrà essere effettuato in contanti, purché non sia pari o superi l’importo previsto dalla normativa vigente, per assegno circolare intestato a Nomisma S.p.a., per bonifico bancario al conto corrente bancario che sarà comunicato al momento dell’aggiudicazione. In quest’ultimo caso il pagamento sarà considerato valido e il lotto sarà consegnato solo con il buon fine ed una volta che l’importo sarà irrevocabilmente accreditato sul conto corrente bancario di Nomisma.
Le spedizioni per posta dei beni aggiudicati verranno evase solo dopo pagamento anticipato; la merce viaggerà a spese, rischio e pericolo del committente. Per le fatture non pagate entro 30 giorni saranno addebitati gli interessi in ragione del tasso legale maggiorato del 7% annuo. L’acquirente è tenuto ad osservare le eventuali leggi doganali sostenendone i relativi costi, comprese le spese postali che di seguito, salvo diversa comunicazione scritta da parte di Nomisma, si vanno ad elencare per ciascun invio:
fino ad euro 300,00 spese di packaging euro 15,00 + 1% del valore della ricevuta per assicurazione (Italia)
fino ad euro 300,00 spese di packaging euro 25,00 + 1% del valore della ricevuta per assicurazione (resto del mondo)
sopra euro 300,00 spese di packaging euro 20,00 + 1% del valore della ricevuta per assicurazione (Italia)
sopra euro 300,00 spese di packaging euro 35,00 + 1% del valore della ricevuta per assicurazione (resto del mondo)
per importi superiori ai € 3.000,00 le spese saranno calcolate in base al tipo di spedizione
Nomisma curerà nel miglior modo possibile la spedizione dei lotti aggiudicati rimanendone comunque sempre il rischio a carico dei committenti i quali dovranno fornire precise istruzioni per la spedizione stessa tenendo presente che San Marino non è Paese UE e considerando quindi tutte le vigenti normative doganali e postali. A mero titolo esemplificativo si evidenzia che non è possibile spedire per assicurata postale nei seguenti Paesi, tra gli altri: Gran Bretagna, Germania, Albania, Canada, USA e Paesi arabi in genere. Per Gran Bretagna, Germania, Canada, USA, Nomisma provvederà a stipulare un’assicurazione privata senza tuttavia alcun impegno o responsabilità. Non è possibile in ogni caso spedire con assicurazione anche per corriere nei Paesi arabi in genere. In caso di emissione di documento doganale T2, i committenti sono tenuti al versamento dei diritti doganali d’importazione a titolo di cauzione; tale somma verrà restituita alla chiusura del detto documento doganale. I committenti sono pregati di informarsi preventivamente su queste disposizioni doganali e postali prima dell’ordine d’acquisto. Si precisa doverosamente che FEDEX e DHL non ritirano monete in Italia né a San Marino.
Nel caso l’acquirente non si presenti per il ritiro dei lotti nei termini sopra stabiliti e non provveda al pagamento dell’intero ammontare dovuto entro il termine essenziale ad ogni effetto di Legge previsto dalle presenti Condizioni Generali ovvero nel caso si presenti ma non paghi, in tutto o in parte, l’ammontare totale dovuto entro i termini previsti dalle presenti Condizioni Generali, Nomisma avrà diritto, a propria discrezione, fatti salvi gli eventuali ulteriori diritti e rimedi di legge di: (i) risolvere, in nome e per conto del venditore, il contratto di compravendita, restando inteso che in tale caso Nomisma potrà chiedere all’aggiudicatario il risarcimento, a proprio favore e/o a favore del conferente, di tutti i danni verificatisi, costituiti, in particolare e a titolo esemplificativo, dal minor prezzo realizzato in una successiva vendita, dai diritti, dalle spese, dagli oneri, anche legali, sopportati, avendo anche il diritto di trattenere a titolo di danno eventuali acconti ricevuti sul prezzo, ecc.; ovvero (ii) agire in via giudiziale in qualità di mandatario all’incasso del venditore per ottenere l’esecuzione coattiva dell’obbligo d’acquisto e il pagamento del prezzo di acquisto, oltre interessi, spese, oneri, e le spese legali necessarie per ottenere l’adempimento del contratto di compravendita. In caso di risoluzione del contratto, Nomisma, a propria discrezione potrà decidere se restituire il bene al mandante, esigendo a titolo di penale da parte dell’aggiudicatario anche l’importo corrispondente al mancato pagamento delle commissioni perdute, ovvero vendere il lotto tramite trattativa privata o in aste successive per conto ed a spese dell’aggiudicatario, salvo in ogni caso il diritto al risarcimento dei danni.
Decorso il termine di cui al primo comma del presente articolo Nomisma resterà responsabile della custodia del/i lotto/i aggiudicato/i nei confronti dell’aggiudicatario solo ed esclusivamente sino al passaggio di proprietà e/o consegna al vettore, all’acquirente o a suo delegato debitamente autorizzato, fermo restando la sua facoltà di poter richiedere eventuali costi sostenuti per la custodia oltre il termine suddetto.
Qualunque rischio per perdita o danni al bene aggiudicato si trasferirà all’acquirente dal momento del passaggio di proprietà e/o consegna al vettore, all’acquirente o a suo delegato.
L’acquirente potrà ottenere la consegna dei beni acquistati solamente previa corresponsione a Nomisma del prezzo e di ogni altra commissione, costo o rimborso inerente.
8. VENDITA CON RISERVA DELLA PROPRIETÀ
I lotti sono venduti con riserva della proprietà e pertanto la proprietà degli stessi si trasferirà in capo all’acquirente solo al momento dell’integrale pagamento del prezzo dovuto per la vendita e dei diritti d’asta. Il rischio di perimento o di danneggiamento dei lotti si trasferirà all’acquirente al momento della consegna dei lotti stessi. L’obbligo di consegna dei lotti venduti è in ogni caso subordinato al previo integrale pagamento da parte dell’acquirente del prezzo dovuto e di tutti i diritti d’asta.
9. FORO COMPETENTE
Le presenti Condizioni di Vendita, regolate dalla legge Sammarinese e con espressa esclusione delle norme di diritto internazionale privato, sono accettate tacitamente da tutti i soggetti partecipanti alla procedura di vendita all’asta e restano a disposizione di chiunque ne faccia richiesta. Per qualsiasi controversia relativa all’attività di vendita all’asta presso Nomisma è stabilita la competenza esclusiva del Tribunale di San Marino con esclusione espressa di qualsiasi Foro alternativo.
10. PRIVACY
Nomisma, nella sua qualità di titolare del trattamento, informa che i dati forniti verranno utilizzati, con mezzi cartacei ed elettronici, per poter dare piena ed integrale esecuzione ai contratti di compravendita stipulati dalla stessa società, nonché per il perseguimento di ogni altro servizio inerente l’oggetto sociale di Nomisma S.p.a.. Il conferimento dei dati è facoltativo, ma si rende strettamente necessario per la partecipazione alle aste ed all’esecuzione dei contratti conclusi. La registrazione alle aste consente a Nomisma di inviare i cataloghi delle aste successive ed altro materiale informativo relativo all’attività della stessa.
A proprio insindacabile giudizio Nomisma si riserva di registrare in qualsiasi forma la seduta dell’asta nonché registrare i collegamenti telefonici.
11. COMUNICAZIONI

Le Condizioni di Vendita, le informazioni e i testi dei cataloghi in lingua diversa rispetto alla lingua italiana rappresentano soltanto traduzioni ausiliari senza effetto vincolante. Nomisma non si assume alcuna responsabilità in relazione alla correttezza di tali traduzioni.
Il testo in lingua Italiana delle presenti Condizioni Generali sarà l’unico a produrre effetti tra le Parti e potrà essere utilizzato prevalendo su qualsiasi traduzione; la traduzione/versione in inglese è una semplice comodità degli interessati.
13. VARIE
I diritti d’autore attinenti a tutte le immagini, illustrazioni e documenti scritti, realizzati da o per Nomisma Spa, relativi a un lotto o a un contenuto specifico del catalogo, sono e rimarranno di proprietà di Nomisma Spa. Tali contenuti non potranno pertanto essere utilizzati dall’acquirente e/o da terzi senza il previo consenso scritto di Nomisma Spa.
Qualora una o più clausole delle presenti Condizioni Generali dovessero essere o diventare inefficaci o invalide per qualsivoglia motivo, tale inefficacia o invalidità non inficerà l’efficacia giuridica delle restanti disposizioni. Le disposizioni inefficaci o invalide verranno sostituite da disposizioni idonee a salvaguardare il più possibile la ratio della disposizione invalida.
La partecipazione all’Asta implica l’integrale accettazione delle presenti condizioni di vendita.
Qualsiasi modifica o integrazione delle presenti condizioni generali di vendita sarà invalida se non effettuata per iscritto.
15. VESSATORIE
L’offerente dichiara di aver letto, compreso e di approvare espressamente le su estese Condizioni Generali ed in particolare quelle dei seguenti articoli: 1, 2, 3, 4, 5, 7, 8, 9, 10, 12, 13 e 14.
Terms of sale
TERMS AND CONDITIONS
Nomisma S.p.a. (hereinafter "Nomisma") carries out auction sales of goods based exclusively on these general conditions of sale (hereinafter the "General Conditions"). Any general conditions applied by customers will therefore not be applicable and will remain ineffective.
The auction sale of goods grouped into lots is carried out in places open to the public. Sales are made to the highest bidder and are intended for "cash".
Nomisma acts as an agent with its own name on behalf of the owners of the goods offered for sale. The sale must be considered to have taken place between the owner and the buyer. It follows that Nomisma does not assume any responsibility towards buyers or third parties in general other than those deriving from its role as agent. All responsibility continues to be borne by the owners of the goods. The Award of the Sales Manager (or the Auctioneer) determines the conclusion of the sales contract between the owner and the buyer.
