CONDITIONS GÉNÉRALES DE VENTE - PIASA
« Constituent des ventes aux enchères publiques les ventes faisant intervenir un tiers, agissant comme mandataire du propriétaire ou de son représentant, pour proposer et adjuger un bien au mieux- disant des enchérisseurs à l'issue d'un procédé de mise en concurrence ouvert au public et transparent. Le mieux-disant des enchérisseurs acquiert le bien adjugé à son profit ; il est tenu d'en payer le prix. Sauf dispositions particulières et le cas des ventes effectuées dans le cercle purement privé, ces ventes sont ouvertes à toute personne pouvant enchérir et aucune entrave ne peut être portée à la liberté des enchères. » (Article L 320-2 du Code de commerce)
La Maison de Ventes PIASA est un opérateur de ventes volontaires régi par les dispositions des articles L 321-1 et suivants du Code de commerce. La Maison de Ventes agit comme mandataire du vendeur qui contracte avec l’acheteur.
Les ventes aux enchères sont soumises aux présentes conditions générales.
AVANT LA VENTE
1. Description et présentation des lots
Les acquéreurs potentiels sont invités à examiner les biens pouvant les intéresser et à constater leur état avant la vente aux enchères, notamment pendant les expositions.
PIASA se tient à leur disposition pour leur fournir des rapports de condition sur l’état des lots, en fonction des connaissances artistiques et scientifiques à la date de la vente. Les rapports de condition sont disponibles gratuitement, sur demande, pour aider l’acquéreur potentiel à évaluer l’état d’un lot.
L’absence de réserve au catalogue n’implique pas que le lot soit en parfait état de conservation et exempt de restauration ou imperfection (usures, craquelures, rentoilage). Les lots sont vendus dans l’état dans lequel ils se trouvent au moment de la vente. En conséquence, aucune réclamation ne sera recevable dès l’adjudication prononcée, les lots ayant pu être examinés lors de l’exposition.
Les dimensions et poids sont donnés à titre indicatif. Les couleurs et les nuances peuvent différer sur papier ou à l’écran par rapport à leur présentation lors d’un examen physique.
2. Estimation
Dans le catalogue, l’estimation figure à la suite de chaque lot. Il ne s’agit que d’une indication, le prix d’adjudication résulte du libre jeu des enchères.
L’estimation basse mentionnée dans le catalogue ne peut être inférieure au prix de réserve, et pourra être modifiée jusqu’au moment de la vente.
Les estimations ne comprennent aucunes taxes ou frais applicables.
Les estimations peuvent être données en plusieurs monnaies. L’arrondie de ces conversions peut entraîner une légère modification des arrondissements légaux.
3. Provenance et authenticité
Dans le cadre de la protection des biens culturels PIASA met tout en œuvre dans la mesure de ses moyens pour s’assurer de la provenance des lots mis en vente. En cas de contestations notamment sur l’authenticité ou l’origine des objets vendus, la responsabilité éventuelle de PIASA, tenue par une obligation de moyens, ne peut être engagée qu’à la condition expresse qu’une faute personnelle et prouvée soit démontrée à son encontre.
L’action en responsabilité civile à l’encontre de la Maison de Ventes se prescrit par 5 ans à compter de l’adjudication ou de la prisée.
PIASA se réserve le droit de retirer le lot avant la vente ou pendant la vente aux enchères s’il y a des doutes sur son authenticité ou sa provenance.
4. Indications particulières
Les lots précédés d’un * appartiennent à un actionnaire, un collaborateur ou un expert de la société PIASA. Les notices d’information contenues dans le catalogue sont établies avec toutes les diligences requises, par PIASA et l’expert qui l’assiste le cas échéant, sous réserve des notifications, déclarations, rectifications, annoncées verbalement au moment de la présentation de l’objet et portées au procès-verbal de la vente.
PARTICIPATION A LA VENTE
Les enchérisseurs sont invités à se faire connaître auprès de PIASA avant la vente afin de procéder à l’enregistrement de leurs données personnelles.
Pour une personne physique, son enregistrement nécessite une pièce d’identité avec photo et un justificatif de domicile si son adresse actuelle ne figure pas sur la pièce d’identité.
Pour une société, son enregistrement nécessite un certificat d’immatriculation de moins de trois mois indiquant le nom du représentant légal et son siège social.
PIASA se réserve le droit de ne pas enregistrer un client à la vente si les collaborateurs considèrent que ce client n’apporte pas toutes les garanties pour la sécurité de la transaction. Toute fausse indication concernant l’identité du client engagera sa responsabilité.
Plusieurs possibilités s’offrent au client pour enchérir.
1. Enchères en salle
Le mode usuel pour enchérir consiste à être présent en salle pendant la vente. Vous devez vous enregistrer en ligne ou en personne au sein de nos locaux 24 heure avant la vente.
2. Ordres d’achat
Le client ne pouvant assister à la vente pourra laisser un ordre d’achat. PIASA agira pour le compte de l’enchérisseur, selon les instructions contenues dans le formulaire d’ordre d’achat, et au mieux de ses intérêts. Étant entendu que les limites en euros inscrites sur l’ordre d’achat correspondent au prix marteau et ne comprennent pas les taxes et commissions à la charge de l’acheteur. Lorsque deux ordres d’achat sont identiques, la priorité revient au premier ordre reçu.
3. Enchères téléphoniques
PIASA peut porter des enchères téléphoniques pour le compte d’un acquéreur potentiel. L’acquéreur potentiel devra se faire connaître au préalable de la maison de vente. La responsabilité de PIASA ne peut être engagée pour un problème de liaison téléphonique ou en cas d’erreur ou d’omissions relatives à la réception des enchères téléphoniques.
Il ne sera accepté aucune enchère téléphonique pour les lots dont l’estimation est inférieure à 300 €.
Les ordres d’achat écrits ou les enchères par téléphone sont une facilité pour les clients mise en place à titre
gracieux. Ni PIASA, ni ses employés ne pourront être tenus pour responsables en cas d’erreurs éventuelles ou omissions dans leur exécution comme en cas de non- exécution de ceux-ci.
4. Enchères en ligne
PIASA ne peut être responsable en cas de dysfonctionnement des plateformes utilisées pour enchérir en ligne. L’utilisateur doit prendre connaissance et accepter, sans réserve, les conditions d’utilisation de cette plateforme.
5. Mandat pour le compte d’un tiers
Tout enchérisseur est réputé agir pour son propre compte, cependant il peut informer au préalable PIASA de sa qualité de mandataire pour le compte d’un tiers.
PIASA se réserve le droit d’accepter ou de refuser le mandat.
Les demandes d’ordres d’achat et d’enchères téléphoniques peuvent être faites par le biais du formulaire en ligne sur le site https://piasa.fr ou en utilisant le formulaire prévu à cet effet à la fin du catalogue de vente.
DÉROULEMENT DE LA VENTE
1. Le jeu des enchères
Le commissaire-priseur est en droit de faire progresser librement les enchères. Dans le cas où un prix de réserve a été fixé par le vendeur, le commissaire-priseur peut faire porter les enchères pour le compte du vendeur jusqu’à ce que ce prix soit atteint.
Les enchères en salle priment sur les enchères online.
L’adjudicataire sera le plus offrant et le dernier enchérisseur.
Après le coup de marteau, le commissaire-priseur ne pourra prendre aucune enchère quelle qu’elle soit.
2. La présentation des objets
Les éventuelles modifications aux descriptions du catalogue seront énoncées verbalement pendant la vente et noté au procès-verbal.
PIASA peut utiliser des moyens vidéo pendant la vente aux enchères pour la présentation des objets mis en vente. PIASA ne pourra engager sa responsabilité en cas d’erreur de manipulation sur les plateformes (présentation d’un bien différent de celui sur lequel les enchères sont portées).
3. Droit de préemption
Conformément aux dispositions des articles L123-1 et L123- 2 du Code du Patrimoine, l’État français dispose d’un droit de préemption sur certaines œuvres d’art mises en vente lors des enchères publiques. L’État se trouve alors subrogé au dernier enchérisseur. L’exercice de ce droit intervient immédiatement après le coup de marteau, et est confirmé dans un délai de quinze jours à compter de la vente. PIASA ne pourra être tenu pour responsable des conditions de la préemption par l’État français.
EXÉCUTION DE LA VENTE
L’adjudication réalise le transfert de propriété. Un contrat de vente est conclu entre le vendeur et l’adjudicataire.
Dès l’adjudication, les objets sont placés sous l’entière responsabilité de l’acquéreur qui devra les enlever dans les plus brefs délais.
1. Paiement
L’article L320-2 du code de commerce énonce que le mieux disant des enchérisseurs acquiert le bien adjugé en son profit et est tenu d’en payer le prix au comptant.
Le règlement du bien, ainsi que celui des taxes s’y appliquant, sera effectué en euros.
L’adjudicataire pourra s’acquitter par les moyens suivants : 1. Par carte bancaire uniquement en salle et au 5 Boulevard Ney 75018 Paris: VISA et MASTERCARD. (L’American express n’est pas acceptée)
2. Par chèque bancaire certifié en euros avec présentation obligatoire d’une pièce d’identité en cours de validité, ou d’un Kbis datant de moins de 3 mois pour les personnes morales

