Mahmoud Saleh Mohammadi is a multidisciplinary artist. Today he lives between Milan and Antwerp. In a series of online interviews, Mohammadi has explained his artistic vision and the main elements of his practice. An essential role is played by colours and, above all, by the light, which is considered as important as a spiritual element. In his work he also pours his interest in philosophy, poetry, Sufism, human history and Oriental traditions.By juxtaposing oriental carpets with recycled material found in a western city, the artist creates a sort of union, a dialogue between two very different worlds, which perhaps in the end are not even so different, since the human beings with their strengths and weaknesses are always at the centre of all aspects of life. In ‘Ma’ the Balochi needlework with mirror embroidery become the focus on the canvas. The perfection of the motif and the symmetry is emphasized by the plain background. The word ‘Ma’ can be interpreted through two different traditions, respectively the Buddhist and Japanese ones. In both cases, the word can be translated as interval, space, pause or void, but a void full of meanings. In this work, the artist intends to represent a non-space in a timeless moment. The eternity of a work of art is considered as a consequence of the reflection, thought, mental and spiritual journey undertaken by the artist to reach not only creation, but also life. Baias può vendere all’asta in varie modalità - in presenza e/o in remoto - dichiaratamente espresse in ogni catalogo di vendita.
Commissione compratore
Baias applica il 24% sul prezzo di aggiudicazione.
A questa va aggiunta la percentuale della piattaforma online di cui il compratore si è servito, ove applicabile (drouot +3%). Tale percentuale varia a seconda della piattaforma partner ed è sempre specificata nei termini e condizioni di ogni vendita.
Modalità di pagamento e ritiro dei lotti
I lotti acquistati dovranno essere saldati a Baias srl entro e non oltre 3 gg lavorativi successivi alla data dell’asta. I lotti acquistati dovranno essere immediatamente ritirati dal compratore o da persone/personale da lui incaricato entro e non oltre 10 gg dalla data del pagamento. Oltre tale termine BAIAS si riserva il diritto di richiedere un corrispettivo per l’immagazzinamento.

Responsabilità
La Casa d’Aste agisce in qualità di mandataria con rappresentanza del Venditore ed è esente da qualsiasi responsabilità in ordine alla provenienza e descrizione dei Lotti nei cataloghi, nelle brochure e in qualsiasi altro materiale illustrativo; tali descrizioni, così come ogni altra indicazione o illustrazione, devono considerarsi puramente indicative e non vincolanti, e non possono generare affidamento di alcun tipo negli Offerenti e nell’Acquirente. Qualsiasi riferimento alle condizioni dell’opera nella scheda di catalogo non equivale a una completa descrizione dello stato di conservazione. Tutte le aste sono precedute dall’esposizione dei lotti, ad accesso libero o su appuntamento, al fine di permettere un esame attento e approfondito circa l’autenticità, lo stato di conservazione, la provenienza, il tipo e la qualità degli stessi, su cui esclusivamente gli Offerenti e l’Acquirente assumono ogni rischio e responsabilità, anche per gli effetti di cui all’art. 1488, c. 2, c.c.. Dopo l’aggiudicazione né la Casa d’Aste né i Venditori potranno essere ritenuti responsabili per eventuali vizi dei Lotti, relativi tra l’altro allo stato di conservazione, all’errata attribuzione, all’autenticità, alla provenienza, al peso o alla mancanza di qualità dei Lotti. A tal fine gli Offerenti e l’Acquirente rinunciano espressamente alla garanzia di cui all’art. 1490 c.c., liberando la Casa d’Aste da ogni relativa responsabilità. I lotti sono venduti nella formula “visto e piaciuto” tramite asta pubblica, quindi non è previsto il diritto di recesso.
Spedizioni e Belle Arti
BAIAS srl NON si occupa delle spedizioni dei lotti acquistati. Ciononostante, sarà nostra cura agevolare in ogni modo la consegna del lotto suggerendo il recapito di uno spedizioniere che effettua il servizio secondo le regole vigenti in Italia.
Lotti con materiali di specie protette e lotti soggetti ad embargo
BAIAS darà esplicita comunicazione in catalogo in merito ai materiali che compongono ciascun lotto e li tratterà in conformità alla normativa vigente in Italia. E’ responsabilità del compratore verificare che tali materiali possano essere importati nel paese di destinazione della merce prima di formulare un’offerta.