1. LOTS FOR SALE - STATE OF PRESERVATION
The lots are sold in the conditions in which they are found ("as is"). The descriptions and illustrations contained in the catalogs, on the website or in any other illustrative material are purely indicative and will not generate any kind of damage to the successful bidders. By appointment, it will be possible to view the lots in the days prior to the auction and thus until the beginning of the same with the aim of examining the authenticity, attribution, state of conservation, origin, type and quality and any defects of the items offered for sale and clarify any compliance with respect to what is indicated in the catalog. By registering and / or participating in the auction, those interested in purchasing a lot acknowledge that they have had the opportunity to examine it in depth, eventually with the advice of a trusted expert, to ascertain all its characteristics.
Nomisma does not guarantee in any way the contents of technical expertise on coins or other objects offered for sale, including by way of example and not limited to: watches, jewels, pens and books, carried out by third parties or entities; such contents will be purely indicative.
After the award, no disputes are allowed regarding the contents of appraisals on coins or other items offered for sale, including by way of example and not limited to: watches, jewelry, pens and books, made by third parties or entities.
In particular and for greater clarification of these General Conditions, with regard to the following objects possibly placed in auction, the following is specified:
a) Watches.
The descriptions of the watches have been made by our experts in good faith and conscience but every description, as well as our every opinion, is to be understood as absolutely indicative and does not exempt the potential buyer from direct verification in person according to the said provisions for access to the goods.
Nomisma does not guarantee the correct functioning of the watch even if in the description criteria of reliability and rigor have been kept, listing both merits and defects, evident and otherwise. Each watch is sold in the state of fact and law in which it is found and subsequent complaints on the originality of the various components will not be accepted. Therefore, the final purchaser is advised to carry out a thorough review of the object at authorized centers.
During the sale, for internal and logistic reasons, it will not be possible to examine the watches. Potential bidders are strongly advised to take an appointment with Nomisma before the auction in order to examine the watches of interest directly and possibly with a trusted expert.
Without prejudice to all of the above regarding the condition of the goods and their description, Nomisma is available to send, upon request to be sent at least 7 working days prior to the auction, further photographic or video material as it is available for telephone interviews.
The carats indicated in the goods descriptions are to be understood as estimated and the precise carat weight is not guaranteed.
b) Jewelery.
The descriptions of the jewels have been made by our experts in good faith and conscience but every description, as well as our every opinion, is to be understood as absolutely indicative and does not exempt the potential buyer from direct verification in person according to the said provisions for access to the goods.
Potential bidders/buyers are strongly advised to make an appointment with Nomisma before the auction in order to examine the jewels of interest directly and possibly with a trusted expert.
During the sale, for internal and logistic reasons it will not be possible to examine the jewels; each Jewel, in fact, is sold in the state of fact and law in which it is found and subsequent complaints will not be accepted.
Without prejudice to all of the above regarding the condition of the goods and their description, Nomisma is available to send, upon request to be sent at least 7 working days prior to the auction, further photographic or video material as it is available for telephone interviews.
The carats indicated in the goods descriptions are to be understood as estimated and the precise carat weight is not guaranteed.
c) Pens.
The description of the Pens has been made carefully but potential bidders/buyers are strongly advised to have a direct view of the said goods in order to ascertain the defects described and their authenticity. Each pen, in fact, is sold in the state of fact and law in which it is found and subsequent claims will not be accepted.
During the sale for internal and logistic reasons it will not be possible to examine the pens.
Nomisma is available to send, upon request to be sent at least 7 working days prior to the auction, further photographic or video material as it is available for telephone interviews to describe the goods.
d) Books.
The description of the books has been made carefully but potential buyers/bidders are strongly advised to have a direct view of them in order to ascertain the defects described which may vary according to different opinions. Each book, in fact, is sold in the state of fact and law in which it is found and once the award has been made, no complaints will be taken into consideration regarding deficiencies, defects or classification errors.
During the sale for internal and logistic reasons it will not be possible to examine the books.
Nomisma is available to send, upon request to be sent at least 7 working days prior to the auction, further photographic or video material as it is available for telephone interviews to describe the goods.
Lots offered for sale are to be considered as used antiques and as such not qualifiable as a "product" according to the definition set out in art. 3 lett. e) of the italian D.Lgs 6.09.2005 n. 206 (Consumer Code), referred to here for indicative purposes only but not binding.
2. COMPLAINTS
Unless otherwise provided in these Terms and general Conditions, Nomisma will consider complaints only regarding disputes on the authenticity of the lots, on the existence of serious defects or hidden defects and / or on the non-conformity between the purchased lots and those described in the auction catalog and available for viewing before the auction. In this regard, it will not be considered a lack of conformity that of which the buyer should have been aware at the time of purchase having had the opportunity to view the lot in the catalog or during the exhibition preceding the sale (ie the defect which he could not ignore using ordinary diligence).
Any complaints must be communicated by registered letter with return receipt within 20 (twenty) calendar days from the auction and in any case before Nomisma spa has made the payment to the transferor. In the event of a dispute, submitted and validated within the prescribed period, any obligation or liability will be limited to reimbursement to the buyer of the sum actually paid by him, excluding any other claim.
Complaints will not be accepted under any circumstances:
(a) for flaws or defects expressly mentioned in the catalog or easily detectable by the photograph of the lot or by viewing before the auction;
(b) relating to multiple lots such as collections or accumulations of any kind;
(c) relating to lots explicitly referred to in the auction catalog with the clause "to be examined";
(d) inherent to the state of conservation of the lots being the evaluation of the conservation entirely subjective and the sale being subject to the clause "as seen and liked";
(e) for flaws or defects attributable to the conduct of the buyer following the delivery of the lot.
(f) after 20 days from the auction date.
Nomisma will give written feedback to complaints within 60 days from the receipt.
Nomisma will accept complaints only in the event that, in the opinion of two independent experts appointed by each party, the lot is found to be inauthentic, affected by serious defects or hidden defects and / or not at all compliant with what is described in the auction catalog. In this case, only the refund of the sums paid for the purchase and delivery of the lot will be due to the buyer, any compensation or refund being expressly excluded. In the event that the customer submits a coin to the grading companies after the auction, the judgment of the latter regarding conservation and in particular regarding, for example, the definitions of CLEANED, DETAILS etc. cannot be contested against Nomisma spa as it does not give the right to terminate the contract.
3. LIMITATION OF LIABILITY
Nomisma assumes no responsibility in relation to any damage that may arise to the buyer, who assumes all risk in relation to any damage that may arise from, or be related to, the purchased goods.
4. PARTICIPATION IN THE AUCTION
To participate the auction in the room, subjects who intend to compete for the award of any lot, must ask for the appropriate "identification number" from Nomisma personnel and communicate their personal details and registered residence, with exhibition and copy of the document of identity and tax code. Nomisma reserves the right to request from the participants in the auction information on general information and bank references, as well as the right, also and not only following these checks, to prohibit unwanted participants from entering the room. If the participant acts in the name and on behalf of another person or entity, a suitable verifiable power of attorney must be presented before the auction is held.
To participate in the "online" and / or "E-live" auction (in both cases also by correspondence or telephone), the participant must sign and send the appropriate form to Nomisma within the starting time of the reference auction, thus accepting to take part in it and undertaking to pay the realized price if the asset is awarded. In any case Nomisma will not be held responsible for non-participation if this form is not received in due time, or if it is not properly filled in. The participant also agrees to check, at the end of the auction, if his offers have been successful, relieving Nomisma of any responsibility in this regard. Complaints due to negligence, lack of clarity or error in the compilation of written offers by correspondence will not be accepted.
Nomisma disclaims any responsibility towards those who participate in the auction in the event of non-execution of the participation due to any misunderstandings that may occur during or before the telephone and / or internet connection.
To participate in the online auction, you must register on the website https://nomismaweb.com; participation can only be made online by accessing the Nomisma website and the award will be made to the highest bidder. The lots, which can be viewed in advance on the Nomisma website and in the related Catalog, are offered for sale at an auction base (estimate) under which they cannot be awarded. The possibility of making bids is limited to a predetermined duration, indicated from time to time, during which it will be possible, at any time, to make a maximum bid for each lot.
Following the award of a lot, the successful bidder will receive the informations necessary for the balance of their purchases and the methods of collection or delivery of the lots. Upon request and at the expense of the successful bidder, Nomisma can arrange home delivery by specialized courier.
The Participant/customer is made fully aware of how Nomisma is required to comply with the national anti-money laundering legislation of San Marino (Law no.82 of June 17, 2008), together with its subsequent amendments and additions, and therefore unconditionally accepts that upon the said legislation the so-called "Adequate Verification" (Adeguata Verifica) is requested, in addition to the delivery of documents and information to the successful bidder; by signing and accepting these Conditions, the Participant also undertakes to do everything necessary so that Nomisma carries out this activity aware of the fact that, even after the award and payment of the price, Nomisma will have the right not to release the goods if the "Adequate Verification ” will not have been completed as required by the law.
In particular, the "Adequate Verification" literally consists of the following:
• identification of the Participant/customer and verification of his identity on the basis of documents, data or information obtained from a reliable and independent source;
• identification of the beneficial owner and adoption of reasonable measures to verify his identity, by using information and data from reliable sources, so that the designated person is certain of the identity of the beneficial owner;
• understanding and acquiring information on the purpose and intended nature of the business relationship or professional service. In any case of a high level of money laundering and terrorist financing risk, the activity of understanding and acquiring information on the intended purpose and nature should also be applied to occasional transactions, other than professional service;
• exercise a constant control of the business relationship, also by carrying out a check on the transactions concluded during this relationship, in order to ensure that they are consistent with the knowledge that the designated subject has of the customer, of his economic activity and his profile risk, including, if necessary, the origin of the funds, and ensure that the documents, data or information held are kept up to date. In the presence of a high risk of money laundering and terrorist financing, the designated subject must carry out, with increased frequency, a review of the documents, data and information previously obtained and, if necessary, initiate further investigations on the client's operations.
Nomisma's auctions are not subject to the right of withdrawal as they are preceded by the display of the lots that can be viewed before bidding, at the San Marino headquarters.
