PUNTO 1.
I lotti vengono messi in vendita nella sede aperta al pubblico da BASEZERO, la quale
agisce quale mandatario in esclusiva in nome e per conto di ciascun Venditore, il cui
nome viene trascritto negli appositi registri di P.S. presso BASEZERO. Gli effetti della
vendita – salvo il caso in cui si tratti di beni di proprietà di BASEZERO - si producono sul
Venditore. BASEZERO non assume nei confronti dell'Aggiudicatario o di terzi in genere
altra responsabilità oltre a quella ad esso derivante dalla propria qualità di mandatario.
PUNTO 2.
BASEZERO si riserva la facoltà di ritirare dall'Asta qualsiasi lotto.
PUNTO 3.
I beni oggetto degli incanti sono aggiudicati al miglior offerente. Il pagamento dovrà
avvenire per intero entro 7 giorni dall'aggiudicazione a mezzo bonifico bancario, assegno
circolare o contanti. Nel rispetto delle norme antiriciclaggio è escluso il pagamento in
contanti per importi superiori a € 999,99.
PUNTO 4.
Nel medesimo termine di 7 giorni di cui all’art. 3 che precede, l’aggiudicatario
corrisponderà a BASEZERO, oltre al corrispettivo dell’aggiudicazione, un importo
compreso tra il 17% e il 30% del medesimo prezzo a titolo di commissione d’Asta, a
seconda del tipo di asta. Il valore corretto è specificato in ciascun catalogo d'asta.Tale
importo si intende comprensivo di IVA e dell'eventuale diritto di seguito. In caso di
mancato pagamento BASEZERO potrà alternativamente procedere per l'esecuzione
coattiva dell'obbligo di acquisto e di pagamento, ovvero alienare il lotto a trattativa
privata oppure in un'Asta successiva in danno all'Aggiudicatario, salvo in ogni caso il
risarcimento dei danni subiti. L'oggetto sarà custodito da BASEZERO a rischio e spese
dell'Aggiudicatario fino a quando non sarà alienato come sopra, ovvero restituito al
Venditore d'intesa col medesimo.
PUNTO 5.
Anche ai fini della validità di un'eventuale aggiudicazione, è richiesto a ogni partecipante
di compilare prima di ogni Asta una Scheda di Partecipazione con indicazione dei dati
personali e di fornire copia di un documento di identità e del codice fiscale.
PUNTO 6.
BASEZERO può accettare mandati per l'acquisto (offerte scritte, telefoniche o
telematiche) a prezzi determinati, effettuando rilanci mediante il Banditore, in gara con
il pubblico partecipante all'Asta.
PUNTO 7.
Nel caso di due offerte scritte per il medesimo lotto, lo stesso verrà aggiudicato al
Partecipante la cui offerta sia stata ricevuta per prima. BASEZERO si riserva il diritto di
rifiutare le offerte di Partecipanti non conosciuti o reputati inaffidabili a meno che venga
rilasciato un deposito ad intera copertura dell'offerta effettuata o, in ogni caso, fornita
idonea garanzia. All'atto dell'aggiudicazione BASEZERO potrà chiedere
all'Aggiudicatario di confermare le proprie generalità e di fornire referenze bancarie
congrue e, comunque controllabili, unitamente a ogni altra informazione necessaria o
utile per l'acquisto. In caso di inesattezza o di incompletezza dei dati e delle informazioni
di cui sopra, incluse le informazioni già fornite ex art. 5 o, comunque, in caso di
inadeguatezza delle referenze bancarie, BASEZERO si riserva di revocare
l'aggiudicazione del lotto.
PUNTO 8.
BASEZERO, ai sensi e nei limiti di cui all'art. 1229 c.c., declina ogni responsabilità in ordine
alla descrizione dei lotti contenuta nei cataloghi, nella brochure, nel proprio sito Internet
e in qualsiasi altro supporto informativo o promozionale. Le descrizioni di cui sopra, così
come ogni altra informazione o illustrazione, sono puramente indicative e non potranno
generare alcun affidamento nei partecipanti all'asta, sui quali grava l'onere di esaminare
preventivamente lo stato di ciascun bene, effettuando o facendo effettuare tutti i
controlli e verifiche del caso.