4. Les chèques tirés sur une banque étrangère ne seront autorisés qu’après l’accord préalable de PIASA, pour cela, il est conseillé aux acheteurs d’obtenir, avant la vente, une lettre accréditive de leur banque pour une valeur avoisinant leur intention d’achat, qu’ils transmettront à PIASA.
5. En espèces :
- Jusqu’à 1000€ frais et taxes comprises lorsque le débiteur a son domicile fiscal en France ou agit pour les besoins d’une activité professionnelle.
- Jusqu’à 15000€ frais et taxes comprises lorsque le débiteur justifie qu’il n’a pas son domicile fiscal en France et n’agit pas pour les besoins d’une activité professionnelle, sur présentation d’un passeport et justificatif de domicile.
2. Frais acheteur
En sus du prix de l’adjudication, l’adjudicataire devra acquitter par lot et par tranche dégressive les commissions et taxes suivantes :

La société étant sous le régime fiscal de la marge prévu à l'Article 297A du CGI, il ne sera délivré aucun document faisant ressortir la TVA.
L’adjudicataire UE justifiant d’un numéro de TVA intracommunautaire et d’un document prouvant la livraison dans son Etat membre pourra obtenir le remboursement de la TVA sur les commissions.
Lots en provenance hors UE
Les lots dont le n° est précédé par le symbole ƒ sont soumis à des frais additionnels pouvant être rétrocédé à l’adjudicataire sur présentation des documents douaniers
d’exportation hors Union Européenne. Ces frais sont de 6.60% TTC (soit 5.50% HT) sur le prix de l'adjudication.
Les lots dont le n° est précédé par le symbole ƒƒ sont soumis à des frais additionnels de 24,00% TTC (soit 20% HT) sur le prix de l'adjudication.

3. Défaut de paiement
Conformément à l’article L 321-14 du Code de commerce, à défaut de paiement par l’adjudicataire, après mise en demeure adressée à l’acquéreur par lettre recommandée avec accusé de réception, restée infructueuse, le bien est remis en vente à la demande du vendeur sur réitération des enchères ; si le vendeur ne formule pas cette demande dans un délai de trois mois à compter de l’adjudication, PIASA aura mandat d’agir en son nom et pour son compte et pourra :
- soit notifier à l’adjudicataire défaillant la résolution de plein droit de la vente, sans préjudice des éventuels dommages-intérêts. L’adjudicataire défaillant demeure redevable des frais de vente ;
- soit poursuivre l’exécution forcée de la vente et le paiement du prix d’adjudication et des frais de vente, pour son propre compte et/ou pour le compte du vendeur.
PIASA SA se réserve le droit d’exclure des ventes futures tout adjudicataire qui aura été défaillant ou qui n’aura pas respecté les présentes conditions générales de vente.
À ce sujet, la société de ventes volontaires PIASA est adhérente au Registre central de prévention des impayés des Commissaires-priseurs auprès duquel les incidents de paiement sont susceptibles d’inscription. Les droits d’accès, de rectification et d’opposition pour motif légitime sont à exercer par le débiteur concerné auprès du Symev, 15 rue Freycinet, 75016 Paris.
RETRAIT DES LOTS
Le transport des lots devra être effectué aux frais et sous l’entière responsabilité de l’adjudicataire.
Aucun lot ne sera remis aux acquéreurs avant l’acquittement de l’intégralité des sommes dues. En cas de paiement par chèque ou par virement, la délivrance des objets, pourra être différée jusqu’à l’encaissement. Les frais de dépôt sont, en ce cas, à la charge de l’adjudicataire.
Tous les achats réglés pourront être enlevés 24 heures après la vente :