For participation in auctions, in any of the aforementioned methods, Nomisma reserves the right at its own discretion to ask the participant, who unconditionally accepts with the registration, the release of suitable guarantees to allow the participant to be able to formulate offers for the purpose the award of an asset subject to the auction. It also reserves the right to refuse offers from unknown or unwelcome buyers, unless a deposit is left to fully cover the price of the desired lots or other adequate guarantee is provided. The person who has secured the offer and who fails to win the lot (s) will in no case be able to claim other sums beyond the amount of the deposit itself, expressly renouncing as of now any action in this regard. For auctions in the hall, Nomisma reserves the right to deny anyone, at its discretion, entry to its premises and participation in the auction. Following the non-payment or delayed payment by a buyer of a lot awarded to him, Nomisma may refuse any offer made by him or by his representative in the course of subsequent auctions.
5. OFFERS
Nomisma has the right to withdraw from the auction any goods put up for sale and also has the right, at its sole discretion, to combine or separate the lots and to vary the sale order, provided that the lots are not put up for auction before the expected date. The Auctioneer has the right to accept both offers from the public present and those of people not present, or by telephone, by correspondence or online, provided that they are communicated prior to the auction in the forms established for the auction itself and can be found in the relative regulations, as regulated above.
The auction starting price correspond to the estimation indicated for each lot; bids lower than that estimate value cannot be accepted in any way.
The minimum raises are regulated by the Auctioneer of the sale. The award of the assets is made at the best bidder, with a specific declaration by the Auctioneer which will be valid as acceptance of the bid, proposed by the participant in the auction. For the same value, the order of arrival will be taken into account. Participants in the mail order auction can inquire about the outcome of their bids by calling 0549/904012, starting three working days after the auction has closed. Nomisma spa assumes no responsibility in informing customers of the outcome of their offers.
Where a dispute arises about the award, the disputed property, at the sole discretion of the Auctioneer, may be withdrawn from the auction, or put back up for auction in the same session, on the basis of the last bid collected.
Nomisma reserves the right to refuse offers from, or attributable to, subjects who have not previously duly honored pecuniary obligations, including as compensation for Nomisma itself.
It should be noted that the estimated values indicated in the catalog are expressed in euros and constitute a simple advice.
6. AUCTION RIGHTS
To the hammer price, which will take place on the third call, auction rights are to be added in an amount equal to 21,63% (twenty-one point sixty-three). Any further charges or taxes relating to the purchase will in any case be borne by the successful bidder.
7. DELIVERY OF THE AWARDED LOTS AND PAYEMENT
The awarded lots must be paid and collected by the buyer no later than 24 hours after the award, an essential deadline for all legal purposes. The collection must take place at the Nomisma headquarters by and at the expense of the successful bidder. Nomisma will be obliged to deliver the awarded assets only after successful payment of the full amount to which the lot was awarded by the buyer plus the auction rights. At its discretion, Nomisma may ask the buyer to pay a deposit to finalize the award, on the same day of the auction. From the award to the withdrawal, the goods will be in storage at the exclusive risk of the buyer.
Payment can be made in cash, provided that it is not equal to or exceeds the legal amount provided for by current legislation, by bank draft made out to Nomisma S.p.a., by bank transfer to the bank account that will be communicated at the time of the award. In the latter case, the payment will be considered valid and the lot will be delivered only with successful completion and once the amount is irrevocably credited to Nomisma's bank account.
Shipments by Post of the awarded goods will be processed only after advance payment; the goods will travel at the expense, risk and peril of the customer. For invoices not paid within 30 days, interest will be charged at the statutory rate increased by 7% per annum. The buyer is required to observe any customs laws and incur the related costs, including postage which, unless otherwise communicated in writing by Nomisma, are listed below for each shipment:
• up to €300.00 packaging costs €15.00 + 1% of the receipt value for insurance (Italy)
• up to €300.00 packaging costs €25.00 + 1% of the receipt value for insurance (rest of the world)
• over €300.00 packaging costs €20.00 + 1% of the receipt value for insurance (Italy)• above € 1,000.00 and up to € 3,000.00, postage costs € 26.00;
• over €300.00 packaging costs €35.00 + 1% of the receipt value for insurance (rest of the world)
• for amounts exceeding €3,000.00, the costs will be calculated based on the type of shipping
Nomisma will take care of the shipment of the awarded lots in the best possible way, always remaining the risk borne by the customers who must provide precise instructions for the shipment itself, bearing in mind that San Marino is not an EU country and therefore considering all current customs and postal regulations. By way of example, it should be noted that it is not possible to ship by registered mail to the following countries, among others: Great Britain, Germany, Albania, Canada, USA and Arab countries in general. For Great Britain, Germany, Canada, USA, Nomisma will take out private insurance without any commitment or liability.
It is not possible to ship with insurance even by courier in Arab countries in general. In the event of the issuance of a T2 customs document, customers are required to pay import customs duties as a deposit; this sum will be returned when the customs document is closed. Customers are requested to inquire in advance about these customs and postal provisions before placing the purchase order. It is dutifully specified that FEDEX and DHL do not collect coins in Italy or in San Marino.
In the event that the buyer does not present himself for the collection/withdrawal of the lots within the terms established above and fails to pay the entire amount due within the essential deadline for all purposes of the law provided for by these General Conditions, or in the event he presents himself but does not pay in whole or in part, the total amount due within the terms set out in these General Conditions, Nomisma will be entitled, at its discretion, without prejudice to any further legal rights and remedies to: (i) terminate, in the name and on behalf of the seller, the sale contract, it being understood that in this case Nomisma may ask the successful bidder for compensation, in its own favor and / or in favor of the assignor, for all damages that have arisen, in particular and by way of example, by the lower price achieved in a subsequent sale, by the rights, expenses, charges, including legal ones, borne, also having the right to withhold as damage any advances received on the price, etc .; or (ii) take legal action as a collection agent for the seller to obtain the compulsory execution of the purchase obligation and the payment of the purchase price, plus interest, expenses, charges, and legal fees necessary to obtain the fulfillment of the sales contract. In the event of termination of the contract, Nomisma, at its own discretion, may decide whether to return the asset to the seller, demanding as a penalty from the successful bidder the amount corresponding to the non-payment of the lost commissions, or to sell the lot through private negotiation. or in subsequent auctions on behalf and at the expense of the successful bidder, except in any case the right to compensation for damages.
Once the term referred to in the first paragraph of this article has elapsed, Nomisma will remain responsible for the custody of the awarded lot(s) towards the successful bidder only and exclusively up to the transfer of ownership and / or delivery to the carrier, the buyer or his duly authorized delegate, without prejudice to his right to request any costs incurred for custody after the aforementioned term.
Any risk for loss or damage to the awarded lot(s) will be transferred to the buyer from the moment of transfer of ownership and / or delivery to the carrier, the buyer or his delegate.
The buyer will be able to obtain the delivery of the purchased goods only upon payment to Nomisma of the price and any other inherent commission, cost or reimbursement.
8. SALE WITH RESERVE OF OWNERSHIP
Lots are sold with reserve of ownership and therefore the said ownership will be transferred to the buyer only at the time of full payment of the price due for the sale plus the auction rights. The risk of loss or damage to the lots will be transferred to the buyer upon delivery of the lots. The delivery of the lots sold is in any case subject to the prior full payment by the buyer of the price due and all auction fees.
9. JURISDICTION
These General Conditions of Sale, exclusively governed by San Marino law and with the express exclusion of the rules of private international law, are tacitly accepted by all parties participating in the auction sale procedure and remain available to anyone who requests them. For any dispute relating to the auction sales activity at Nomisma, the exclusive jurisdiction of the Court of San Marino is established with the express exclusion of any alternative Court.
10. PRIVACY
Nomisma, in its capacity as data controller, informs that the data(s) provided will be used, by paper and electronic means, in order to be able to give full and complete execution to the sales contracts stipulated by the same company, as well as for the pursuit of any other service concerning the purpose of Nomisma Spa. The provision of data is optional, but it is strictly necessary for participation in auctions and for the execution of contracts. Registration for auctions allows Nomisma to send the catalogs of subsequent auctions and other information material relating to its activity.
At its sole discretion, Nomisma has the right to record the auction session in any form and has the right to record any telephone connections.
11. COMMUNICATIONS

12. EXCLUSION OF LIABILITY RELATED TO THE TERMS OF SALE CONTAINED IN THE CATALOGS
This General Conditions of Sale, informations and the texts of the catalogs in a language other than the Italian language represent only auxiliary translations without a binding effect. Nomisma assumes no responsibility for the accuracy of such translations.
The Italian text of these General Conditions will be the only one to produce effects between the Parties and may be used overriding any translation; the translation / version in English is a simple convenience for those concerned.
13. MISCELLANEOUS
All copyrights relating to all images, illustrations and written documents, created by or for Nomisma Spa, relating to a specific lot or content of the catalog, are and will remain in the exclusive property of Nomisma Spa. Such contents cannot therefore be used by the buyer and / or any anyone without the prior written consent of Nomisma Spa.
Should one or more clauses of these General Conditions be or become ineffective or invalid for any reason, such ineffectiveness or invalidity will not affect the legal effectiveness of the remaining provisions. The ineffective or invalid provisions will be replaced by provisions suitable for safeguarding as much as possible the intent of the invalid provision.
Participation in the Auction implies full acceptance of these conditions of sale.
Any change or addition to these General Conditions of sale will be invalid if not made in writing.
14. SPECIAL CLAUSES
The bidder declares to have read, understood and expressly approve the extended General Conditions and in particular those of the following articles: 1, 2, 3, 4, 5, 7, 8, 9, 10, 12, 13 and 14.
Condizioni di vendita
CONDIZIONI GENERALI
La Nomisma S.p.a. (di seguito “Nomisma”) effettua vendite all’asta di beni sulla base esclusivamente delle presenti condizioni generali di vendita (di seguito le “Condizioni Generali”). Eventuali condizioni generali applicate dai clienti non saranno pertanto applicabili e rimarranno inefficaci.
