En cette qualité Boisgirard – Antonini agit comme mandataire du vendeur qui contracte avec l’acquéreur. Aucune demande d’ordre d’achat ou de demande de ligne téléphonique ne sera acceptée par e-mail. Merci de passer directement par les différentes plateformes disponibles. Boisgirard – Antonini se réserve de demander à tout acquéreur potentiel de justifier de son identité ainsi que de ses références bancaires. Boisgirard – Antonini se réserve d’interdire l’accès à la salle de vente de tout acquéreur potentiel pour justes motifs. b) Toute personne qui se porte enchérisseur s’engage à régler personnellement et immédiatement le prix d’adjudication augmenté des frais à la charge de l’acquéreur et de tous impôts ou taxes qui pourraient être exigibles. En cas de contestation Boisgirard – Antonini se réserve de désigner l’adjudicataire, de poursuivre la vente ou de l’annuler, ou encore de remettre le lot en vente. f)L’adjudicataire ne pourra obtenir la livraison du lot qu’après règlement de l’intégralité du prix. g) L’Utilisateur doit s’assurer qu’il dispose des outils techniques adaptés à l’utilisation des Services et, au minimum, des recommandations techniques suivantes permettant d’optimiser l’accès aux Services : dernière version des navigateurs existants sur le marché, une connexion Internet haut débit. 3 – Les incidents de la vente a)Dans l’hypothèse où deux personnes auront porté des enchères identiques par la voix, le geste, ou par téléphone et réclament en même temps le bénéfice de l’adjudication après le coup de marteau, le bien sera immédiatement remis en vente au prix proposé par les derniers enchérisseurs, et tout le public présent pourra porter de nouvelles enchères. b)Pour faciliter la présentation des biens lors de ventes, Boisgirard – Antonini pourra utiliser des moyens vidéos. Les photos du catalogue ne sont pas contractuelles. En cas d’erreur de manipulation pouvant conduire pendant la vente à présenter un bien différent de celui sur lequel les enchères sont portées, Boisgirard- Antonini ne pourra engager leur responsabilité, et sera seul juge de la nécessité de recommencer les enchères. 4 – Préemption de l’État français L’État français dispose d’un droit de préemption des œuvres vendues conformément aux textes en vigueur. L’exercice de ce droit intervient immédiatement après le coup de marteau, le représentant de l’État manifestant alors la volonté de ce dernier de se substituer au dernier enchérisseur, et devant confirmer la préemption dans les 15 jours. Boisgirard – Antonini ne pourra être tenu pour responsable des conditions de la préemption pour l’État français. 5 – L’exécution de la vente En sus du prix de l’adjudication, l’adjudicataire (acheteur) devra acquitter par lot les commissions et taxes suivantes : Lots en provenance de l’Union européenne : Les frais sont de 25 % + TVA (soit 30% TTC). Les frais pour les livres sont de 26.37 % TTC Les lots précédés d’un. sont vendus par un associé ou par un collaborateur de la Maison de vente. Ces frais seront précisés avant la vente. En cas de règlement par Carte Bleue étrangère, la Maison de Vente Boisgirard – Antonini facturera 1 % en sus du montant de l’adjudication. b) Les lots précédés d’un * seront assujettis à la TVA supplémentaire de 5,5 % s’ils restent en France ou en Union européenne La TVA à l’import peut être rétrocédée à l’adjudicataire sur présentation des justificatifs d’exportation hors Union européenne dans les deux mois qui suivent la vente. Il ne pourra recourir contre Boisgirard- Antonini, dans l’hypothèse du vol, de la perte ou de la dégradation de son lot, après l’adjudication. f)Le lot ne sera délivré à l’acquéreur qu’après paiement intégral du prix des frais et des taxes. Dans l’intervalle Boisgirard – Antonini pourra facturer à l’acquéreur des frais de dépôt du lot, et éventuellement des frais de manutention et de transport. À défaut de paiement par l’adjudicataire, après mise en demeure restée infructueuse, le bien est remis en vente à la demande du vendeur sur folle enchère de d’adjudicataire défaillant ; si le vendeur ne formule pas cette demande dans un délai d’un mois à compter de l’adjudication, la vente est résolue de plein droit, sans préjudice de dommages intérêts