Les lots pourront être gardés à titre gracieux pendant 30 jours. Passé ce délai, des frais de dépôts et d’assurance seront supportés par les acquéreurs au tarif de 30€ HT forfaitaire et 3€ HT par jour calendaire et par lot, 6 € HT par jour calendaire et par lot concernant le mobilier.
Passé 60 jours, PIASA décline toute responsabilité quant aux dommages que l’objet pourrait encourir, la garantie de PIASA cessera alors de plein droit.
EXPORTATION
L’exportation hors de France ou l’importation dans un autres pays d’un lot, peut être affectée par les lois du pays dans lequel il est exporté, ou importé. L’exportation de tout bien hors de France ou l’importation dans un autre pays peut être soumise à l’obtention d’une ou plusieurs autorisation(s) d’exporter ou d’importer. Certaines lois peuvent interdire l’importation ou interdire la revente d’un lot dans le pays dans lequel il a été importé.
L’exportation de certains objets dans un pays de l’Union Européenne est subordonnée à l’obtention d’un certificat d’exportation délivré par les services compétents du Ministère de la Culture, dans un délai maximum de 4 mois à compter de sa demande.
La réglementation internationale du 3 mars 1973, dite Convention de Washington, a pour effet la protection de spécimens et d’espèces dits menacés d’extinction. L’exportation ou l’importation de tout lot fait ou comportant une partie (quel qu’en soit le pourcentage) en ivoire, écailles de tortues, peau de crocodile, corne de rhinocéros, os de baleine, certaines espèces de corail et en palissandre etc. peut être restreinte ou interdite.
A titre informatif, le nouveau règlement (UE) 2021/2280 de la Commission du 16 décembre 2021 interdit l’exportation en dehors de l’Union Européenne de tout lot contenant un élément en ivoire travaillé, à l’exception des instruments de musique pré-1975.
Il appartient, sous sa seule responsabilité, à l’acheteur de prendre conseil et vérifier la possibilité de se conformer aux dispositions légales ou règlementaires qui peuvent s’appliquer à l’exportation ou l’importation d’un lot, avant même d’enchérir. Dans certains cas, le lot concerné ne peut être transporté qu’assorti d’une confirmation par expert, aux frais de l’acheteur, de l’espèce et ou de l’âge du spécimen concerné.
PIASA peut, sur demande, assister l’acheteur dans l’obtention des autorisations et rapport d’expert requis. Ces démarches seront conduites aux frais de l’acheteur. Cependant, PIASA ne peut garantir l’obtention que les autorisations seront délivrées.
En cas de refus de permis ou de délai d’obtention de celui- ci, l’acheteur reste redevable de la totalité du prix d’achat du lot. Un tel refus ou délai ne saurait en aucun cas justifier le retard du paiement ou l’annulation de la vente.
LOI APPLICABLE ET ATTRIBUTION DE COMPÉTENCE
Les dispositions des conditions de vente sont indépendantes les unes des autres. La nullité d’une des conditions ne peut entraîner l’inapplicabilité des autres conditions de vente.
Les présentes conditions de ventes sont rédigées en français et régies par le droit français. Les éventuels litiges relatifs à l’interprétation ou l’application des présentes Conditions Générales de Vente seront portés devant les juridictions françaises, compétentes dans le ressort du siège social de PIASA.
PROTECTION DES DONNÉES PERSONNELLES
Le client PIASA dispose d’un droit d’accès et de rectification aux données nominatives fournies à PIASA dans les conditions de la loi Informatique et Liberté du 6 janvier 1978 modifiée par la loi du 6 août 2004. Depuis le 25 mai 2018, PIASA est en conformité avec la nouvelle réglementation européenne de la protection des données personnelles. Ces données pourront être communiquées aux autorités compétentes dès lors que la réglementation l’impose.
GENERAL TERMS AND CONDITIONS OF AUCTION - PIASA
“Public auctions are sales which involve the participation of a third party, acting as agent of the owner or his representative, to offer and sell an item of property to the highest bidder at the end of a process of competitive bidding that is open to the public and transparent. The highest bidder acquires the sold item for his own benefit ; he is bound to pay the price. Except where specially provided otherwise or for sales made within a purely private circle, these sales are open to any person able to bid and no restriction may be made on the freedom of bidding.” (Article L 320-2 of the Commercial Code)
The Maison de Ventes (Auction House) PIASA is a public auction operator governed by the provisions of Articles L 321-1 et seq. of the Commercial Code. The Auction House acts as agent of the seller who enters into contract with the buyer.
The auctions are subject to these general terms and conditions.
PRIOR TO THE SALE
1. Description and presentation of the lots
Potential buyers are invited to examine the items that may interest them and to observe their condition prior to the auction, including in particular during exhibitions.
PIASA remains at their disposal to provide reports on the condition of the lots, according to artistic and scientific knowledge at the date of the auction. Condition reports are available free of charge, upon request, to assist the prospective buyer in evaluating the condition of a lot.
The absence of a reserve in the catalog doesn’t imply that the lot is perfectly conserved and free of restorations or imperfections (wear and tear, cracks, lining). The lots are sold in the condition in which they are at the time of the sale. Consequently, no claim will be admissible as of the time of the adjudication, as the lots were available for examination at the exhibition.
The dimensions and weights are given for information only. Colors and shades may vary on paper or on screen from their presentation during a physical examination.
2. Appraisal
In the catalog, appraisal appears after each lot. This is only an indication, the hammer price shall result from free bidding. Appraisals may be given in several currencies. The rounding of these conversions may lead to a slight difference compared to laws on rounding.
The low estimate mentioned in the catalog cannot be lower than the reserve price, and can be modified until the moment of the sale.
Appraisals don’t include any applicable taxes or fees.
3. Provenance and authenticity
In the framework of the protection of items of cultural property, PIASA makes all effort within its means to verify the origin of the auctioned lots. In the event of dispute, notably as to the authenticity or origin of the sold items, PIASA, bound by a best efforts obligation, shall only be liable under the express condition of demonstration that it has committed a proven personal wrong.
Any liability claim against the Auction House will be barred after the limitation period of 5 years following the sale or appraisal. PIASA reserves the right to withdraw the lot from auction at any time if there is doubt as to its authenticity or origin.
4. Special indications
The lots preceded by an * belong to a shareholder, employee or expert of PIASA. The information notices contained in the catalogue are drawn up with all due diligence, by PIASA and the expert assisting it where relevant, subject to any notifications, declarations or rectifications announced orally at the time of presentation of the item and set down in the minutes of the sale.
PARTICIPATION TO THE AUCTION
Bidders are invited to present themselves to PIASA SA before the sale in order to enable their personal details to be registered (an identity document will be requested). For an individual, registration requires photo identification and proof of address if the current address is not on the identification.
For a company, registration requires a certificate of registration less than three months old indicating the name of the legal representative and the registered office.
PIASA reserves the right not to register a client for sale if the employees consider that this client does not bring all the guarantees for the security of the transaction. Any false information concerning the bidder's identity will give rise to his or her liability.
There are several possibilities for buyers to bid.
1. Bidding in the auction room
The usual method of bidding is by being present in the room during the auction. You must register online or in person at our office 24 hours before the sale.
2. Purchase orders
A customer who cannot attend the sale may leave a purchase order. PIASA will act on behalf of the bidder, in accordance with the instructions contained on the purchase order form, and in his or her best interests. The the limits in euros indicated on the purchase order correspond to the hammer price and do not include taxes and commissions payable by the buyer. If two purchase orders are identical, priority will go to the first order received.
3. Telephone bidding
PIASA may carry telephone bids on behalf of a potential buyer. The potential buyer must present himself to the auction house in advance. PIASA cannot be held liable for any difficulty in the telephone connection or in the event of error or omission concerning the receipt of telephone bids.
No telephone bids will be accepted for lots where the appraisal is less than €300.
Written purchase orders or telephone bids are facilities that are provided to customers without charge. Neither PIASA nor its employees may be held liable in the event of any error or omission in executing them or failing to execute them.
4. Bid Online
PIASA cannot be held responsible in the event of dysfunction of the platforms used to bid online. The user must read and accept, without reservation, the conditions of use of this platform.
5. Mandate on behalf of a third party
Each bidder is deemed to be acting on his own behalf, however he may inform PIASA in advance that he is acting as agent on behalf of a third party. PIASA reserves the right to accept or refuse the agent's representative status.
Requests for purchase orders and telephone bids may be made using the online form available on the site https://piasa.fr or by using the form provided for this purpose at the end of the auction catalogue.
AUCTION PROCEEDINGS
1. The bids
The auctioneer is freely entitled to proceed with bidding. Bids made in the auction room will take precedence to online bids.
In the event that a reserve price has been set by the seller, PIASA may carry bids on behalf of the seller until this price has been reached. The lower limit of the appraisal stated in the catalogue cannot be lower than the reserve price, and may be modified up to the time of the auction.
The winning bidder shall be the highest and final bidder.
After the hammer fall, the auctioneer cannot take account of any other bid whatsoever.
2. The presentation of the objects
Any changes to the catalog descriptions will be stated verbally during the sale and noted in the minutes. At the time of the auction, PIASA shall be entitled to shift lots, group or subdivide lots, or withdraw lots from the auction.
PIASA may use video devices during the auction to present the items put up for auction. PIASA shall bear no liability in the event of a handling error (presentation of an item that is different to the one for which bidding is made) or in the event of dysfunction in the platform permitting online bidding.
3. Right of pre-emption
In accordance with the provisions of articles L123-1 and L123-2 of the Code du Patrimoine, amended by the Law of 10 July 2000, the French State has a right of pre-emption over certain works of art sold at public auction. The State will then enter by way of subrogation into the rights of the highest bidder. This right must be exercised immediately after the hammer fall, and confirmed within a period of fifteen days following the sale. PIASA cannot be held liable for the conditions under which pre-emption is exercised by the French State.
ENFORCEMENT OF THE SALE
The announcement of the sale (adjudication) causes transfer of ownership title. A contract of sale is concluded between the seller and the successful bidder.
As of the time of the adjudication, the items shall be the entire responsibility of the buyer who must remove them as soon as possible. He will also have to insure his purchase(s) as soon as the adjudication is pronounced, the whole of the risks, in particular of loss, degradations, theft or others, being from this moment transferred to him.
1. Payment
In accordance with Article L320-2 of the Code du commerce states, the highest bidder acquires the property auctioned in his favor and is required to pay the price in cash.
Payment for items, together with applicable taxes, shall be made in euros.