La Vendita all’asta dei beni raggruppati in lotti è effettuata in locali aperti al pubblico. Le vendite si effettuano al maggiore offerente e si intendono per “contanti”.
Nomisma agisce in qualità di mandataria in nome proprio e per conto dei proprietari dei beni posti in vendita. La vendita deve considerarsi avvenuta tra il venditore e l’acquirente. Ne consegue che Nomisma non assume nei confronti degli acquirenti o di terzi in genere altre responsabilità all’infuori di quelle derivanti dalla propria qualità di mandataria. Ogni responsabilità continua a gravare in capo ai venditori dei beni. L’Aggiudicazione del Direttore della vendita (o il Banditore) determina la conclusione del contratto di vendita tra il venditore e l’acquirente.
1. LOTTI POSTI IN VENDITA - STATO DI CONSERVAZIONE
I lotti sono venduti nelle condizioni in cui si trovano (“as is”). Le descrizioni e le illustrazioni contenute nei cataloghi, nel sito web o in qualsiasi altro materiale illustrativo, sono puramente indicative e non potranno generare affidamenti di alcun tipo negli aggiudicatari. Previo appuntamento sarà possibile visionare i lotti nei giorni antecedenti all’asta e così fino all’inizio della medesima con lo scopo di esaminare l’autenticità, l’attribuzione, lo stato di conservazione, la provenienza, il tipo e la qualità e gli eventuali difetti degli oggetti posti in vendita e chiarire eventuali difformità rispetto a quanto indicato nel catalogo. L’interessato all’acquisto di un lotto riconosce con l’iscrizione e/o la partecipazione all’asta di aver avuto la possibilità di esaminarlo approfonditamente, eventualmente con la consulenza di un suo esperto di fiducia, per accertarne tutte le caratteristiche.
Nomisma non garantisce in alcun modo i contenuti di perizie su monete o altri oggetti posti in vendita, tra i quali a titolo meramente esemplificativo e non esaustivo: orologi, gioielli, penne e libri, effettuate da soggetti o enti terzi; tali contenuti saranno puramente indicativi.
Dopo l’aggiudicazione non sono ammesse contestazioni al riguardo di contenuti di perizie su monete o altri oggetti posti in vendita, tra i quali a titolo meramente esemplificativo e non esaustivo: orologi, gioielli, penne e libri, effettuate da soggetti o enti terzi.
In particolare ed a maggior precisazione delle presenti Condizioni Generali, per quanto ai seguenti determinati oggetti eventualmente posti in asta, si precisa quanto segue:
a) Orologi.
Le descrizioni degli orologi sono state fatte dai nostri esperti in tutta fede e coscienza ma ogni descrizione, così come ogni nostro parere, è da intendersi come assolutamente indicativa e non esime il potenziale acquirente da una verifica personale diretta secondo le indicate disposizioni di accesso ai beni.
Nomisma non garantisce il corretto funzionamento dell’orologio anche se nella descrizione si sono tenuti criteri di attendibilità e rigore elencando sia pregi che difetti, evidenti e no. Ogni orologio è venduto nello stato di fatto e di diritto in cui si trova e non saranno accettati reclami successivi sull’originalità delle varie componenti. Perciò si consiglia comunque all’acquirente finale una accurata revisione dell’oggetto presso centri autorizzati.
Durante la vendita per motivi organizzativi non sarà possibile esaminare gli orologi. Si consiglia vivamente i potenziali offerenti a prendere preventivamente all'asta un appuntamento con Nomisma onde esaminare direttamente e possibilmente con un esperto di fiducia gli orologi d’interesse.
Fermo ed impregiudicato tutto quanto sopra in ordine alle condizioni degli oggetti ed alla loro descrizione, Nomisma è a disposizione per inviare, previa richiesta da far pervenire almeno 7 giorni lavorativi preventivamente all’asta, ulteriore materiale fotografico o video così come è disponibile a colloqui telefonici esplicativi.
Le carature indicate nelle descrizioni sono da intendersi come stimate e non si garantisce la caratura precisa.
b) Gioielli.
Le descrizioni dei Gioielli sono state fatte dai nostri esperti in tutta fede e coscienza ma ogni descrizione, così come ogni nostro parere, è da intendersi come assolutamente indicativa e non esime il potenziale acquirente da una verifica personale diretta secondo le indicate disposizioni di accesso ai beni.
Si consiglia vivamente i potenziali offerenti a prendere preventivamente all’asta un appuntamento con Nomisma onde esaminare direttamente e possibilmente con un esperto di fiducia i gioielli d’interesse.
Durante la vendita per motivi organizzativi non sarà possibile esaminare i gioielli; ogni Gioiello, infatti, è venduto nello stato di fatto e di diritto in cui si trova e non saranno accettati reclami successivi.
Fermo ed impregiudicato tutto quanto sopra in ordine alle condizioni degli oggetti ed alla loro descrizione, Nomisma è a disposizione per inviare, previa richiesta da far pervenire almeno 7 giorni lavorativi preventivamente all’asta, ulteriore materiale fotografico o video dei gioielli, così come è disponibile a colloqui telefonici esplicativi.
Le carature indicate nelle descrizioni sono da intendersi come stimate e non si garantisce la caratura precisa.
c) Penne.
La descrizione delle penne è stata fatta con attenzione ma si consiglia fortemente i potenziali acquirenti ad una visione diretta delle stesse onde accertarsi dei difetti descritti e della loro autenticità. Ogni penna, infatti, è venduta nello stato di fatto e di diritto in cui si trova e non saranno accettati reclami successivi.
Durante la vendita per motivi organizzativi non sarà possibile esaminare le penne.
Nomisma è a disposizione per inviare, previa richiesta da far pervenire almeno 7 giorni lavorativi preventivamente all’asta, ulteriore materiale fotografico o video di ciò che potrà essere d’interesse così come è disponibile a colloqui telefonici per descrivere il materiale.
d) Libri.
La descrizione dei libri è stata fatta con attenzione ma si consiglia fortemente i potenziali acquirenti ad una visione diretta degli stessi onde accertarsi dei difetti descritti che possono variare secondo i diversi pareri. Ogni libro, infatti, è venduto nello stato di fatto e di diritto in cui si trova e ad aggiudicazione avvenuta non saranno presi in considerazioni reclami riguardo mancanze, difetti o errori di classificazione.
Durante la vendita per motivi organizzativi non sarà possibile esaminare i libri.
Nomisma è a disposizione per inviare, previa richiesta da far pervenire almeno 7 giorni lavorativi preventivamente all’asta, ulteriore materiale fotografico o video dei libri d’interesse così come è disponibile a colloqui telefonici per descrivere il materiale.
I lotti posti in vendita sono da considerarsi come beni usati d’antiquariato e come tali non qualificabili come “prodotto” secondo la definizione di cui all’art. 3 lett. e) del D.Lgs. 6.09.2005 n. 206 (Codice del consumo), qui richiamato a solo scopo indicativo ma non cogente.
2. RECLAMI
Se non diversamente disposto nelle presenti Condizioni, Nomisma prenderà in considerazione reclami solo in merito a contestazioni sulla autenticità dei lotti, sulla esistenza di gravi vizi o difetti occulti e/o sulla non conformità fra i lotti acquistati e quelli descritti in catalogo d’asta e disponibili per visione prima dell’asta. A tale riguardo, non verrà considerato difetto di conformità quello di cui l’acquirente avrebbe dovuto essere a conoscenza al momento dell’acquisto avendo avuto l’opportunità di visionare il lotto sul catalogo o durante l’esposizione che precede la vendita (i.e. il difetto che non poteva ignorare facendo uso dell’ordinaria diligenza). Eventuali reclami dovranno essere comunicati a mezzo lettera raccomandata A.R. entro 20 (venti) giorni di calendario dall’asta e comunque prima che Nomisma spa abbia effettuato il pagamento al conferente. In caso di contestazione, presentata e convalidata entro quanto prescritto, ogni obbligo o responsabilità sarà limitato al solo rimborso al compratore della somma da lui effettivamente pagata, esclusa ogni altra pretesa.
Non verranno accettati in alcun caso reclami:
per vizi o difetti espressamente citati in catalogo o facilmente riscontrabili dalla fotografia del lotto o dalla visione prima dell’asta;
inerenti a lotti multipli quali collezioni o accumulazioni di qualsiasi tipo;
inerenti a lotti esplicitamente richiamati in catalogo d’asta con la clausola “da esaminare”;
inerenti allo stato di conservazione dei lotti essendo la valutazione di tale elemento del tutto soggettiva ed essendo la vendita soggetta alla clausola “come visto e piaciuto”;
per vizi o difetti imputabili a condotta dell’acquirente successiva alla consegna del lotto.
trascorsi 20 giorni dalla data di svolgimento dell’asta.
Nomisma darà un riscontro scritto ai reclami entro 60 giorni dalla ricezione degli stessi.
Nomisma accetterà i reclami solo nel caso in cui a giudizio di due periti indipendenti nominati da ciascuna parte il lotto risultasse non autentico, affetto da gravi vizi o difetti occulti e/o per nulla conforme a quanto descritto in catalogo d’asta. In tal caso sarà dovuta all’acquirente solo la restituzione delle somme corrisposte per l’acquisto e la consegna del lotto essendo espressamente escluso ogni risarcimento o rimborso. In caso che il cliente dopo l’asta sottoponga una moneta alle società di grading, il giudizio di queste ultime riguardo alla conservazione ed in particolare per quanto riguarda, ad esempio, le definizioni di CLEANED, DETAILS ecc. non potrà essere oggetto di contestazione a Nomisma spa non dando il diritto di risoluzione del contratto.
3. LIMITAZIONE DI RESPONSABILITÀ
Nomisma non si assume alcuna responsabilità in relazione a qualsiasi danno che possa derivare all’acquirente, il quale si assume ogni rischio in relazione a qualsiasi danno potesse derivare da, o essere relativo ai, beni acquistati.