Anche in considerazione di ciò, BASEZERO organizza presso la propria sede, con
congruo anticipo rispetto alla data dell'asta, l'esposizione dei lotti che saranno posti
all'incanto consentendo ai propri clienti di accertare le qualità, il tipo, lo stato di
conservazione, l'autenticità, la provenienza dei medesimi. Per la lettura dei cataloghi le
misure vanno intese in quest'ordine: altezza, larghezza, profondità. Sotto la voce
"Provenienza" sono elencati i timbri e le etichette delle Gallerie e delle Collezioni applicati
sul retro del dipinto o le informazioni risultanti da eventuali pubblicazioni dell'opera.
PUNTO 9.
Nel caso di offerte giunte prima della messa in Asta del lotto, si partirà dall'ultima offerta
massima pervenuta.
PUNTO 10.
L'Aggiudicatario, saldato integralmente il prezzo e le commissioni per i diritti d'asta,
dovrà ritirare i lotti acquistati a propria cure, rischio e spese entro 7 giorni
dall'aggiudicazione. Previo accordo con l'Aggiudicatario, BASEZERO potrà organizzare,
a spese e rischio dell'Aggiudicatario, l'imballaggio, il trasporto e l'assicurazione del lotto.
PUNTO 11.
Ferme restando le condizioni che precedono, BASEZERO si riserva di concordare con gli
Aggiudicatari forme speciali di pagamento, di concedere eventuali pagamenti rateali, di
depositare in magazzino privato/pubblico o vendere privatamente i lotti aggiudicati e
non ritirati tempestivamente, di assicurare i lotti aggiudicati, di gestire eventuali
controversie e contestazioni effettuate da o contro gli Aggiudicatari e, in generale, di
intraprendere qualsiasi iniziativa ritenuta opportuna al fine di riscuotere somme dovute
dall'Aggiudicatario.
PUNTO 12.
BASEZERO non si assume alcuna responsabilità nei confronti degli Acquirenti per gli
eventuali limiti o divieti relativi all'esportazione dei beni acquistati, né in ordine a
eventuali licenze o permessi che l'Acquirente dovrà ottenere o procurarsi in base alle
vigenti leggi.
PUNTO 13.
Una volta ricevuto l'integrale pagamento del lotto, comprensivo delle relative
commissioni d'Asta, BASEZERO rilascerà all'Aggiudicatario un certificato di garanzia e
provenienza per ogni lotto venduto.
PUNTO 14.
Le presenti condizioni di vendita, pubblicate sul sito web www.basezero.it, si intendono
accettate da quanti concorrano all'Asta e sono a disposizione di qualunque interessato
che ne faccia richiesta. Per qualunque controversia è stabilità la competenza esclusiva
del Foro di Busto Arsizio.

POINT 1.
BASEZERO puts for sale all lots in selected public spaces, BASEZERO will act as an
exclusive agent in name of each seller, the sellers name will be registered in the P.S.
registry held by BASEZERO. All sales agreements, – with the exception of goods sold
directly by BASEZERO – are affecting the seller. BASEZERO will not be held responsible
by the buyer or any other third party, for any situation except the one included in the
role of the agent.
POINT 2.
BASEZERO reserves the right to exclude from auction any lot, without any notice.
POINT 3.
The artwork that will be put on auction will be rewarded to the highest bidder. The
payment will have to take place within 7 days from the auction closing, through bank
payment, cash or cashier's cheque. Within the regulation in matter of money laundering,
the cash payment will be accepted only for less than a total value of € 999,99.
POINT 4.
Within the same time frame as the payment (as per point 3), the buyer will pay
BASEZERO, on top of the successful bidding price, an amount between 17% and 30%
of the successful bidding price as fee for Auction rights, depending by the auction.