4. Cheques drawn on a foreign bank will not be authorised except with PIASA's prior agreement. For that purpose, buyers are advised to obtain a letter of credit from their bank for a value approaching their intended purchase price, which they will transmit to PIASA.

- Up to €1,000 including costs and taxes, where the debtor's tax residence is in France or if acting for the purposes of a professional activity.
- Up to €15,000 including costs and taxes where the debtor proves not being having tax residency
in France and not acting for the purposes of a professional activity, on presentation of a passport and proof of residence.
2. Buyer's selling costs
In addition to the hammer price, the winning bidder must pay the following commission and taxes, per lot and in accordance with the relevant price brackets:
30% including VAT on the first €700,000
(25% excluding VAT + 20% VAT)
24% including VAT from €700,001 to €4,000,000 (20% excluding VAT + 20% VAT)
14.4% including VAT above €4,000,001
12% excluding VAT + 20% VAT)
For books, in addition to the hammer price, the winning bidder must pay the following commission and taxes, per lot and in accordance with the relevant price brackets: 30% including VAT on the first €700,000

24% including VAT from €700,001 to €4,000,000 (22,75 % excluding VAT + 5,5% VAT)
14.4% including VAT above €4,000,001

No document showing VAT will be issued, as the company is subject to the margin provided for in Article 297 A of the CGI.
The successful bidder from the EU with an intra- community VAT number and a document proving the delivery in his Member State will be able to obtain a refund of the VAT on the commissions.
Lots from outside the EU
Lots having a number preceded by the symbol ƒ are subject to additional costs that may be paid over to the winning bidder on the presentation of customs export documents from outside the European Union. These costs are 6,60% with VAT, (so 5,50% excluding VAT), of the hammer price.
Lots having a number preceded by the symbol ƒƒ are subject to additional costs of 24,00% with VAT (so 20% excluding VAT) of the hammer price.

3. Payment default
In accordance with Article L 321-14 of the Code du commerce, in the event of failure to pay by the winning bidder, after notice summoning payment has been sent to the buyer by registered letter with return receipt requested and remains without effect, the item shall be re-auctioned on the seller's request; if the seller does not express this request within three months following the sale, PIASA shall be empowered to act in his name and on his behalf and may: - either notify the winning bidder of the automatic rescission of the sale, without prejudice to any damages that may be claimed.
The defaulting winning bidder will remain liable to pay the auction costs ;
- or pursue the enforcement of the sale and payment of the hammer price and auction costs, for its own benefit and/or on behalf of the seller.
PIASA SA reserves the right to exclude any winning bidder who fails to pay, or who does not comply with these general terms and conditions of auction, from any future auctions.
In this respect, the PIASA auction house is a member of the central registry for auctioneers for the prevention of non-payment (Registre central de prévention des impayés des Commissaires priseurs) with which payment incidents may be registered. The rights of access, rectification and opposition on legitimate grounds may be exercised by the debtor in question by contacting Symev, 15 rue Freycinet, 75016 Paris.
TAKING DELIVERY OF LOTS
The transport of the lots will be at the expense and under the entire responsibility of the successful bidder.
No items will be given to the purchasers before the payment of the totality of the sums due. In the case of payment by cheque or bank transfer, the delivery of the objects may be deferred until the amount has been cashed. In this case, the deposit fees are at the expense of the purchasers.

