En cette qualité Boisgirard – Antonini agit comme mandataire du vendeur qui contracte avec l’acquéreur. Aucune demande d’ordre d’achat ou de demande de ligne téléphonique ne sera acceptée par e-mail. Merci de passer directement par les différentes plateformes disponibles. Boisgirard – Antonini se réserve de demander à tout acquéreur potentiel de justifier de son identité ainsi que de ses références bancaires. Boisgirard – Antonini se réserve d’interdire l’accès à la salle de vente de tout acquéreur potentiel pour justes motifs. b) Toute personne qui se porte enchérisseur s’engage à régler personnellement et immédiatement le prix d’adjudication augmenté des frais à la charge de l’acquéreur et de tous impôts ou taxes qui pourraient être exigibles. Les photos du catalogue ne sont pas contractuelles. En cas d’erreur de manipulation pouvant conduire pendant la vente à présenter un bien différent de celui sur lequel les enchères sont portées, Boisgirard- Antonini ne pourra engager leur responsabilité, et sera seul juge de la nécessité de recommencer les enchères. 4 – Préemption de l’État français L’État français dispose d’un droit de préemption des œuvres vendues conformément aux textes en vigueur. L’exercice de ce droit intervient immédiatement après le coup de marteau, le représentant de l’État manifestant alors la volonté de ce dernier de se substituer au dernier enchérisseur, et devant confirmer la préemption dans les 15 jours. Boisgirard – Antonini ne pourra être tenu pour responsable des conditions de la préemption pour l’État français. 5 – L’exécution de la vente En sus du prix de l’adjudication, l’adjudicataire (acheteur) devra acquitter par lot les commissions et taxes suivantes : Lots en provenance de l’Union européenne : Les frais sont de 25 % + TVA (soit 30% TTC). Il ne pourra recourir contre Boisgirard- Antonini, dans l’hypothèse du vol, de la perte ou de la dégradation de son lot, après l’adjudication. f)Le lot ne sera délivré à l’acquéreur qu’après paiement intégral du prix des frais et des taxes. Dans l’intervalle Boisgirard – Antonini pourra facturer à l’acquéreur des frais de dépôt du lot, et éventuellement des frais de manutention et de transport. À défaut de paiement par l’adjudicataire, après mise en demeure restée infructueuse, le bien est remis en vente à la demande du vendeur sur folle enchère de d’adjudicataire défaillant ; si le vendeur ne formule pas cette demande dans un délai d’un mois à compter de l’adjudication, la vente est résolue de plein droit, sans préjudice de dommages intérêts dus par l’adjudicataire défaillant. Boisgirard – Antonini se réserve d’exclure de ses ventes futures, tout adjudicataire qui aura été défaillant ou qui n’aura pas respecté les présentes conditions générales d’achat. Il est vivement demandé aux adjudicataires de procéder à un enlèvement le plus rapide possible de leurs achats, afin de limiter les frais de stockage qui sont à leur charge. Les achats de petits volumes seront transportés chez Boisgirard – Antonini où ils seront gardés à titre gracieux pendant quinze jours. Passé ce délai, des frais de dépôt seront supportés par les acquéreurs au tarif de 3 € par jour et par lot. Boisgirard-Antonini désigne les pierres modifiées par d’autres procédés, par le nom de la pierre, suivi de la mention « traitée » ou par l’indication du traitement subi. (Art.2) Les pierres non accompagnées de certificats ou attestations de laboratoires ont été estimées par Boisgirard-Antonini en tenant compte des modifications éventuelles du paragraphe a). c) Boisgirard-Antonini désigne par le terme générique PIERRE suivi d’un qualificatif de couleur les désignations suivantes : pierres synthétiques, pierres artificielles et imitations de pierres gemmes. En ce qui concerne les montres, les restaurations, les modifications, les caractéristiques techniques, les numéros de séries, les dimensions, le poids sont notifiés dans la mesure de nos moyens. L’état de fonctionnement n’est pas garanti. Il est possible que certains lots comprennent des pièces non originales suite à des réparations ou révisions de la montre ou de l’horloge. Ces éléments ne sont donnés qu’à titre indicatif pour faciliter l’inspection de l’acquéreur potentiel et restent soumises à son appréciation