The correct value is specified in each auction catalog. This amount includes VAT and
eventual resale right. In case of missing payment, BASEZERO will be able to proceed
alternately for the enforcement of the purchase and the payment, or shall sell the
lot based on private negotiation or through a further auction even to the detriment
of the awarded contractor, except in any case the compensation of the suffered
damages. The item shall be safeguarded by BASEZERO at awarded contractor's risks
and costs until it shall be sold as above described or given back to the Seller as agreed
with him.
POINT 5.
In order to comply with all administrative requirements and to assure a successful
bidding process, each participant to the auction should fill in the participation form
including all of your personal details, together with a copy of a valid ID and social security
number.
POINT 6.
BASEZERO can accept mandate for the purchase of a lot (written offers, telephone bids
or internet bids) up to an agreed limit amount, those bids will be communicated to the
audience of the auction by the auctioneer.
POINT 7.
In case we should receive two identical written offers for the same lot by two separate
bidders, the offer that will be recognised as valid, will be the one which was submitted
first. BASEZERO reserves the right to refuse the bids of unknown or perceived unreliable
bidders; In case a deposit for the full bid amount should be paid, the bid will be accepted,
the same applies in case BASEZERO will be provided with other satisfactory and tangible
guarantees. The moment the lot will be rewarded to a bidder BASEZERO will ask the
bidder to confirm identity and will ask also to supply bank references, the same will apply
to any information required for the completion of purchase. In case the information given
will prove to be wrong or incomplete (including information ex art. 5) BASEZERO
reserves the right to revoke the successful bid.
POINT 8.
BASEZERO, will not be held responsible for the information contained in the catalogue,
in the brochure, on its own internet site and in any other promotional or
informative documentation (complying art. 1229 codice civile).The descriptions
mentioned by BASEZERO are simply an indication and should not, by any
circumstances, be considered as the only source of information on which you base your
purchase; you should consider the possibility to have all items examined and
eventually arrange for someone to do it for you. In order to support this type of
activities, BASEZERO organises in advance, an exhibition of all lots destined to the
auction, this will enable you to access the quality, status origin and authenticity of the
artwork you plan to bid for.
To facilitate the reading of our auction catalogues you should intend the dimensional
measurements in this order: height, width and depth. Under the tag
"Provenienza" (translates into "Origin") you will see the stamps and the labels of the
galleries that have been applied on the back of the painting and eventually the
information resulting from previously published data regarding the lot.
POINT 9.
In case the lot should receive bids before the auction starts, the auction will have as a
starting bid, the highest bid received.
POINT 10.
The winner of the bid once has paid both the value of the artwork, and the fees for auction
rights will have to arrange collection of the items, in case this should not be done some
discretionary expenses will be debited after 7 days of Auction closure. Only upon request
from the buyer of the lot, BASEZERO could be available to support the buyer in arranging
the shipment, please kindly note that in this case all incurring risks and costs would be
under the responsibilities of the buyer (including shipping and handling, packaging,
transport and insurance).
POINT 11.
All mentioned conditions must apply, but BASEZERO may decide to agree on different
conditions together with the buyer, including instalments, storage in a private/public
storage or sell privately the lots that were bid for but wouldn't be paid and picked up on
timely matter, as much as insure the artwork, manage disputes made by (or towards) the
buyer, more generally, BASEZERO reserves the right to carry out any initiative and/or
action that is considered appropriate in order to receive the due amounts from the
auction winner.
POINT 12.
BASEZERO is not to be held responsible for any export regulations and for any limits
that may apply to the acquired lots; neither for licencing nor for achieving permits. The
buyer only, should arrange by himself the entire documentation required and make
sure that he/she complies with current legislation applied in Italy and in the
country of destination.
POINT 13.
Once the buyer has paid in full the due amount (bidding price plus auctions fees),
BASEZERO will issue the certificate of warranty and of origin for each of the
purchased lots.
POINT 14.
These general sales conditions, (published also on the web site www.basezero.it), are to
be considered as accepted by all participants to the auctions in all details described in

disputes resulting from this Agreement, relating to its validity or in connection with these
Sales conditions shall be disputed in the court of Busto Arsizio; the language of dispute