Items will be kept free of charge for 30 days. Thereafter the purchaser will be charged storage and insurance costs at the rate of €30+tax, and €3+tax, per day and per lot and €6+tax per day and per lot concerning the furniture.
Past 60 days, PIASA assumes no liability for any damages that may occur to the lot, it being no longer covered by PIASA’s insurance.
EXPORTS
The export out of France or the import into another country of a lot may be affected by the laws of the country in which it is exported, or imported. The export of any lot from France or the import into another country may be subject to one or more export or import authorisations. Local laws may prevent the buyer from importing a lot or may prevent him selling a lot in the country the buyer import it into.
The export of certain items to a country of the European Union requires an export certificate issued by the competent departments of the Ministry of Culture within a maximum period of 4 months following the application.
The international regulations of 3 March 1973, known as the Washington Convention (Convention on International Trade of Endangered Species, CITES), have the effect of protecting specimens and species threatened with extinction. The export or import of any lot made of or containing any part (whatever the percentage) of ivory, tortoiseshell, crocodile skin, rhinoceros horn, whalebone, certain species of coral, rosewood etc. may be restricted or prohibited.
It is the buyer's sole responsibility to take advice and meeting the requirements of any laws or regulations which apply to exporting or importing any lot, prior to bidding. In some cases, the lot concerned may only be shipped along with an independent scientific confirmation of species and/or age of the specimen concerned, which will be issued at the expense of the buyer.
The new Commission Regulation (EU) 2021/2280 of December 16, 2021 prohibits the export outside the European Union of any lot containing a worked ivory component, with the exception of pre-1975 musical instruments.
PIASA can, on request, assist the buyer in obtaining the required licenses and independent scientific confirmation. This proceeding will be carried out at the buyer's expense. However, PIASA cannot guarantee that the buyer will get the appropriate license.
In the event of refusal of the license or delay in obtaining one, the buyer remains liable for the entire purchase price of the lot. Such a refusal or delay shall not allow for late payment or cancellation of the sale.
Transportation of the lots shall be made at the expense and entirely under the responsibility of the winning bidder. The sale is made for payment with immediate value and in euros.
GOVERNING LAW AND JURISDICTION
All of the provisions of the terms and conditions of auction are independent of one another. The nullity of any one of the terms and conditions cannot cause any of the other terms and conditions of auction to be inapplicable.
These terms and conditions of auction are drafted in French and governed by French law. Any dispute concerning the interpretation or application of these General Terms and Conditions of Auction shall be brought before the competent French courts of the judicial district in which the registered offices of PIASA are located.
PERSONAL DATA PROTECTION
Customers of PIASA have a right of access and rectification of personally identifiable data provided to PIASA, as provided for in the Law on Computing and Civil Liberties of 6 January 1978, amended by the Law of 6 August 2004. Since 25 May 2018, PIASA complies with the new European data protection regulations. These data may be communicated to the competent authorities when required by law.
CONDITIONS GÉNÉRALES DE VENTE - PIASA
« Constituent des ventes aux enchères publiques les ventes faisant intervenir un tiers, agissant comme mandataire du propriétaire ou de son représentant, pour proposer et adjuger un bien au mieux- disant des enchérisseurs à l'issue d'un procédé de mise en concurrence ouvert au public et transparent. Le mieux-disant des enchérisseurs acquiert le bien adjugé à son profit ; il est tenu d'en payer le prix. Sauf dispositions particulières et le cas des ventes effectuées dans le cercle purement privé, ces ventes sont ouvertes à toute personne pouvant enchérir et aucune entrave ne peut être portée à la liberté des enchères. » (Article L 320-2 du Code de commerce)
La Maison de Ventes PIASA est un opérateur de ventes volontaires régi par les dispositions des articles L 321-1 et suivants du Code de commerce. La Maison de Ventes agit comme mandataire du vendeur qui contracte avec l’acheteur.
Les ventes aux enchères sont soumises aux présentes conditions générales.
AVANT LA VENTE
1. Description et présentation des lots
Les acquéreurs potentiels sont invités à examiner les biens pouvant les intéresser et à constater leur état avant la vente aux enchères, notamment pendant les expositions.
PIASA se tient à leur disposition pour leur fournir des rapports de condition sur l’état des lots, en fonction des connaissances artistiques et scientifiques à la date de la vente. Les rapports de condition sont disponibles gratuitement, sur demande, pour aider l’acquéreur potentiel à évaluer l’état d’un lot.
L’absence de réserve au catalogue n’implique pas que le lot soit en parfait état de conservation et exempt de restauration ou imperfection (usures, craquelures, rentoilage). Les lots sont vendus dans l’état dans lequel ils se trouvent au moment de la vente. En conséquence, aucune réclamation ne sera recevable dès l’adjudication prononcée, les lots ayant pu être examinés lors de l’exposition.
Les dimensions et poids sont donnés à titre indicatif. Les couleurs et les nuances peuvent différer sur papier ou à l’écran par rapport à leur présentation lors d’un examen physique.
2. Estimation
Dans le catalogue, l’estimation figure à la suite de chaque lot. Il ne s’agit que d’une indication, le prix d’adjudication résulte du libre jeu des enchères.
L’estimation basse mentionnée dans le catalogue ne peut être inférieure au prix de réserve, et pourra être modifiée jusqu’au moment de la vente.
Les estimations ne comprennent aucunes taxes ou frais applicables.
Les estimations peuvent être données en plusieurs monnaies. L’arrondie de ces conversions peut entraîner une légère modification des arrondissements légaux.
3. Provenance et authenticité
Dans le cadre de la protection des biens culturels PIASA met tout en œuvre dans la mesure de ses moyens pour s’assurer de la provenance des lots mis en vente. En cas de contestations notamment sur l’authenticité ou l’origine des objets vendus, la responsabilité éventuelle de PIASA, tenue par une obligation de moyens, ne peut être engagée qu’à la condition expresse qu’une faute personnelle et prouvée soit démontrée à son encontre.
L’action en responsabilité civile à l’encontre de la Maison de Ventes se prescrit par 5 ans à compter de l’adjudication ou de la prisée.
PIASA se réserve le droit de retirer le lot avant la vente ou pendant la vente aux enchères s’il y a des doutes sur son authenticité ou sa provenance.
4. Indications particulières
Les lots précédés d’un * appartiennent à un actionnaire, un collaborateur ou un expert de la société PIASA. Les notices d’information contenues dans le catalogue sont établies avec toutes les diligences requises, par PIASA et l’expert qui l’assiste le cas échéant, sous réserve des notifications, déclarations, rectifications, annoncées verbalement au moment de la présentation de l’objet et portées au procès-verbal de la vente.
PARTICIPATION A LA VENTE
Les enchérisseurs sont invités à se faire connaître auprès de PIASA avant la vente afin de procéder à l’enregistrement de leurs données personnelles.
Pour une personne physique, son enregistrement nécessite une pièce d’identité avec photo et un justificatif de domicile si son adresse actuelle ne figure pas sur la pièce d’identité.
Pour une société, son enregistrement nécessite un certificat d’immatriculation de moins de trois mois indiquant le nom du représentant légal et son siège social.
PIASA se réserve le droit de ne pas enregistrer un client à la vente si les collaborateurs considèrent que ce client n’apporte pas toutes les garanties pour la sécurité de la transaction. Toute fausse indication concernant l’identité du client engagera sa responsabilité.
Plusieurs possibilités s’offrent au client pour enchérir.
1. Enchères en salle
Le mode usuel pour enchérir consiste à être présent en salle pendant la vente. Vous devez vous enregistrer en ligne ou en personne au sein de nos locaux 24 heure avant la vente.
2. Ordres d’achat
Le client ne pouvant assister à la vente pourra laisser un ordre d’achat. PIASA agira pour le compte de l’enchérisseur, selon les instructions contenues dans le formulaire d’ordre d’achat, et au mieux de ses intérêts. Étant entendu que les limites en euros inscrites sur l’ordre d’achat correspondent au prix marteau et ne comprennent pas les taxes et commissions à la charge de l’acheteur. Lorsque deux ordres d’achat sont identiques, la priorité revient au premier ordre reçu.
3. Enchères téléphoniques
PIASA peut porter des enchères téléphoniques pour le compte d’un acquéreur potentiel. L’acquéreur potentiel devra se faire connaître au préalable de la maison de vente. La responsabilité de PIASA ne peut être engagée pour un problème de liaison téléphonique ou en cas d’erreur ou d’omissions relatives à la réception des enchères téléphoniques.
Il ne sera accepté aucune enchère téléphonique pour les lots dont l’estimation est inférieure à 300 €.
Les ordres d’achat écrits ou les enchères par téléphone sont une facilité pour les clients mise en place à titre
gracieux. Ni PIASA, ni ses employés ne pourront être tenus pour responsables en cas d’erreurs éventuelles ou omissions dans leur exécution comme en cas de non- exécution de ceux-ci.
4. Enchères en ligne
PIASA ne peut être responsable en cas de dysfonctionnement des plateformes utilisées pour enchérir en ligne. L’utilisateur doit prendre connaissance et accepter, sans réserve, les conditions d’utilisation de cette plateforme.
5. Mandat pour le compte d’un tiers
Tout enchérisseur est réputé agir pour son propre compte, cependant il peut informer au préalable PIASA de sa qualité de mandataire pour le compte d’un tiers.
PIASA se réserve le droit d’accepter ou de refuser le mandat.
Les demandes d’ordres d’achat et d’enchères téléphoniques peuvent être faites par le biais du formulaire en ligne sur le site https://piasa.fr ou en utilisant le formulaire prévu à cet effet à la fin du catalogue de vente.
DÉROULEMENT DE LA VENTE
1. Le jeu des enchères
Le commissaire-priseur est en droit de faire progresser librement les enchères. Dans le cas où un prix de réserve a été fixé par le vendeur, le commissaire-priseur peut faire porter les enchères pour le compte du vendeur jusqu’à ce que ce prix soit atteint.
Les enchères en salle priment sur les enchères online.
L’adjudicataire sera le plus offrant et le dernier enchérisseur.
Après le coup de marteau, le commissaire-priseur ne pourra prendre aucune enchère quelle qu’elle soit.
2. La présentation des objets
Les éventuelles modifications aux descriptions du catalogue seront énoncées verbalement pendant la vente et noté au procès-verbal.
PIASA peut utiliser des moyens vidéo pendant la vente aux enchères pour la présentation des objets mis en vente. PIASA ne pourra engager sa responsabilité en cas d’erreur de manipulation sur les plateformes (présentation d’un bien différent de celui sur lequel les enchères sont portées).
3. Droit de préemption
Conformément aux dispositions des articles L123-1 et L123- 2 du Code du Patrimoine, l’État français dispose d’un droit de préemption sur certaines œuvres d’art mises en vente lors des enchères publiques. L’État se trouve alors subrogé au dernier enchérisseur. L’exercice de ce droit intervient immédiatement après le coup de marteau, et est confirmé dans un délai de quinze jours à compter de la vente. PIASA ne pourra être tenu pour responsable des conditions de la préemption par l’État français.
EXÉCUTION DE LA VENTE
L’adjudication réalise le transfert de propriété. Un contrat de vente est conclu entre le vendeur et l’adjudicataire.
Dès l’adjudication, les objets sont placés sous l’entière responsabilité de l’acquéreur qui devra les enlever dans les plus brefs délais.
1. Paiement
L’article L320-2 du code de commerce énonce que le mieux disant des enchérisseurs acquiert le bien adjugé en son profit et est tenu d’en payer le prix au comptant.
Le règlement du bien, ainsi que celui des taxes s’y appliquant, sera effectué en euros.