personnelle. La responsabilité du commissaire-priseur et de l’expert ne saurait être mise en cause en cas d’omissions pouvant subsister malgré les précautions prises. Toute reproduction de celui-ci est interdite et constitue une contrefaçon à son préjudice. En outre Boisgirard – Antonini dispose d’une dérogation légale leur permettant de reproduire dans son catalogue les œuvres mises en vente, alors même que le droit de reproduction ne serait pas tombé dans le domaine public. La Maison de Vente est seul titulaire de tous les droits relatifs aux contenus afférents au Site et notamment à l’ensemble des droits d’auteur sur les contenus qu’elle met en ligne sur son site. L’Utilisateur s’interdit de reproduire, représenter, extraire, ou utiliser de quelque manière que ce soit tout ou partie du Site ou de son contenu et notamment les catalogues sans avoir obtenu une autorisation préalable et écrite de la Maison de Vente sous peine de voir une action judiciaire en contrefaçon engagée à son égard. 8- Responsabilité de la maison de vente Boisgirard-Antonini s’efforce, dans la mesure du possible et dans le cadre de son obligation de moyens relative au fonctionnement du Site, de le maintenir accessible. Néanmoins, l’accès au site peut être modifié, suspendu ou interrompu de manière temporaire ou permanente, en raison d’opérations techniques de maintenance, de migration, de pannes ou de contraintes liées au fonctionnement d’internet sans que ces opérations n’ouvrent droit à une quelconque indemnité. Boisgirard-Antonini ne saurait voir sa responsabilité engagée en raison d’un dysfonctionnement ou d’une impossibilité d’accès aux services imputable au fournisseur d’accès de l’utilisateur, à un encombrement du réseau internet, à un matériel inadapté, à une opération de maintenance ou de mise à jour des services ou à tout autre circonstance étrangère à la Maison de vente. 9- Compétences législative et juridictionnelle La loi française seule régit les présentes conditions générales d’achat. Toute contestation relative à leur existence, leur validité, leur opposabilité à tout enchérisseur et acquéreur, et à leur exécution sera tranchée par le tribunal compétent du ressort de Paris (France). 10- La sortie du territoire français La sortie d’un lot de France peut être sujette à une autorisation administrative. L’obtention du document concerné ne relève que de la responsabilité de l’adjudication du lot concerné par cette disposition. Le retard ou le refus de délivrance par l’administration des documents de sortie du territoire, ne justifiera ni l’annulation de la vente, ni un retard de règlement, ni une résolution. 11– CITES Chaque lot en ivoire vendu aux enchères fera l’objet d’une déclaration CITES, reprenant les contacts du vendeur, mais aussi de l’acheteur. Les objets décrits dans le présent catalogue contenant de l’ivoire d’Elephantidae supp (I/A), pré-convention, antérieur au 3 mars 1947 et ayant subi une destruction mécanique par débit de placage, découpe ou tournage et de ce fait conforme au Règle XE 338/97 du 09/12/1996 art.2-Wmc, peuvent être commercialisés après obtention d’un CIC préalable à toute vente, conformément à la directive européenne CE 2021/2280 du 16/12/2021 et son application à partir du 19 janvier 2022. L’adjudicataire s’engage à fournir sans délai à Boisgirard-Antonini toutes les informations éventuellement nécessaires à toutes fines douanières pour ce faire. L’adjudicataire est seul tenu d’accomplir toutes autres diligences résultant de la nature particulière d’un tel lot sous sa responsabilité. En particulier, il lui appartient de faire les démarches imposées par ses éventuelles revente ou exportation hors de France, notamment la demande d’un nouveau XIX de ré-export sera nécessaire, celui-ci étant à sa charge. Dans ce cadre, en cas de retard de paiement, les données à caractère personnel relatives aux enchérisseurs, ou leurs représentants, (notamment identité et coordonnées des enchérisseurs, informations relatives à la vente, bordereaux) sont susceptibles d’être communiquées à CPM aux fins de gestion du recouvrement amiable de créance. CPM intervient en qualité de sous-traitant au sens du Règlement général sur la protection des données (Règlement UE 2016/679 du 27 avril 2016).