4. PARTECIPAZIONE ALL’ASTA
Per la partecipazione all’asta in sala, i soggetti che intendono concorrere all’aggiudicazione di qualsivoglia lotto, dovranno richiedere al personale di Nomisma l’apposito “numero identificativo” e comunicare le proprie generalità e la residenza anagrafica, con esibizione e copia del documento di identità e codice fiscale. Nomisma si riserva il diritto di richiedere ai partecipanti all’asta informazioni sulle generalità e sulle referenze bancarie, nonché il diritto, anche e non solo a seguito di dette verifiche, di vietare a partecipanti non desiderati l’ingresso in sala. Qualora il partecipante agisca in nome e per conto di un’altra persona fisica o giuridica, dovrà essere esibita idonea procura verificabile prima dello svolgimento dell’asta.
Per la partecipazione all’asta “on line” e/o “E-live” (in entrambe i casi anche per corrispondenza o telefonica) il partecipante dovrà sottoscrivere e far pervenire a Nomisma l’apposito modulo entro l’ora di inizio dell’asta di riferimento, accettando così di prendervi parte e impegnandosi a corrispondere il prezzo realizzato qualora gli sia aggiudicato il bene. In ogni caso Nomisma non sarà tenuta responsabile della mancata partecipazione qualora detto modulo non pervenisse in tempo utile, ovvero non fosse adeguatamente compilato. Il partecipante si impegna inoltre a controllare, al termine dell’asta, se le sue offerte sono andate a buon fine manlevando Nomisma da ogni responsabilità in tal senso. Le contestazioni dovute a negligenza, poca chiarezza o errore nella compilazione di offerte scritte per corrispondenza non saranno accettate. Nomisma declina ogni responsabilità nei confronti di chi partecipa all’asta nel caso di mancata esecuzione della partecipazione dovuta a eventuali disguidi che possono occorrere durante o precedentemente il collegamento telefonico e/o internet.
Per partecipare all’asta on line è necessario iscriversi sul sito https://nomismaweb.com; la partecipazione potrà avvenire esclusivamente on line tramite l’accesso a detto sito web di Nomisma e l’aggiudicazione avverrà al miglior offerente. I lotti, preventivamente visionabili sul sito di Nomisma e sul relativo Catalogo sono messi in vendita ad una base d’asta (stima) sotto il quale non potranno essere aggiudicati. La possibilità di fare le offerte è limitata ad una durata prestabilita, indicata di volta in volta, durante la quale sarà possibile, in qualsiasi momento, fare un’offerta massima per ogni lotto.
A seguito dell’aggiudicazione di un lotto, l’aggiudicatario riceverà le informazioni necessarie per il saldo dei propri acquisti e le modalità di ritiro o consegna dei lotti. Su richiesta ed a carico dell’aggiudicatario, Nomisma potrà organizzare la consegna a domicilio tramite corriere specializzato.
Il Partecipante è reso edotto pienamente di come Nomisma sia tenuta a rispettare la normativa antiriciclaggio nazionale di San Marino (L. n. 82 del 17 Giugno 2008), unitamente alle sue successive modificazioni ed integrazioni, e pertanto accetta incondizionatamente che in base a detta normativa gli sia richiesta la cosiddetta “Adeguata Verifica”, oltre alla consegna di documenti ed informazioni all’aggiudicatario; il Partecipante con la sottoscrizione ed accettazione delle presenti Condizioni si impegna anche a fare tutto quanto necessario acché Nomisma esplichi tale attività conscio del fatto che, anche dopo l’aggiudicazione ed il pagamento del prezzo, Nomisma avrà diritto a non rilasciare i beni se la “Adeguata Verifica” non sarà stata completata ex lege.
Nello specifico, la “Adeguata Verifica” consiste letteralmente in quanto segue:
identificazione del cliente e verifica della sua identità sulla base di documenti, dati o informazioni ottenuti da una fonte affidabile e indipendente;
identificazione del titolare effettivo e adozione di misure ragionevoli per verificarne l’identità, utilizzando informazioni e dati ottenuti da fonti affidabili, in modo che il soggetto designato sia certo dell’identità del titolare effettivo;
comprensione e acquisizione di informazioni sullo scopo e sulla natura prevista del rapporto d’affari o della prestazione professionale. In presenza di un livello di rischio di riciclaggio e di finanziamento del terrorismo alto, l’attività di comprensione ed acquisizione di informazioni sullo scopo e sulla natura prevista si applica anche alle operazioni occasionali, diverse dalla prestazione professionale;
svolgere un controllo costante del rapporto d’affari, anche esercitando una verifica sulle operazioni concluse in costanza di tale rapporto, in modo da assicurare che esse siano coerenti con la conoscenza che il soggetto designato ha del cliente, della sua attività economica e del suo profilo di rischio, anche riguardo, se necessario, all'origine dei fondi, e assicurarsi che siano tenuti aggiornati i documenti, i dati o le informazioni detenute. In presenza di un rischio di riciclaggio e di finanziamento del terrorismo elevato, il soggetto designato deve svolgere, con aumentata frequenza, una revisione dei documenti, dei dati e delle informazioni precedentemente ottenute e, se necessario, avviare ulteriori approfondimenti sull’operatività del cliente.
Le aste di Nomisma non sono soggette al Diritto di recesso essendo precedute dall’esposizione dei lotti che sono visionabili prima di effettuare le offerte, presso la sede di San Marino.
Per la partecipazione alle aste, in qualsiasi delle modalità sopra indicate, Nomisma si riserva a propria discrezione il diritto di chiedere al partecipante, che con l’iscrizione accetta incondizionatamente, il rilascio di idonee garanzie per permettere al partecipante stesso di poter formulare offerte al fine dell’aggiudicazione di un bene oggetto dell’incanto. Si riserva inoltre di rifiutare le offerte di acquirenti non conosciuti o non graditi, a meno che venga lasciato un deposito ad intera copertura del prezzo dei lotti desiderati o fornita altra adeguata garanzia. Il soggetto che abbia cauzionato l’offerta e che non riuscisse ad aggiudicarsi il/i lotto/i non potrà in alcun caso rivendicare altre somme oltre l’ammontare del deposito medesimo, rinunciando espressamente sin d’ora a qualsiasi azione in tal senso. Per le aste in sala, Nomisma si riserva il diritto di negare a chiunque, a propria discrezione, l’ingresso nei propri locali e la partecipazione all’asta. In seguito al mancato o ritardato pagamento da parte di un acquirente di un lotto a lui aggiudicato, Nomisma potrà rifiutare qualsiasi offerta fatta dallo stesso o da un suo rappresentante nel corso di successive aste.
5. OFFERTE
Nomisma ha facoltà di ritirare dall’asta qualsiasi bene posto in vendita ed ha, inoltre, facoltà, a suo insindacabile giudizio, di abbinare o separare i lotti e di variarne l’ordine di vendita, purché i lotti non vengano posti in asta anteriormente alla data prevista. Il Banditore ha facoltà di accettare sia le offerte del pubblico presente sia quelle di persone non presenti, ovvero telefoniche, per corrispondenza o online, purché comunicate anteriormente all’asta nelle forme stabilite per l’asta stessa e rinvenibili sul relativo regolamento, come sopra disciplinato.
La base d’Asta è la stima indicata per ciascun lotto; non potranno essere in alcun modo accettate offerte inferiori a detta stima.
Gli scatti minimi sono regolati dal Banditore della vendita. L’aggiudicazione dei beni è fatta al miglior offerente, con apposita dichiarazione del Banditore che varrà quale accettazione dell’offerta, proposta dal partecipante all’asta. A parità di valore si terrà conto dell’ordine d’arrivo. I concorrenti all'asta per corrispondenza possono informarsi dell’esito delle loro offerte telefonando, a partire da tre giorni lavorativi dopo la chiusura dell’asta, allo 0549/904012. Nomisma spa non si assume alcuna responsabilità nell’informare i clienti dell’esito delle loro offerte.
Ove sorga contestazione intorno all’aggiudicazione, il bene disputato, ad insindacabile giudizio del Banditore, potrà essere ritirato dall’asta, oppure rimesso in vendita all’incanto nella stessa seduta, sulla base dell’ultima offerta raccolta.
Nomisma si riserva il diritto di rifiutare offerte provenienti da, o riconducibili a, soggetti che in precedenza non abbiano puntualmente onorato obbligazioni pecuniarie, anche a titolo risarcitorio nei confronti di Nomisma stessa.
Si premette che i valori di stima indicati nel catalogo sono espressi in euro e costituiscono una mera indicazione.
6. DIRITTI D’ASTA
Al prezzo di aggiudicazione, che avverrà alla terza chiamata, sono da aggiungere i diritti di asta in misura pari al 21,63% (ventunovirgolasessantatre percento). Qualunque ulteriore onere o tributo relativo all’acquisto sarà comunque a carico dell’aggiudicatario.
7. CONSEGNA DEI LOTTI AGGIUDICATI E PAGAMENTO
Fermo ed impregiudicato quanto previsto all’Art. 4 sull’”Adeguata Verifica”, i lotti aggiudicati dovranno essere inderogabilmente pagati e ritirati dall’acquirente entro e non oltre 24 ore dall’aggiudicazione, termine essenziale ad ogni effetto di Legge. Il ritiro dovrà avvenire presso la sede di Nomisma a cura e spese dell’aggiudicatario. Nomisma sarà obbligata a consegnare i beni aggiudicati esclusivamente a seguito del buon fine del pagamento dell’intero importo a cui è stato aggiudicato il lotto da parte del Banditore e dei diritti d’asta. A propria discrezione Nomisma potrà chiedere all’acquirente il versamento di un acconto per perfezionare l’aggiudicazione, il medesimo giorno dell’asta. Dall’aggiudicazione al ritiro i beni saranno in giacenza a rischio esclusivo dell’acquirente.