4. Les chèques tirés sur une banque étrangère ne seront autorisés qu’après l’accord préalable de PIASA, pour cela, il est conseillé aux acheteurs d’obtenir, avant la vente, une lettre accréditive de leur banque pour une valeur avoisinant leur intention d’achat, qu’ils transmettront à PIASA.
5. En espèces :
- Jusqu’à 1000€ frais et taxes comprises lorsque le débiteur a son domicile fiscal en France ou agit pour les besoins d’une activité professionnelle.
- Jusqu’à 15000€ frais et taxes comprises lorsque le débiteur justifie qu’il n’a pas son domicile fiscal en France et n’agit pas pour les besoins d’une activité professionnelle, sur présentation d’un passeport et justificatif de domicile.
2. Frais acheteur
En sus du prix de l’adjudication, l’adjudicataire devra acquitter par lot et par tranche dégressive les commissions et taxes suivantes :

La société étant sous le régime fiscal de la marge prévu à l'Article 297A du CGI, il ne sera délivré aucun document faisant ressortir la TVA.
L’adjudicataire UE justifiant d’un numéro de TVA intracommunautaire et d’un document prouvant la livraison dans son Etat membre pourra obtenir le remboursement de la TVA sur les commissions.
Lots en provenance hors UE
Les lots dont le n° est précédé par le symbole ƒ sont soumis à des frais additionnels pouvant être rétrocédé à l’adjudicataire sur présentation des documents douaniers
d’exportation hors Union Européenne. Ces frais sont de 6.60% TTC (soit 5.50% HT) sur le prix de l'adjudication.
Les lots dont le n° est précédé par le symbole ƒƒ sont soumis à des frais additionnels de 24,00% TTC (soit 20% HT) sur le prix de l'adjudication.

3. Défaut de paiement
Conformément à l’article L 321-14 du Code de commerce, à défaut de paiement par l’adjudicataire, après mise en demeure adressée à l’acquéreur par lettre recommandée avec accusé de réception, restée infructueuse, le bien est remis en vente à la demande du vendeur sur réitération des enchères ; si le vendeur ne formule pas cette demande dans un délai de trois mois à compter de l’adjudication, PIASA aura mandat d’agir en son nom et pour son compte et pourra :
- soit notifier à l’adjudicataire défaillant la résolution de plein droit de la vente, sans préjudice des éventuels dommages-intérêts. L’adjudicataire défaillant demeure redevable des frais de vente ;
- soit poursuivre l’exécution forcée de la vente et le paiement du prix d’adjudication et des frais de vente, pour son propre compte et/ou pour le compte du vendeur.
PIASA SA se réserve le droit d’exclure des ventes futures tout adjudicataire qui aura été défaillant ou qui n’aura pas respecté les présentes conditions générales de vente.
À ce sujet, la société de ventes volontaires PIASA est adhérente au Registre central de prévention des impayés des Commissaires-priseurs auprès duquel les incidents de paiement sont susceptibles d’inscription. Les droits d’accès, de rectification et d’opposition pour motif légitime sont à exercer par le débiteur concerné auprès du Symev, 15 rue Freycinet, 75016 Paris.
RETRAIT DES LOTS
Le transport des lots devra être effectué aux frais et sous l’entière responsabilité de l’adjudicataire.
Aucun lot ne sera remis aux acquéreurs avant l’acquittement de l’intégralité des sommes dues. En cas de paiement par chèque ou par virement, la délivrance des objets, pourra être différée jusqu’à l’encaissement. Les frais de dépôt sont, en ce cas, à la charge de l’adjudicataire.
Tous les achats réglés pourront être enlevés 24 heures après la vente :