dus par l’adjudicataire défaillant. En outre, Boisgirard – Antonini se réserve de réclamer à l’adjudicataire défaillant, à son choix : – des intérêts au taux légal majoré de cinq points. – le remboursement des coûts supplémentaires engendrés par sa défaillance. – le paiement de la différence entre le prix d’adjudication initial et le prix d’adjudication sur folle enchère s’il est inférieur, ainsi que les coûts générés par les nouvelles enchères. Boisgirard – Antonini se réserve d’exclure de ses ventes futures, tout adjudicataire qui aura été défaillant ou qui n’aura pas respecté les présentes conditions générales d’achat. Il est vivement demandé aux adjudicataires de procéder à un enlèvement le plus rapide possible de leurs achats, afin de limiter les frais de stockage qui sont à leur charge. Les achats de petits volumes seront transportés chez Boisgirard – Antonini où ils seront gardés à titre gracieux pendant quinze jours. Passé ce délai, des frais de dépôt seront supportés par les acquéreurs au tarif de 3 € par jour et par lot. Boisgirard-Antonini désigne les pierres modifiées par d’autres procédés, par le nom de la pierre, suivi de la mention « traitée » ou par l’indication du traitement subi. (Art.2) Les pierres non accompagnées de certificats ou attestations de laboratoires ont été estimées par Boisgirard-Antonini en tenant compte des modifications éventuelles du paragraphe a). c) Boisgirard-Antonini désigne par le terme générique PIERRE suivi d’un qualificatif de couleur les désignations suivantes : pierres synthétiques, pierres artificielles et imitations de pierres gemmes. En ce qui concerne les montres, les restaurations, les modifications, les caractéristiques techniques, les numéros de séries, les dimensions, le poids sont notifiés dans la mesure de nos moyens. L’état de fonctionnement n’est pas garanti. Il est possible que certains lots comprennent des pièces non originales suite à des réparations ou révisions de la montre ou de l’horloge. Ces éléments ne sont donnés qu’à titre indicatif pour faciliter l’inspection de l’acquéreur potentiel et restent soumises à son appréciation personnelle. La responsabilité du commissaire-priseur et de l’expert ne saurait être mise en cause en cas d’omissions pouvant subsister malgré les précautions prises. Les opérations de paiement sont effectuées par la Maison de Vente par l’intermédiaire de son prestataire de paiement : Ingenico, certifiée PCI-DSS a)Obligations de l’Enchérisseur potentiel : Celui-ci doit s’assurer qu’il dispose des outils techniques adaptés à l’utilisation des Services et, au minimum, des recommandations techniques suivantes permettant d’optimiser l’accès au service. La Maison de vente ne peut en aucun cas être tenu responsable en cas d’incidents liés à des informations mal renseignées de sa part. b)Données personnelles : La Maison de vente s’engage à respecter la réglementation en vigueur applicable au traitement de données à caractère personnel et en particulier, le règlement (UE) 2016/679 (RGPD) 7 – Propriété intellectuelle – reproduction des œuvres Boisgirard – Antonini est propriétaire du droit de reproduction de leur catalogue. Toute reproduction de celui-ci est interdite et constitue une contrefaçon à son préjudice. En outre Boisgirard – Antonini dispose d’une dérogation légale leur permettant de reproduire dans son catalogue les œuvres mises en vente, alors même que le droit de reproduction ne serait pas tombé dans le domaine public. La Maison de Vente est seul titulaire de tous les droits relatifs aux contenus afférents au Site et notamment à l’ensemble des droits d’auteur sur les contenus qu’elle met en ligne sur son site. L’Utilisateur s’interdit de reproduire, représenter, extraire, ou utiliser de quelque manière que ce soit tout ou partie du Site ou de son contenu et notamment les catalogues sans avoir obtenu une autorisation préalable et écrite de la Maison de Vente sous peine de voir une action judiciaire en contrefaçon engagée à son égard. 