Dichiarazione di interesse culturale, prelazione ed esportazione
Gli Acquirenti saranno tra l’altro tenuti, per gli oggetti dei Lotti sottoposti al procedimento di dichiarazione di interesse culturale (c.d. notifica) ex artt. 13 e ss. D.Lgs. n. 42/2004 all’osservanza di tutte le disposizioni di cui al Codice dei Beni Culturali e di ogni altra normativa applicabile anche in materia doganale, valutaria e tributaria. Resta in ogni caso fermo che, in caso di diniego della licenza di esportazione, la vendita resterà valida e vincolante, incluso l’obbligo di pagamento del Prezzo Totale nei termini previsti. È esclusivo onere dell’Acquirente verificare le eventuali restrizioni all’esportazione dei Lotti aggiudicati ovvero le eventuali licenze o attestati previsti dalla legge (emessi o da emettere), con espresso esonero di ogni eventuale obbligo e/o responsabilità in capo alla Casa d’Aste. In caso di esercizio del diritto di prelazione ai sensi degli artt. 60 e ss., D.Lgs. n. 42/2004, oppure di acquisto coattivo ai sensi dell’art. 70 della stessa legge, l’Acquirente non potrà pretendere alcunché, a qualunque titolo, dalla Casa d’Aste e/o dal Venditore, se non la sola restituzione degli importi eventualmente già pagati a causa della aggiudicazione dei Lotti e al momento del pagamento da parte dell’Amministrazione. In caso di notifica o diniego del permesso di esportazione il rimborso dell'ammontare pagato è subordinato al recupero di tale credito presso il mandate venditore.

Baias can sell at auction in various ways - in person and/or remotely - specifically stated in each sales catalogue.
Buyer's premium
Baias charges 24% on the hammer price.
Other commission for online platforms will be charged on top of the basic commission (24%)
The online fee changes according to the partner platform and is always specified in the terms and conditions of each sale (drouot +3%).
Terms of payment and collection of lots
The lots purchased must be paid to Baias srl within 3 working days after the date of the auction. The lots purchased must be immediately collected by the buyer or by persons/personnel appointed by the buyer within and no later than 10 days from the date of payment. Beyond this deadline BAIAS may charge a storage fee.

A specific condition report on one or more lots may be requested before the auction.
Liability
The Auction House acts as agent with representation for the Seller and is exempt from any responsibility regarding the provenance and description of the Lots in the catalogues, brochures and any other illustrative material; such descriptions, as well as any other indication or illustration, must be considered purely indicative and not binding, and cannot generate any kind of reliance whatsoever in the Bidders and in the Buyer. Any reference to the condition of the work in the catalogue entry does not amount to a complete description of the state of conservation. All auctions are preceded by a viewing, with free access or by appointment, in order to allow for a careful and thorough examination of their authenticity, state of preservation, provenance, type and quality, on which exclusively the Bidders and the Buyer assume all risks and responsibilities, also for the effects of art. 1488, c. 2, Civil Code. After the sale, neither the Auction House nor the Sellers shall be held liable for any defects in the Lots, regarding, among other things, the state of preservation, incorrect attribution, authenticity, origin, weight or lack of quality of the Lots. To this end, the Bidders and the Buyer expressly waive the warranty pursuant to Article 1490 of the Italian Civil Code, releasing the Auction House from any related liability. The Lots are sold “as is” and through public auction, therefore no right of withdrawal is granted.
Shipping and Fine Arts
BAIAS srl does NOT provide the shipping of the lots purchased. Nevertheless, we will make every effort to facilitate the delivery of the lot by suggesting the address of a shipping agent that performs the service according to the rules in force in Italy.
Lots with materials of protected species and lots subject to embargo
BAIAS will give explicit notice in the catalogue of the materials comprising each lot and will treat them in accordance with the Italian law. It is the buyer's responsibility to verify that such materials can be imported into the country of destination of the goods before making an offer.
The same applies to artefacts from certain civilisations (e.g. lots of Iranian origin, archaeology). It is the buyer's responsibility to verify that lots with such attributes can be imported into the country of destination of the goods before making an offer.
Declaration of cultural interest, pre-emption and exportation
The Purchasers shall be obliged, inter alia, for the objects of the Lots subject to the procedure of declaration of cultural interest (so-called notification) pursuant to Articles 13 et seq. Legislative Decree No. 42/2004, to comply with all the provisions set forth in the Code of Cultural Heritage and any other applicable regulations, also with regard to customs, currency and tax matters. In any case, it is understood that, in the event of denial of the export license, the sale shall remain valid and binding, including the obligation to pay the Total Price within the prescribed terms. It is the exclusive responsibility of the Buyer to verify any restrictions on the exportation of the Lots awarded or any licenses or certificates required by law (issued or to be issued), with express exoneration of any eventual obligation and/or responsibility on the part of the Auction House. In the event of the pre-emption pursuant to Articles 60 et seq., Legislative Decree No. 42/2004, or of compulsory purchase pursuant to Article 70 of the same law, the Buyer may not claim anything, for any reason whatsoever, from the Auction House and/or the Seller, other than the sole reimbursement of any amounts already paid due to the award of the Lots and buyer’s premium. In the event of notification or refusal of the export license, the refund of the amount paid is subordinate to the recovery of such credit from the vendor, acted by the auction house.