Il pagamento potrà essere effettuato in contanti, purché non sia pari o superi l’importo previsto dalla normativa vigente, per assegno circolare intestato a Nomisma S.p.a., per bonifico bancario al conto corrente bancario che sarà comunicato al momento dell’aggiudicazione. In quest’ultimo caso il pagamento sarà considerato valido e il lotto sarà consegnato solo con il buon fine ed una volta che l’importo sarà irrevocabilmente accreditato sul conto corrente bancario di Nomisma.
Le spedizioni per posta dei beni aggiudicati verranno evase solo dopo pagamento anticipato; la merce viaggerà a spese, rischio e pericolo del committente. Per le fatture non pagate entro 30 giorni saranno addebitati gli interessi in ragione del tasso legale maggiorato del 7% annuo. L’acquirente è tenuto ad osservare le eventuali leggi doganali sostenendone i relativi costi, comprese le spese postali che di seguito, salvo diversa comunicazione scritta da parte di Nomisma, si vanno ad elencare per ciascun invio:
fino ad euro 300,00 spese di packaging euro 15,00 + 1% del valore della ricevuta per assicurazione (Italia)
fino ad euro 300,00 spese di packaging euro 25,00 + 1% del valore della ricevuta per assicurazione (resto del mondo)
sopra euro 300,00 spese di packaging euro 20,00 + 1% del valore della ricevuta per assicurazione (Italia)
sopra euro 300,00 spese di packaging euro 35,00 + 1% del valore della ricevuta per assicurazione (resto del mondo)
per importi superiori ai € 3.000,00 le spese saranno calcolate in base al tipo di spedizione
Nomisma curerà nel miglior modo possibile la spedizione dei lotti aggiudicati rimanendone comunque sempre il rischio a carico dei committenti i quali dovranno fornire precise istruzioni per la spedizione stessa tenendo presente che San Marino non è Paese UE e considerando quindi tutte le vigenti normative doganali e postali. A mero titolo esemplificativo si evidenzia che non è possibile spedire per assicurata postale nei seguenti Paesi, tra gli altri: Gran Bretagna, Germania, Albania, Canada, USA e Paesi arabi in genere. Per Gran Bretagna, Germania, Canada, USA, Nomisma provvederà a stipulare un’assicurazione privata senza tuttavia alcun impegno o responsabilità. Non è possibile in ogni caso spedire con assicurazione anche per corriere nei Paesi arabi in genere. In caso di emissione di documento doganale T2, i committenti sono tenuti al versamento dei diritti doganali d’importazione a titolo di cauzione; tale somma verrà restituita alla chiusura del detto documento doganale. I committenti sono pregati di informarsi preventivamente su queste disposizioni doganali e postali prima dell’ordine d’acquisto. Si precisa doverosamente che FEDEX e DHL non ritirano monete in Italia né a San Marino.
Nel caso l’acquirente non si presenti per il ritiro dei lotti nei termini sopra stabiliti e non provveda al pagamento dell’intero ammontare dovuto entro il termine essenziale ad ogni effetto di Legge previsto dalle presenti Condizioni Generali ovvero nel caso si presenti ma non paghi, in tutto o in parte, l’ammontare totale dovuto entro i termini previsti dalle presenti Condizioni Generali, Nomisma avrà diritto, a propria discrezione, fatti salvi gli eventuali ulteriori diritti e rimedi di legge di: (i) risolvere, in nome e per conto del venditore, il contratto di compravendita, restando inteso che in tale caso Nomisma potrà chiedere all’aggiudicatario il risarcimento, a proprio favore e/o a favore del conferente, di tutti i danni verificatisi, costituiti, in particolare e a titolo esemplificativo, dal minor prezzo realizzato in una successiva vendita, dai diritti, dalle spese, dagli oneri, anche legali, sopportati, avendo anche il diritto di trattenere a titolo di danno eventuali acconti ricevuti sul prezzo, ecc.; ovvero (ii) agire in via giudiziale in qualità di mandatario all’incasso del venditore per ottenere l’esecuzione coattiva dell’obbligo d’acquisto e il pagamento del prezzo di acquisto, oltre interessi, spese, oneri, e le spese legali necessarie per ottenere l’adempimento del contratto di compravendita. In caso di risoluzione del contratto, Nomisma, a propria discrezione potrà decidere se restituire il bene al mandante, esigendo a titolo di penale da parte dell’aggiudicatario anche l’importo corrispondente al mancato pagamento delle commissioni perdute, ovvero vendere il lotto tramite trattativa privata o in aste successive per conto ed a spese dell’aggiudicatario, salvo in ogni caso il diritto al risarcimento dei danni.
Decorso il termine di cui al primo comma del presente articolo Nomisma resterà responsabile della custodia del/i lotto/i aggiudicato/i nei confronti dell’aggiudicatario solo ed esclusivamente sino al passaggio di proprietà e/o consegna al vettore, all’acquirente o a suo delegato debitamente autorizzato, fermo restando la sua facoltà di poter richiedere eventuali costi sostenuti per la custodia oltre il termine suddetto.
Qualunque rischio per perdita o danni al bene aggiudicato si trasferirà all’acquirente dal momento del passaggio di proprietà e/o consegna al vettore, all’acquirente o a suo delegato.
L’acquirente potrà ottenere la consegna dei beni acquistati solamente previa corresponsione a Nomisma del prezzo e di ogni altra commissione, costo o rimborso inerente.
8. VENDITA CON RISERVA DELLA PROPRIETÀ
I lotti sono venduti con riserva della proprietà e pertanto la proprietà degli stessi si trasferirà in capo all’acquirente solo al momento dell’integrale pagamento del prezzo dovuto per la vendita e dei diritti d’asta. Il rischio di perimento o di danneggiamento dei lotti si trasferirà all’acquirente al momento della consegna dei lotti stessi. L’obbligo di consegna dei lotti venduti è in ogni caso subordinato al previo integrale pagamento da parte dell’acquirente del prezzo dovuto e di tutti i diritti d’asta.
9. FORO COMPETENTE
Le presenti Condizioni di Vendita, regolate dalla legge Sammarinese e con espressa esclusione delle norme di diritto internazionale privato, sono accettate tacitamente da tutti i soggetti partecipanti alla procedura di vendita all’asta e restano a disposizione di chiunque ne faccia richiesta. Per qualsiasi controversia relativa all’attività di vendita all’asta presso Nomisma è stabilita la competenza esclusiva del Tribunale di San Marino con esclusione espressa di qualsiasi Foro alternativo.
10. PRIVACY
Nomisma, nella sua qualità di titolare del trattamento, informa che i dati forniti verranno utilizzati, con mezzi cartacei ed elettronici, per poter dare piena ed integrale esecuzione ai contratti di compravendita stipulati dalla stessa società, nonché per il perseguimento di ogni altro servizio inerente l’oggetto sociale di Nomisma S.p.a.. Il conferimento dei dati è facoltativo, ma si rende strettamente necessario per la partecipazione alle aste ed all’esecuzione dei contratti conclusi. La registrazione alle aste consente a Nomisma di inviare i cataloghi delle aste successive ed altro materiale informativo relativo all’attività della stessa.
A proprio insindacabile giudizio Nomisma si riserva di registrare in qualsiasi forma la seduta dell’asta nonché registrare i collegamenti telefonici.
11. COMUNICAZIONI

12. ESCLUSIONE DI RESPONSABILITÀ IN RELAZIONE ALLE CONDIZIONI DI VENDITA CONTENUTE NEI CATALOGHI
Le Condizioni di Vendita, le informazioni e i testi dei cataloghi in lingua diversa rispetto alla lingua italiana rappresentano soltanto traduzioni ausiliari senza effetto vincolante. Nomisma non si assume alcuna responsabilità in relazione alla correttezza di tali traduzioni.
Il testo in lingua Italiana delle presenti Condizioni Generali sarà l’unico a produrre effetti tra le Parti e potrà essere utilizzato prevalendo su qualsiasi traduzione; la traduzione/versione in inglese è una semplice comodità degli interessati.
13. VARIE
I diritti d’autore attinenti a tutte le immagini, illustrazioni e documenti scritti, realizzati da o per Nomisma Spa, relativi a un lotto o a un contenuto specifico del catalogo, sono e rimarranno di proprietà di Nomisma Spa. Tali contenuti non potranno pertanto essere utilizzati dall’acquirente e/o da terzi senza il previo consenso scritto di Nomisma Spa.
Qualora una o più clausole delle presenti Condizioni Generali dovessero essere o diventare inefficaci o invalide per qualsivoglia motivo, tale inefficacia o invalidità non inficerà l’efficacia giuridica delle restanti disposizioni. Le disposizioni inefficaci o invalide verranno sostituite da disposizioni idonee a salvaguardare il più possibile la ratio della disposizione invalida.
La partecipazione all’Asta implica l’integrale accettazione delle presenti condizioni di vendita.
Qualsiasi modifica o integrazione delle presenti condizioni generali di vendita sarà invalida se non effettuata per iscritto.
15. VESSATORIE
L’offerente dichiara di aver letto, compreso e di approvare espressamente le su estese Condizioni Generali ed in particolare quelle dei seguenti articoli: 1, 2, 3, 4, 5, 7, 8, 9, 10, 12, 13 e 14.
Terms of sale
TERMS AND CONDITIONS
Nomisma S.p.a. (hereinafter "Nomisma") carries out auction sales of goods based exclusively on these general conditions of sale (hereinafter the "General Conditions"). Any general conditions applied by customers will therefore not be applicable and will remain ineffective.
The auction sale of goods grouped into lots is carried out in places open to the public. Sales are made to the highest bidder and are intended for "cash".
Nomisma acts as an agent with its own name on behalf of the owners of the goods offered for sale. The sale must be considered to have taken place between the owner and the buyer. It follows that Nomisma does not assume any responsibility towards buyers or third parties in general other than those deriving from its role as agent. All responsibility continues to be borne by the owners of the goods. The Award of the Sales Manager (or the Auctioneer) determines the conclusion of the sales contract between the owner and the buyer.