8- Responsabilité de la maison de vente Boisgirard-Antonini s’efforce, dans la mesure du possible et dans le cadre de son obligation de moyens relative au fonctionnement du Site, de le maintenir accessible. Néanmoins, l’accès au site peut être modifié, suspendu ou interrompu de manière temporaire ou permanente, en raison d’opérations techniques de maintenance, de migration, de pannes ou de contraintes liées au fonctionnement d’internet sans que ces opérations n’ouvrent droit à une quelconque indemnité. Boisgirard-Antonini ne saurait voir sa responsabilité engagée en raison d’un dysfonctionnement ou d’une impossibilité d’accès aux services imputable au fournisseur d’accès de l’utilisateur, à un encombrement du réseau internet, à un matériel inadapté, à une opération de maintenance ou de mise à jour des services ou à tout autre circonstance étrangère à la Maison de vente. 9- Compétences législative et juridictionnelle La loi française seule régit les présentes conditions générales d’achat. Toute contestation relative à leur existence, leur validité, leur opposabilité à tout enchérisseur et acquéreur, et à leur exécution sera tranchée par le tribunal compétent du ressort de Paris (France). 10- La sortie du territoire français La sortie d’un lot de France peut être sujette à une autorisation administrative. L’obtention du document concerné ne relève que de la responsabilité de l’adjudication du lot concerné par cette disposition. Le retard ou le refus de délivrance par l’administration des documents de sortie du territoire, ne justifiera ni l’annulation de la vente, ni un retard de règlement, ni une résolution. 11– CITES Chaque lot en ivoire vendu aux enchères fera l’objet d’une déclaration CITES, reprenant les contacts du vendeur, mais aussi de l’acheteur. Les objets décrits dans le présent catalogue contenant de l’ivoire d’Elephantidae supp (I/A), pré-convention, antérieur au 3 mars 1947 et ayant subi une destruction mécanique par débit de placage, découpe ou tournage et de ce fait conforme au Règle XE 338/97 du 09/12/1996 art.2-Wmc, peuvent être commercialisés après obtention d’un CIC préalable à toute vente, conformément à la directive européenne CE 2021/2280 du 16/12/2021 et son application à partir du 19 janvier 2022. L’adjudicataire s’engage à fournir sans délai à Boisgirard-Antonini toutes les informations éventuellement nécessaires à toutes fines douanières pour ce faire. L’adjudicataire est seul tenu d’accomplir toutes autres diligences résultant de la nature particulière d’un tel lot sous sa responsabilité. En particulier, il lui appartient de faire les démarches imposées par ses éventuelles revente ou exportation hors de France, notamment la demande d’un nouveau XIX de ré-export sera nécessaire, celui-ci étant à sa charge. La délivrance d’un tel document n’étant pas automatique. Pour une éventuelle réexportation hors de France, il appartiendra à l’adjudicataire de se renseigner – préalablement à tout achat- auprès des douanes du pays destinataire. Conformément à la nouvelle législation européenne du 16 décembre 2021, ce lot ne pourra pas sortir de l’Union Européenne. 12– TEMIS Boisgirard-Antonini à recours à la plateforme TEMIS opérée par la société Commissaires-Priseurs Multimédia, aux fins de gestion du recouvrement des Bordereaux impayés. Dans ce cadre, en cas de retard de paiement, les données à caractère personnel relatives aux enchérisseurs, ou leurs représentants, (notamment identité et coordonnées des enchérisseurs, informations relatives à la vente, bordereaux) sont susceptibles d’être communiquées à CPM aux fins de gestion du recouvrement amiable de créance. CPM intervient en qualité de sous-traitant au sens du Règlement général sur la protection des données (Règlement UE 2016/679 du 27 avril 2016). INCIDENTS DE PAIEMENT – FICHIER DES RESTRICTIONS D’ACCÈS DES VENTES AUX ENCHERES (TEMIS) Tout bordereau d’adjudication demeuré impayé après de Boisgirard-Antonini ou ayant fait l’objet d’un retard de paiement est susceptible d’inscription au Fichier des restrictions d’accès aux ventes aux enchères (« Fichier TEMIS ») mis en oeuvre par la société Commissaires-Priseurs Multimédia (CPM), société anonyme à directoire, ayant son siège social sis à (75009) Paris, 37 rue de Châteaudun, immatriculée au registre du commerce et des sociétés de Paris sous le numéro 437 868 425. Il ne pourra recourir contre Boisgirard- Antonini, dans l’hypothèse du vol, de la perte ou de la dégradation de son