Les lots pourront être gardés à titre gracieux pendant 30 jours. Passé ce délai, des frais de dépôts et d’assurance seront supportés par les acquéreurs au tarif de 30€ HT forfaitaire et 3€ HT par jour calendaire et par lot, 6 € HT par jour calendaire et par lot concernant le mobilier.
Passé 60 jours, PIASA décline toute responsabilité quant aux dommages que l’objet pourrait encourir, la garantie de PIASA cessera alors de plein droit.
EXPORTATION
L’exportation hors de France ou l’importation dans un autres pays d’un lot, peut être affectée par les lois du pays dans lequel il est exporté, ou importé. L’exportation de tout bien hors de France ou l’importation dans un autre pays peut être soumise à l’obtention d’une ou plusieurs autorisation(s) d’exporter ou d’importer. Certaines lois peuvent interdire l’importation ou interdire la revente d’un lot dans le pays dans lequel il a été importé.
L’exportation de certains objets dans un pays de l’Union Européenne est subordonnée à l’obtention d’un certificat d’exportation délivré par les services compétents du Ministère de la Culture, dans un délai maximum de 4 mois à compter de sa demande.
La réglementation internationale du 3 mars 1973, dite Convention de Washington, a pour effet la protection de spécimens et d’espèces dits menacés d’extinction. L’exportation ou l’importation de tout lot fait ou comportant une partie (quel qu’en soit le pourcentage) en ivoire, écailles de tortues, peau de crocodile, corne de rhinocéros, os de baleine, certaines espèces de corail et en palissandre etc. peut être restreinte ou interdite.
A titre informatif, le nouveau règlement (UE) 2021/2280 de la Commission du 16 décembre 2021 interdit l’exportation en dehors de l’Union Européenne de tout lot contenant un élément en ivoire travaillé, à l’exception des instruments de musique pré-1975.
Il appartient, sous sa seule responsabilité, à l’acheteur de prendre conseil et vérifier la possibilité de se conformer aux dispositions légales ou règlementaires qui peuvent s’appliquer à l’exportation ou l’importation d’un lot, avant même d’enchérir. Dans certains cas, le lot concerné ne peut être transporté qu’assorti d’une confirmation par expert, aux frais de l’acheteur, de l’espèce et ou de l’âge du spécimen concerné.
PIASA peut, sur demande, assister l’acheteur dans l’obtention des autorisations et rapport d’expert requis. Ces démarches seront conduites aux frais de l’acheteur. Cependant, PIASA ne peut garantir l’obtention que les autorisations seront délivrées.
En cas de refus de permis ou de délai d’obtention de celui- ci, l’acheteur reste redevable de la totalité du prix d’achat du lot. Un tel refus ou délai ne saurait en aucun cas justifier le retard du paiement ou l’annulation de la vente.
LOI APPLICABLE ET ATTRIBUTION DE COMPÉTENCE
Les dispositions des conditions de vente sont indépendantes les unes des autres. La nullité d’une des conditions ne peut entraîner l’inapplicabilité des autres conditions de vente.
Les présentes conditions de ventes sont rédigées en français et régies par le droit français. Les éventuels litiges relatifs à l’interprétation ou l’application des présentes Conditions Générales de Vente seront portés devant les juridictions françaises, compétentes dans le ressort du siège social de PIASA.
PROTECTION DES DONNÉES PERSONNELLES
Le client PIASA dispose d’un droit d’accès et de rectification aux données nominatives fournies à PIASA dans les conditions de la loi Informatique et Liberté du 6 janvier 1978 modifiée par la loi du 6 août 2004. Depuis le 25 mai 2018, PIASA est en conformité avec la nouvelle réglementation européenne de la protection des données personnelles. Ces données pourront être communiquées aux autorités compétentes dès lors que la réglementation l’impose.
GENERAL TERMS AND CONDITIONS OF AUCTION - PIASA
“Public auctions are sales which involve the participation of a third party, acting as agent of the owner or his representative, to offer and sell an item of property to the highest bidder at the end of a process of competitive bidding that is open to the public and transparent. The highest bidder acquires the sold item for his own benefit ; he is bound to pay the price. Except where specially provided otherwise or for sales made within a purely private circle, these sales are open to any person able to bid and no restriction may be made on the freedom of bidding.” (Article L 320-2 of the Commercial Code)
The Maison de Ventes (Auction House) PIASA is a public auction operator governed by the provisions of Articles L 321-1 et seq. of the Commercial Code. The Auction House acts as agent of the seller who enters into contract with the buyer.
The auctions are subject to these general terms and conditions.
PRIOR TO THE SALE
1. Description and presentation of the lots
Potential buyers are invited to examine the items that may interest them and to observe their condition prior to the auction, including in particular during exhibitions.
PIASA remains at their disposal to provide reports on the condition of the lots, according to artistic and scientific knowledge at the date of the auction. Condition reports are available free of charge, upon request, to assist the prospective buyer in evaluating the condition of a lot.
The absence of a reserve in the catalog doesn’t imply that the lot is perfectly conserved and free of restorations or imperfections (wear and tear, cracks, lining). The lots are sold in the condition in which they are at the time of the sale. Consequently, no claim will be admissible as of the time of the adjudication, as the lots were available for examination at the exhibition.
The dimensions and weights are given for information only. Colors and shades may vary on paper or on screen from their presentation during a physical examination.
2. Appraisal
In the catalog, appraisal appears after each lot. This is only an indication, the hammer price shall result from free bidding. Appraisals may be given in several currencies. The rounding of these conversions may lead to a slight difference compared to laws on rounding.
The low estimate mentioned in the catalog cannot be lower than the reserve price, and can be modified until the moment of the sale.
Appraisals don’t include any applicable taxes or fees.
3. Provenance and authenticity
In the framework of the protection of items of cultural property, PIASA makes all effort within its means to verify the origin of the auctioned lots. In the event of dispute, notably as to the authenticity or origin of the sold items, PIASA, bound by a best efforts obligation, shall only be liable under the express condition of demonstration that it has committed a proven personal wrong.
Any liability claim against the Auction House will be barred after the limitation period of 5 years following the sale or appraisal. PIASA reserves the right to withdraw the lot from auction at any time if there is doubt as to its authenticity or origin.
4. Special indications
The lots preceded by an * belong to a shareholder, employee or expert of PIASA. The information notices contained in the catalogue are drawn up with all due diligence, by PIASA and the expert assisting it where relevant, subject to any notifications, declarations or rectifications announced orally at the time of presentation of the item and set down in the minutes of the sale.
PARTICIPATION TO THE AUCTION
Bidders are invited to present themselves to PIASA SA before the sale in order to enable their personal details to be registered (an identity document will be requested). For an individual, registration requires photo identification and proof of address if the current address is not on the identification.
For a company, registration requires a certificate of registration less than three months old indicating the name of the legal representative and the registered office.
PIASA reserves the right not to register a client for sale if the employees consider that this client does not bring all the guarantees for the security of the transaction. Any false information concerning the bidder's identity will give rise to his or her liability.
There are several possibilities for buyers to bid.
1. Bidding in the auction room
The usual method of bidding is by being present in the room during the auction. You must register online or in person at our office 24 hours before the sale.
2. Purchase orders
A customer who cannot attend the sale may leave a purchase order. PIASA will act on behalf of the bidder, in accordance with the instructions contained on the purchase order form, and in his or her best interests. The the limits in euros indicated on the purchase order correspond to the hammer price and do not include taxes and commissions payable by the buyer. If two purchase orders are identical, priority will go to the first order received.
3. Telephone bidding
PIASA may carry telephone bids on behalf of a potential buyer. The potential buyer must present himself to the auction house in advance. PIASA cannot be held liable for any difficulty in the telephone connection or in the event of error or omission concerning the receipt of telephone bids.
No telephone bids will be accepted for lots where the appraisal is less than €300.
Written purchase orders or telephone bids are facilities that are provided to customers without charge. Neither PIASA nor its employees may be held liable in the event of any error or omission in executing them or failing to execute them.
4. Bid Online
PIASA cannot be held responsible in the event of dysfunction of the platforms used to bid online. The user must read and accept, without reservation, the conditions of use of this platform.
5. Mandate on behalf of a third party
Each bidder is deemed to be acting on his own behalf, however he may inform PIASA in advance that he is acting as agent on behalf of a third party. PIASA reserves the right to accept or refuse the agent's representative status.
Requests for purchase orders and telephone bids may be made using the online form available on the site https://piasa.fr or by using the form provided for this purpose at the end of the auction catalogue.
AUCTION PROCEEDINGS
1. The bids
The auctioneer is freely entitled to proceed with bidding. Bids made in the auction room will take precedence to online bids.
In the event that a reserve price has been set by the seller, PIASA may carry bids on behalf of the seller until this price has been reached. The lower limit of the appraisal stated in the catalogue cannot be lower than the reserve price, and may be modified up to the time of the auction.
The winning bidder shall be the highest and final bidder.
After the hammer fall, the auctioneer cannot take account of any other bid whatsoever.
2. The presentation of the objects
Any changes to the catalog descriptions will be stated verbally during the sale and noted in the minutes. At the time of the auction, PIASA shall be entitled to shift lots, group or subdivide lots, or withdraw lots from the auction.
PIASA may use video devices during the auction to present the items put up for auction. PIASA shall bear no liability in the event of a handling error (presentation of an item that is different to the one for which bidding is made) or in the event of dysfunction in the platform permitting online bidding.
3. Right of pre-emption
In accordance with the provisions of articles L123-1 and L123-2 of the Code du Patrimoine, amended by the Law of 10 July 2000, the French State has a right of pre-emption over certain works of art sold at public auction. The State will then enter by way of subrogation into the rights of the highest bidder. This right must be exercised immediately after the hammer fall, and confirmed within a period of fifteen days following the sale. PIASA cannot be held liable for the conditions under which pre-emption is exercised by the French State.
ENFORCEMENT OF THE SALE
The announcement of the sale (adjudication) causes transfer of ownership title. A contract of sale is concluded between the seller and the successful bidder.
As of the time of the adjudication, the items shall be the entire responsibility of the buyer who must remove them as soon as possible. He will also have to insure his purchase(s) as soon as the adjudication is pronounced, the whole of the risks, in particular of loss, degradations, theft or others, being from this moment transferred to him.
1. Payment
In accordance with Article L320-2 of the Code du commerce states, the highest bidder acquires the property auctioned in his favor and is required to pay the price in cash.
Payment for items, together with applicable taxes, shall be made in euros.
The winning bidder may pay using the following means: 1. By credit or debit card only in the auction room, or 5 Boulevard Ney 75018 Paris: VISA and MASTERCARD. (American express not accepted)
2. By certified bank cheque in euros with compulsory presentation of a valid identity document, or extract of registration in the trade registry ("Kbis" extract) dating from within the last 3 months for legal entities.