1. LOTS FOR SALE - STATE OF PRESERVATION
The lots are sold in the conditions in which they are found ("as is"). The descriptions and illustrations contained in the catalogs, on the website or in any other illustrative material are purely indicative and will not generate any kind of damage to the successful bidders. By appointment, it will be possible to view the lots in the days prior to the auction and thus until the beginning of the same with the aim of examining the authenticity, attribution, state of conservation, origin, type and quality and any defects of the items offered for sale and clarify any compliance with respect to what is indicated in the catalog. By registering and / or participating in the auction, those interested in purchasing a lot acknowledge that they have had the opportunity to examine it in depth, eventually with the advice of a trusted expert, to ascertain all its characteristics.
Nomisma does not guarantee in any way the contents of technical expertise on coins or other objects offered for sale, including by way of example and not limited to: watches, jewels, pens and books, carried out by third parties or entities; such contents will be purely indicative.
After the award, no disputes are allowed regarding the contents of appraisals on coins or other items offered for sale, including by way of example and not limited to: watches, jewelry, pens and books, made by third parties or entities.
In particular and for greater clarification of these General Conditions, with regard to the following objects possibly placed in auction, the following is specified:
a) Watches.
The descriptions of the watches have been made by our experts in good faith and conscience but every description, as well as our every opinion, is to be understood as absolutely indicative and does not exempt the potential buyer from direct verification in person according to the said provisions for access to the goods.
Nomisma does not guarantee the correct functioning of the watch even if in the description criteria of reliability and rigor have been kept, listing both merits and defects, evident and otherwise. Each watch is sold in the state of fact and law in which it is found and subsequent complaints on the originality of the various components will not be accepted. Therefore, the final purchaser is advised to carry out a thorough review of the object at authorized centers.
During the sale, for internal and logistic reasons, it will not be possible to examine the watches. Potential bidders are strongly advised to take an appointment with Nomisma before the auction in order to examine the watches of interest directly and possibly with a trusted expert.
Without prejudice to all of the above regarding the condition of the goods and their description, Nomisma is available to send, upon request to be sent at least 7 working days prior to the auction, further photographic or video material as it is available for telephone interviews.
The carats indicated in the goods descriptions are to be understood as estimated and the precise carat weight is not guaranteed.
b) Jewelery.
The descriptions of the jewels have been made by our experts in good faith and conscience but every description, as well as our every opinion, is to be understood as absolutely indicative and does not exempt the potential buyer from direct verification in person according to the said provisions for access to the goods.
Potential bidders/buyers are strongly advised to make an appointment with Nomisma before the auction in order to examine the jewels of interest directly and possibly with a trusted expert.
During the sale, for internal and logistic reasons it will not be possible to examine the jewels; each Jewel, in fact, is sold in the state of fact and law in which it is found and subsequent complaints will not be accepted.
Without prejudice to all of the above regarding the condition of the goods and their description, Nomisma is available to send, upon request to be sent at least 7 working days prior to the auction, further photographic or video material as it is available for telephone interviews.
The carats indicated in the goods descriptions are to be understood as estimated and the precise carat weight is not guaranteed.
c) Pens.
The description of the Pens has been made carefully but potential bidders/buyers are strongly advised to have a direct view of the said goods in order to ascertain the defects described and their authenticity. Each pen, in fact, is sold in the state of fact and law in which it is found and subsequent claims will not be accepted.
During the sale for internal and logistic reasons it will not be possible to examine the pens.
Nomisma is available to send, upon request to be sent at least 7 working days prior to the auction, further photographic or video material as it is available for telephone interviews to describe the goods.
d) Books.
The description of the books has been made carefully but potential buyers/bidders are strongly advised to have a direct view of them in order to ascertain the defects described which may vary according to different opinions. Each book, in fact, is sold in the state of fact and law in which it is found and once the award has been made, no complaints will be taken into consideration regarding deficiencies, defects or classification errors.
During the sale for internal and logistic reasons it will not be possible to examine the books.
Nomisma is available to send, upon request to be sent at least 7 working days prior to the auction, further photographic or video material as it is available for telephone interviews to describe the goods.
Lots offered for sale are to be considered as used antiques and as such not qualifiable as a "product" according to the definition set out in art. 3 lett. e) of the italian D.Lgs 6.09.2005 n. 206 (Consumer Code), referred to here for indicative purposes only but not binding.
2. COMPLAINTS
Unless otherwise provided in these Terms and general Conditions, Nomisma will consider complaints only regarding disputes on the authenticity of the lots, on the existence of serious defects or hidden defects and / or on the non-conformity between the purchased lots and those described in the auction catalog and available for viewing before the auction. In this regard, it will not be considered a lack of conformity that of which the buyer should have been aware at the time of purchase having had the opportunity to view the lot in the catalog or during the exhibition preceding the sale (ie the defect which he could not ignore using ordinary diligence).
Any complaints must be communicated by registered letter with return receipt within 20 (twenty) calendar days from the auction and in any case before Nomisma spa has made the payment to the transferor. In the event of a dispute, submitted and validated within the prescribed period, any obligation or liability will be limited to reimbursement to the buyer of the sum actually paid by him, excluding any other claim.
Complaints will not be accepted under any circumstances:
(a) for flaws or defects expressly mentioned in the catalog or easily detectable by the photograph of the lot or by viewing before the auction;
(b) relating to multiple lots such as collections or accumulations of any kind;
(c) relating to lots explicitly referred to in the auction catalog with the clause "to be examined";
(d) inherent to the state of conservation of the lots being the evaluation of the conservation entirely subjective and the sale being subject to the clause "as seen and liked";
(e) for flaws or defects attributable to the conduct of the buyer following the delivery of the lot.
(f) after 20 days from the auction date.
Nomisma will give written feedback to complaints within 60 days from the receipt.
Nomisma will accept complaints only in the event that, in the opinion of two independent experts appointed by each party, the lot is found to be inauthentic, affected by serious defects or hidden defects and / or not at all compliant with what is described in the auction catalog. In this case, only the refund of the sums paid for the purchase and delivery of the lot will be due to the buyer, any compensation or refund being expressly excluded. In the event that the customer submits a coin to the grading companies after the auction, the judgment of the latter regarding conservation and in particular regarding, for example, the definitions of CLEANED, DETAILS etc. cannot be contested against Nomisma spa as it does not give the right to terminate the contract.
3. LIMITATION OF LIABILITY
Nomisma assumes no responsibility in relation to any damage that may arise to the buyer, who assumes all risk in relation to any damage that may arise from, or be related to, the purchased goods.
4. PARTICIPATION IN THE AUCTION
To participate the auction in the room, subjects who intend to compete for the award of any lot, must ask for the appropriate "identification number" from Nomisma personnel and communicate their personal details and registered residence, with exhibition and copy of the document of identity and tax code. Nomisma reserves the right to request from the participants in the auction information on general information and bank references, as well as the right, also and not only following these checks, to prohibit unwanted participants from entering the room. If the participant acts in the name and on behalf of another person or entity, a suitable verifiable power of attorney must be presented before the auction is held.
To participate in the "online" and / or "E-live" auction (in both cases also by correspondence or telephone), the participant must sign and send the appropriate form to Nomisma within the starting time of the reference auction, thus accepting to take part in it and undertaking to pay the realized price if the asset is awarded. In any case Nomisma will not be held responsible for non-participation if this form is not received in due time, or if it is not properly filled in. The participant also agrees to check, at the end of the auction, if his offers have been successful, relieving Nomisma of any responsibility in this regard. Complaints due to negligence, lack of clarity or error in the compilation of written offers by correspondence will not be accepted.
Nomisma disclaims any responsibility towards those who participate in the auction in the event of non-execution of the participation due to any misunderstandings that may occur during or before the telephone and / or internet connection.
To participate in the online auction, you must register on the website https://nomismaweb.com; participation can only be made online by accessing the Nomisma website and the award will be made to the highest bidder. The lots, which can be viewed in advance on the Nomisma website and in the related Catalog, are offered for sale at an auction base (estimate) under which they cannot be awarded. The possibility of making bids is limited to a predetermined duration, indicated from time to time, during which it will be possible, at any time, to make a maximum bid for each lot.
Following the award of a lot, the successful bidder will receive the informations necessary for the balance of their purchases and the methods of collection or delivery of the lots. Upon request and at the expense of the successful bidder, Nomisma can arrange home delivery by specialized courier.
The Participant/customer is made fully aware of how Nomisma is required to comply with the national anti-money laundering legislation of San Marino (Law no.82 of June 17, 2008), together with its subsequent amendments and additions, and therefore unconditionally accepts that upon the said legislation the so-called "Adequate Verification" (Adeguata Verifica) is requested, in addition to the delivery of documents and information to the successful bidder; by signing and accepting these Conditions, the Participant also undertakes to do everything necessary so that Nomisma carries out this activity aware of the fact that, even after the award and payment of the price, Nomisma will have the right not to release the goods if the "Adequate Verification ” will not have been completed as required by the law.
In particular, the "Adequate Verification" literally consists of the following:
• identification of the Participant/customer and verification of his identity on the basis of documents, data or information obtained from a reliable and independent source;
• identification of the beneficial owner and adoption of reasonable measures to verify his identity, by using information and data from reliable sources, so that the designated person is certain of the identity of the beneficial owner;
• understanding and acquiring information on the purpose and intended nature of the business relationship or professional service. In any case of a high level of money laundering and terrorist financing risk, the activity of understanding and acquiring information on the intended purpose and nature should also be applied to occasional transactions, other than professional service;
• exercise a constant control of the business relationship, also by carrying out a check on the transactions concluded during this relationship, in order to ensure that they are consistent with the knowledge that the designated subject has of the customer, of his economic activity and his profile risk, including, if necessary, the origin of the funds, and ensure that the documents, data or information held are kept up to date. In the presence of a high risk of money laundering and terrorist financing, the designated subject must carry out, with increased frequency, a review of the documents, data and information previously obtained and, if necessary, initiate further investigations on the client's operations.
Nomisma's auctions are not subject to the right of withdrawal as they are preceded by the display of the lots that can be viewed before bidding, at the San Marino headquarters.