lot, après l’adjudication. f)Le lot ne sera délivré à l’acquéreur qu’après paiement intégral du prix des frais et des taxes. En ce qui concerne les montres, les restaurations, les modifications, les caractéristiques techniques, les numéros de séries, les dimensions, le poids sont notifiés dans la mesure de nos moyens. L’état de fonctionnement n’est pas garanti. Il est possible que certains lots comprennent des pièces non originales suite à des réparations ou révisions de la montre ou de l’horloge. Ces éléments ne sont donnés qu’à titre indicatif pour faciliter l’inspection de l’acquéreur potentiel et restent soumises à son appréciation personnelle. L’Utilisateur s’interdit de reproduire, représenter, extraire, ou utiliser de quelque manière que ce soit tout ou partie du Site ou de son contenu et notamment les catalogues sans avoir obtenu une autorisation préalable et écrite de la Maison de Vente sous peine de voir une action judiciaire en contrefaçon engagée à son égard. 8- Responsabilité de la maison de vente Boisgirard-Antonini s’efforce, dans la mesure du possible et dans le cadre de son obligation de moyens relative au fonctionnement du Site, de le maintenir accessible. Néanmoins, l’accès au site peut être modifié, suspendu ou interrompu de manière temporaire ou permanente, en raison d’opérations techniques de maintenance, de migration, de pannes ou de contraintes liées au fonctionnement d’internet sans que ces opérations n’ouvrent droit à une quelconque indemnité. Toute contestation relative à leur existence, leur validité, leur opposabilité à tout enchérisseur et acquéreur, et à leur exécution sera tranchée par le tribunal compétent du ressort de Paris (France). 10- La sortie du territoire français La sortie d’un lot de France peut être sujette à une autorisation administrative. L’obtention du document concerné ne relève que de la responsabilité de l’adjudication du lot concerné par cette disposition. Le retard ou le refus de délivrance par l’administration des documents de sortie du territoire, ne justifiera ni l’annulation de la vente, ni un retard de règlement, ni une résolution. 11– CITES Chaque lot en ivoire vendu aux enchères fera l’objet d’une déclaration CITES, reprenant les contacts du vendeur, mais aussi de l’acheteur. Les objets décrits dans le présent catalogue contenant de l’ivoire d’Elephantidae supp (I/A), pré-convention, antérieur au 3 mars 1947 et ayant subi une destruction mécanique par débit de placage, découpe ou tournage et de ce fait conforme au Règle XE 338/97 du 09/12/1996 art.2-Wmc, peuvent être commercialisés après obtention d’un CIC préalable à toute vente, conformément à la directive européenne CE 2021/2280 du 16/12/2021 et son application à partir du 19 janvier 2022. L’adjudicataire s’engage à fournir sans délai à Boisgirard-Antonini toutes les informations éventuellement nécessaires à toutes fines douanières pour ce faire. L’adjudicataire est seul tenu d’accomplir toutes autres diligences résultant de la nature particulière d’un tel lot sous sa responsabilité. En particulier, il lui appartient de faire les démarches imposées par ses éventuelles revente ou exportation hors de France, notamment la demande d’un nouveau XIX de ré-export sera nécessaire, celui-ci étant à sa charge. La délivrance d’un tel document n’étant pas automatique. Pour une éventuelle réexportation hors de France, il appartiendra à l’adjudicataire de se renseigner – préalablement à tout achat- auprès des douanes du pays destinataire. Conformément à la nouvelle législation européenne du 16 décembre 2021, ce lot ne pourra pas sortir de l’Union Européenne. 12– TEMIS Boisgirard-Antonini à recours à la plateforme TEMIS opérée par la société Commissaires-Priseurs Multimédia, aux fins de gestion du recouvrement des Bordereaux impayés. Dans ce cadre, en cas de retard de paiement, les données à caractère personnel relatives aux enchérisseurs, ou leurs représentants, (notamment identité et coordonnées des enchérisseurs, informations relatives à la vente, bordereaux) sont susceptibles d’être communiquées à CPM aux fins de gestion du recouvrement amiable de créance. The condition of antiquities, early ceramics, metal- work, glass and textiles is not guaranteed, since most of the pieces are commonly damaged. Necklaces are recomposed with ancient elements. Dimensions are given for information only, especially concerning the framed paintings. 