4. Cheques drawn on a foreign bank will not be authorised except with PIASA's prior agreement. For that purpose, buyers are advised to obtain a letter of credit from their bank for a value approaching their intended purchase price, which they will transmit to PIASA.
5. In cash:
- Up to €1,000 including costs and taxes, where the debtor's tax residence is in France or if acting for the purposes of a professional activity.
- Up to €15,000 including costs and taxes where the debtor proves not being having tax residency
in France and not acting for the purposes of a professional activity, on presentation of a passport and proof of residence.
2. Buyer's selling costs
In addition to the hammer price, the winning bidder must pay the following commission and taxes, per lot and in accordance with the relevant price brackets:
30% including VAT on the first €700,000
(25% excluding VAT + 20% VAT)
24% including VAT from €700,001 to €4,000,000 (20% excluding VAT + 20% VAT)
14.4% including VAT above €4,000,001
12% excluding VAT + 20% VAT)
For books, in addition to the hammer price, the winning bidder must pay the following commission and taxes, per lot and in accordance with the relevant price brackets: 30% including VAT on the first €700,000
(28,44 % excluding VAT + 5,5% VAT)
24% including VAT from €700,001 to €4,000,000 (22,75 % excluding VAT + 5,5% VAT)
14.4% including VAT above €4,000,001
(13,65 % excluding VAT + 5,5% VAT)
No document showing VAT will be issued, as the company is subject to the margin provided for in Article 297 A of the CGI.
The successful bidder from the EU with an intra- community VAT number and a document proving the delivery in his Member State will be able to obtain a refund of the VAT on the commissions.
Lots from outside the EU
Lots having a number preceded by the symbol ƒ are subject to additional costs that may be paid over to the winning bidder on the presentation of customs export documents from outside the European Union. These costs are 6,60% with VAT, (so 5,50% excluding VAT), of the hammer price.
Lots having a number preceded by the symbol ƒƒ are subject to additional costs of 24,00% with VAT (so 20% excluding VAT) of the hammer price.

3. Payment default
In accordance with Article L 321-14 of the Code du commerce, in the event of failure to pay by the winning bidder, after notice summoning payment has been sent to the buyer by registered letter with return receipt requested and remains without effect, the item shall be re-auctioned on the seller's request; if the seller does not express this request within three months following the sale, PIASA shall be empowered to act in his name and on his behalf and may: - either notify the winning bidder of the automatic rescission of the sale, without prejudice to any damages that may be claimed.
The defaulting winning bidder will remain liable to pay the auction costs ;
- or pursue the enforcement of the sale and payment of the hammer price and auction costs, for its own benefit and/or on behalf of the seller.
PIASA SA reserves the right to exclude any winning bidder who fails to pay, or who does not comply with these general terms and conditions of auction, from any future auctions.
In this respect, the PIASA auction house is a member of the central registry for auctioneers for the prevention of non-payment (Registre central de prévention des impayés des Commissaires priseurs) with which payment incidents may be registered. The rights of access, rectification and opposition on legitimate grounds may be exercised by the debtor in question by contacting Symev, 15 rue Freycinet, 75016 Paris.
TAKING DELIVERY OF LOTS
The transport of the lots will be at the expense and under the entire responsibility of the successful bidder.
No items will be given to the purchasers before the payment of the totality of the sums due. In the case of payment by cheque or bank transfer, the delivery of the objects may be deferred until the amount has been cashed. In this case, the deposit fees are at the expense of the purchasers.

Items will be kept free of charge for 30 days. Thereafter the purchaser will be charged storage and insurance costs at the rate of €30+tax, and €3+tax, per day and per lot and €6+tax per day and per lot concerning the furniture.
Past 60 days, PIASA assumes no liability for any damages that may occur to the lot, it being no longer covered by PIASA’s insurance.
EXPORTS
The export out of France or the import into another country of a lot may be affected by the laws of the country in which it is exported, or imported. The export of any lot from France or the import into another country may be subject to one or more export or import authorisations. Local laws may prevent the buyer from importing a lot or may prevent him selling a lot in the country the buyer import it into.
The export of certain items to a country of the European Union requires an export certificate issued by the competent departments of the Ministry of Culture within a maximum period of 4 months following the application.
The international regulations of 3 March 1973, known as the Washington Convention (Convention on International Trade of Endangered Species, CITES), have the effect of protecting specimens and species threatened with extinction. The export or import of any lot made of or containing any part (whatever the percentage) of ivory, tortoiseshell, crocodile skin, rhinoceros horn, whalebone, certain species of coral, rosewood etc. may be restricted or prohibited.
It is the buyer's sole responsibility to take advice and meeting the requirements of any laws or regulations which apply to exporting or importing any lot, prior to bidding. In some cases, the lot concerned may only be shipped along with an independent scientific confirmation of species and/or age of the specimen concerned, which will be issued at the expense of the buyer.
The new Commission Regulation (EU) 2021/2280 of December 16, 2021 prohibits the export outside the European Union of any lot containing a worked ivory component, with the exception of pre-1975 musical instruments.
PIASA can, on request, assist the buyer in obtaining the required licenses and independent scientific confirmation. This proceeding will be carried out at the buyer's expense. However, PIASA cannot guarantee that the buyer will get the appropriate license.
In the event of refusal of the license or delay in obtaining one, the buyer remains liable for the entire purchase price of the lot. Such a refusal or delay shall not allow for late payment or cancellation of the sale.
Transportation of the lots shall be made at the expense and entirely under the responsibility of the winning bidder. The sale is made for payment with immediate value and in euros.
GOVERNING LAW AND JURISDICTION
All of the provisions of the terms and conditions of auction are independent of one another. The nullity of any one of the terms and conditions cannot cause any of the other terms and conditions of auction to be inapplicable.
These terms and conditions of auction are drafted in French and governed by French law. Any dispute concerning the interpretation or application of these General Terms and Conditions of Auction shall be brought before the competent French courts of the judicial district in which the registered offices of PIASA are located.
PERSONAL DATA PROTECTION
Customers of PIASA have a right of access and rectification of personally identifiable data provided to PIASA, as provided for in the Law on Computing and Civil Liberties of 6 January 1978, amended by the Law of 6 August 2004. Since 25 May 2018, PIASA complies with the new European data protection regulations. These data may be communicated to the competent authorities when required by law.