For participation in auctions, in any of the aforementioned methods, Nomisma reserves the right at its own discretion to ask the participant, who unconditionally accepts with the registration, the release of suitable guarantees to allow the participant to be able to formulate offers for the purpose the award of an asset subject to the auction. It also reserves the right to refuse offers from unknown or unwelcome buyers, unless a deposit is left to fully cover the price of the desired lots or other adequate guarantee is provided. The person who has secured the offer and who fails to win the lot (s) will in no case be able to claim other sums beyond the amount of the deposit itself, expressly renouncing as of now any action in this regard. For auctions in the hall, Nomisma reserves the right to deny anyone, at its discretion, entry to its premises and participation in the auction. Following the non-payment or delayed payment by a buyer of a lot awarded to him, Nomisma may refuse any offer made by him or by his representative in the course of subsequent auctions.
5. OFFERS
Nomisma has the right to withdraw from the auction any goods put up for sale and also has the right, at its sole discretion, to combine or separate the lots and to vary the sale order, provided that the lots are not put up for auction before the expected date. The Auctioneer has the right to accept both offers from the public present and those of people not present, or by telephone, by correspondence or online, provided that they are communicated prior to the auction in the forms established for the auction itself and can be found in the relative regulations, as regulated above.
The auction starting price correspond to the estimation indicated for each lot; bids lower than that estimate value cannot be accepted in any way.
The minimum raises are regulated by the Auctioneer of the sale. The award of the assets is made at the best bidder, with a specific declaration by the Auctioneer which will be valid as acceptance of the bid, proposed by the participant in the auction. For the same value, the order of arrival will be taken into account. Participants in the mail order auction can inquire about the outcome of their bids by calling 0549/904012, starting three working days after the auction has closed. Nomisma spa assumes no responsibility in informing customers of the outcome of their offers.
Where a dispute arises about the award, the disputed property, at the sole discretion of the Auctioneer, may be withdrawn from the auction, or put back up for auction in the same session, on the basis of the last bid collected.
Nomisma reserves the right to refuse offers from, or attributable to, subjects who have not previously duly honored pecuniary obligations, including as compensation for Nomisma itself.
It should be noted that the estimated values indicated in the catalog are expressed in euros and constitute a simple advice.
6. AUCTION RIGHTS
To the hammer price, which will take place on the third call, auction rights are to be added in an amount equal to 21,63% (twenty-one point sixty-three). Any further charges or taxes relating to the purchase will in any case be borne by the successful bidder.
7. DELIVERY OF THE AWARDED LOTS AND PAYEMENT
The awarded lots must be paid and collected by the buyer no later than 24 hours after the award, an essential deadline for all legal purposes. The collection must take place at the Nomisma headquarters by and at the expense of the successful bidder. Nomisma will be obliged to deliver the awarded assets only after successful payment of the full amount to which the lot was awarded by the buyer plus the auction rights. At its discretion, Nomisma may ask the buyer to pay a deposit to finalize the award, on the same day of the auction. From the award to the withdrawal, the goods will be in storage at the exclusive risk of the buyer.
Payment can be made in cash, provided that it is not equal to or exceeds the legal amount provided for by current legislation, by bank draft made out to Nomisma S.p.a., by bank transfer to the bank account that will be communicated at the time of the award. In the latter case, the payment will be considered valid and the lot will be delivered only with successful completion and once the amount is irrevocably credited to Nomisma's bank account.
Shipments by Post of the awarded goods will be processed only after advance payment; the goods will travel at the expense, risk and peril of the customer. For invoices not paid within 30 days, interest will be charged at the statutory rate increased by 7% per annum. The buyer is required to observe any customs laws and incur the related costs, including postage which, unless otherwise communicated in writing by Nomisma, are listed below for each shipment:
• up to €300.00 packaging costs €15.00 + 1% of the receipt value for insurance (Italy)
• up to €300.00 packaging costs €25.00 + 1% of the receipt value for insurance (rest of the world)
• over €300.00 packaging costs €20.00 + 1% of the receipt value for insurance (Italy)• above € 1,000.00 and up to € 3,000.00, postage costs € 26.00;
• over €300.00 packaging costs €35.00 + 1% of the receipt value for insurance (rest of the world)
• for amounts exceeding €3,000.00, the costs will be calculated based on the type of shipping
Nomisma will take care of the shipment of the awarded lots in the best possible way, always remaining the risk borne by the customers who must provide precise instructions for the shipment itself, bearing in mind that San Marino is not an EU country and therefore considering all current customs and postal regulations. By way of example, it should be noted that it is not possible to ship by registered mail to the following countries, among others: Great Britain, Germany, Albania, Canada, USA and Arab countries in general. For Great Britain, Germany, Canada, USA, Nomisma will take out private insurance without any commitment or liability.
It is not possible to ship with insurance even by courier in Arab countries in general. In the event of the issuance of a T2 customs document, customers are required to pay import customs duties as a deposit; this sum will be returned when the customs document is closed. Customers are requested to inquire in advance about these customs and postal provisions before placing the purchase order. It is dutifully specified that FEDEX and DHL do not collect coins in Italy or in San Marino.
In the event that the buyer does not present himself for the collection/withdrawal of the lots within the terms established above and fails to pay the entire amount due within the essential deadline for all purposes of the law provided for by these General Conditions, or in the event he presents himself but does not pay in whole or in part, the total amount due within the terms set out in these General Conditions, Nomisma will be entitled, at its discretion, without prejudice to any further legal rights and remedies to: (i) terminate, in the name and on behalf of the seller, the sale contract, it being understood that in this case Nomisma may ask the successful bidder for compensation, in its own favor and / or in favor of the assignor, for all damages that have arisen, in particular and by way of example, by the lower price achieved in a subsequent sale, by the rights, expenses, charges, including legal ones, borne, also having the right to withhold as damage any advances received on the price, etc .; or (ii) take legal action as a collection agent for the seller to obtain the compulsory execution of the purchase obligation and the payment of the purchase price, plus interest, expenses, charges, and legal fees necessary to obtain the fulfillment of the sales contract. In the event of termination of the contract, Nomisma, at its own discretion, may decide whether to return the asset to the seller, demanding as a penalty from the successful bidder the amount corresponding to the non-payment of the lost commissions, or to sell the lot through private negotiation. or in subsequent auctions on behalf and at the expense of the successful bidder, except in any case the right to compensation for damages.
Once the term referred to in the first paragraph of this article has elapsed, Nomisma will remain responsible for the custody of the awarded lot(s) towards the successful bidder only and exclusively up to the transfer of ownership and / or delivery to the carrier, the buyer or his duly authorized delegate, without prejudice to his right to request any costs incurred for custody after the aforementioned term.
Any risk for loss or damage to the awarded lot(s) will be transferred to the buyer from the moment of transfer of ownership and / or delivery to the carrier, the buyer or his delegate.
The buyer will be able to obtain the delivery of the purchased goods only upon payment to Nomisma of the price and any other inherent commission, cost or reimbursement.
8. SALE WITH RESERVE OF OWNERSHIP
Lots are sold with reserve of ownership and therefore the said ownership will be transferred to the buyer only at the time of full payment of the price due for the sale plus the auction rights. The risk of loss or damage to the lots will be transferred to the buyer upon delivery of the lots. The delivery of the lots sold is in any case subject to the prior full payment by the buyer of the price due and all auction fees.
9. JURISDICTION
These General Conditions of Sale, exclusively governed by San Marino law and with the express exclusion of the rules of private international law, are tacitly accepted by all parties participating in the auction sale procedure and remain available to anyone who requests them. For any dispute relating to the auction sales activity at Nomisma, the exclusive jurisdiction of the Court of San Marino is established with the express exclusion of any alternative Court.
10. PRIVACY
Nomisma, in its capacity as data controller, informs that the data(s) provided will be used, by paper and electronic means, in order to be able to give full and complete execution to the sales contracts stipulated by the same company, as well as for the pursuit of any other service concerning the purpose of Nomisma Spa. The provision of data is optional, but it is strictly necessary for participation in auctions and for the execution of contracts. Registration for auctions allows Nomisma to send the catalogs of subsequent auctions and other information material relating to its activity.
At its sole discretion, Nomisma has the right to record the auction session in any form and has the right to record any telephone connections.
11. COMMUNICATIONS
Any communication relating to the sale/auction must be made by registered letter with return receipt. addressed to:

12. EXCLUSION OF LIABILITY RELATED TO THE TERMS OF SALE CONTAINED IN THE CATALOGS
This General Conditions of Sale, informations and the texts of the catalogs in a language other than the Italian language represent only auxiliary translations without a binding effect. Nomisma assumes no responsibility for the accuracy of such translations.
The Italian text of these General Conditions will be the only one to produce effects between the Parties and may be used overriding any translation; the translation / version in English is a simple convenience for those concerned.
13. MISCELLANEOUS
All copyrights relating to all images, illustrations and written documents, created by or for Nomisma Spa, relating to a specific lot or content of the catalog, are and will remain in the exclusive property of Nomisma Spa. Such contents cannot therefore be used by the buyer and / or any anyone without the prior written consent of Nomisma Spa.
Should one or more clauses of these General Conditions be or become ineffective or invalid for any reason, such ineffectiveness or invalidity will not affect the legal effectiveness of the remaining provisions. The ineffective or invalid provisions will be replaced by provisions suitable for safeguarding as much as possible the intent of the invalid provision.
Participation in the Auction implies full acceptance of these conditions of sale.
Any change or addition to these General Conditions of sale will be invalid if not made in writing.
14. SPECIAL CLAUSES
The bidder declares to have read, understood and expressly approve the extended General Conditions and in particular those of the following articles: 1, 2, 3, 4, 5, 7, 8, 9, 10, 12, 13 and 14.

Only at our offices in Strada Bulumina 6, Serravalle (RSM) - Friday, August, 30th 2024, from 10.00 am to 6.00 pm and Saturday, August 31st from 10.00am - the coins will not be viewing or delivered to the auction room.