2 – The sale a) In order to assure the proper organisation of the sales, prospective buyers are invited to make themselves known to Boisgirard – Antonini before the sale, so as to have their personal identity data recorded. Boisgirard – Antonini reserves the right to ask any prospective buyer to justify his identity as well as his bank references. Boisgirard – Antonini reserve the right to refuse admission to the auction sales premises to any prospective buyer for legitimate reasons. b) Any person who is a bidder undertakes to pay personally and immediately the hammer price increased by the costs to be born by the buyer and any and all taxes or fees/expenses which could be due. Any bidder is deemed acting on his own behalf except when prior notification, accepted by Boisgirard – Antonini is given that he acts as an agent on behalf of a third party. C) The usual way to bid consists in attending the sale on the premises. However, Boisgirard – Antonini may graciously accept to receive some bids by telephone from a prospective buyer who has expressed such a request before the sale. Boisgirard – Antonini will bear no liability/responsability whatsoever, notably if the telephone contact is not made, or if it is made too late, or in case of mistakes or omissions relating to the reception of the telephone. For variety of purposes, Boisgirard – Antonini reserve there right to record all the telephone communications during the auction. Such records shall be kept until the complete payment of the auction price, except claims. d) Boisgirard – Antonini will bear no liability/responsibility in case of mistakes or omission of performance of the written order. e) In the event where a reserve price has been stipulated by the seller, Boisgirard – Antonini reserve the right to bid on behalf of the seller until the reserve price is reached. f) Boisgirard – Antonini will conduct auction sales at their discretion, in accordance with established practices. Boisgirard – Antonini reserve the right to refuse any bid, to organise the bidding in such manner as may be the most appropriate, to move some lots in the course of the sale, to withdraw any lot in the course of the sale, to combine or to divide some lots in the course of the sale. In case of challenge or dispute, Boisgirard – Antonini reserve the right to designate the successful bidder, to continue the bidding or to cancel it, or to put the lot back up for bidding. No lot will be delivered to the buyer until full payment has been made. In case of payment by an ordinary draft/check, payment will be deemed made only when the check will have been cashed. 3 – The incidents of the sale a) In case two bidders have bidden vocally, by mean of gesture or by telephone for the same amount and both claim title to the lot, after the bidding the lot, will immediately be offered again for sale at the previous last bid, and all those attending will be entitled to bid again. b) So as to facilitate the presentation of the items during the sales, Boisgirard – Antonini will be able to use video technology. Should any error occur in operation of such, which may lead to show an item during the bidding which is not the one on which the bids have been made, Boisgirard – Antonini shall bear no liability/responsability whatsoever, and will have sole discretion to decide whether or not the bidding will take place again.- 4 – Pre-emption of the French state The French state in entitled to use a right of pre-emption on works of art, pursuant to the rules of law in force. The use of this right comes immediately after the hammer stroke, the representative of the French state expressing then the intention of the State to substitute for the last bidder, provided he confirms the pre-emption decision within fifteen days. Boisgirard – Antonini will not bear any liability/responsibility for the conditions of the pre-emption by the French State. 5 – The performance of the sale In addition to the lot’s hammer price, the buyer must pay the following costs and fees/taxes : a) Lots from the EEC : The buyer must pay Boisgirard – Antonini, in addition to the hammer price, commission of 24% excl. Tax (with VAT 28,80%) of the sale price. For the books the commission will be : 24% excl. Tax + 5.5% (with VAT 25,32%) By credit card, Boisgirard – Antonini, will charge 1% in addition to the hammer price. b) The taxes (VAT on commissions and VAT on importation) can be retroceded to the purchaser on presentation of written proof of exportation outside the EEC. c) All the bidders that won lots throught DROUOT LIVE will have fees of 28.8% TTC + 1.5% HT All the bidders that won lots throught INTERENCHERE, INVALUABLE,51BIDLIVE, DROUOT ONLINE will have fees of 28.8% TTC+3%HT An EEC purchaser who will submit his intra-Community VAT number will be exempted from paying the VAT on commissions. The payment of the lot will be made cash, for the whole of the price, costs and taxes, even when an export licence is required. The purchaser will be authorized to pay by the following means: – in cash : up to 1 000 euros, costs and taxes included, for French citizen, up to 15 000 euros, costs and taxes included, for foreign citizen on presentation of their identity papers. – By credit card : VISA, MASTERCARD. d) Should the buyer have neglected to give his personal information before the sale, he will have to give the necessary information as soon as the sale of the lot has taken place. e) The lot must to be insured by the buyer immediately after the purchase. The buyer will have no recourse against Boisgirard – Antonini, in the event where, due to a theft, a loss or a deterioration of his lot after the purchase. f) The lot will be delivered to the buyer only after the entire payment of the price, costs and taxes. In the meantime Boisgirard – Antonini may invoice to the buyer the costs of storage of the lot, and if applicable the costs of handling and transport. Should the buyer fail to pay the amount due, and after notice to pay has been given by Boisgirard – Antonini to the buyer without success, at the seller’s request, the lot is re-offered for sale, under the French procedure known as “procédure de folle enchère”. If the seller does not make this request within a month from the date of the sale, the sale will be automatically cancelled, without prejudice to any damages owed by the defaulting buyer. In addition, Boisgirard – Antonini reserve the right to claim against the defaulting buyer, at their option – interest at the legal rate increased by five points, – the reimbursement of additional costs generated by the buyer’s default, – the payment of the difference between the initial hammer price and the price of sale after “procédure de folle enchère” if it is inferior as well as the costs generated by the new auction. Boisgirard – Antonini reserves the right to exclude from any future auction, any bidder who has been a defaulting buyer or who has not fulfilled these general conditions of purchase. e) For items purchased which are not collected within seven days from after the sale (Saturdays, Sundays and public holidays included), Boisgirard – Antonini will be authorized to move them into a storage place at the defaulting buyer’s expense, and to release them to same after payment of corresponding costs, in addition to the price, costs and taxes. Storage fees of lots starts 1 month after the sale, and will be of 3€ per day and per lot. 7 – Intellectual Property Right – Copyright The copyright in any and all parts of the catalogue is the property of Boisgirard – Antonin. Any reproduction thereof is forbidden and will be considered as counterfeiting to their detriment. Furthermore, Boisgirard – Antonini benefits from a legal exception allowing them to reproduce the lots for auction sale in their catalogue, even though the copyright protection on an item has not lapsed. 9- Law and Jurisdiction These Conditions of purchase are governed by French law exclusively. Any dispute relating to their existence, their validity and their binding effect on any bidder or buyer shall be submitted to the exclusive jurisdiction of the Courts of France. 10- CITES Every lot in Ivory will be declared on behalf of the CITES organization, where the names of the buyer and the seller will be given.
