La Société Anonyme Hôtel de Ventes Bernaerts S.A. annonce aux participants de la vente que la vente sera organisée aux conditions générales et spécifiques mentionnées ci-dessous et que toute participation aux ventes aux enchères implique l’acceptation inconditionnelle des présentes conditions de vente.
1. Jour de la vente
La vente publique a lieu par le biais d’une offre orale ou écrite. L’adjudication se fait au plus offrant, par lot, contre paiement comptant. Au moment de la vente et pour autant qu’il ne l’ait pas fait auparavant, l’acquéreur potentiel doit s’inscrire en présentant une pièce d’identité et en indiquant son nom, son adresse, son numéro de téléphone, le numéro de sa pièce d’identité et en apposant sa signature sur le formulaire d’inscription de la Société Anonyme Hôtel de Ventes Bernaerts S.A.. En retour, il recevra une plaquette avec son numéro personnel pour participer aux enchères. Dans les autres cas, l’acquéreur se présente our remplir et signer son formulaire de participation, après quoi il recevra une plaquette avec son numéro personnel. Les enchérisseurs pour la vente en ligne doivent s’enregistrer au minimum 5 h avant le début des sessions. Pour chaque nouvelle vente en ligne, l’acquéreur devra s’enregistrer en acceptant les conditions générales de vente.
2. Engagement de l’enchérisseur
Par son offre, l’enchérisseur s’engage à acheter les lots mis en vente au prix qu’il a proposé. Il n’a néanmoins pas voix au chapitre lorsque la vente est suspendue pour des raisons quelconques.
Hôtel de Ventes Bernaerts S.A. peut, en cas de négligence de l’acheteur, décider d’annuler la vente et de vendre le lot au sous-enchérisseur. Hôtel de Ventes Bernaerts S.A. peut alors récupérer les coûts ou les revenus perdus auprès de l’acheteur.
3. Conduite de la vente, ordre
L’huissier de justice maintient l’ordre pendant la vente. C’est lui qui règle en dernier ressort tous les litiges possibles, nés de la vente, notamment concernant le montant des offres et la personne du plus offrant. Le commissaire-priseur a, entre autres, le droit de fixer le prix minimum de chaque offre, de ne pas accepter l’offre de personnes qu’il ne connaît pas ou dont l’identité ou la solvabilité ne lui semblent pas prouvées – dans ce cas, l’enchérisseur précédent reste lié -, de suspendre la vente, sans devoir s’en expliquer à ce sujet aux enchérisseurs, de diviser, joindre ou retirer n’importe quel lot. En cas d’obstruction ou de perturbation de l’enchère par violence, par menace ou par un moyen frauduleux, les dispositions de l’article 314 du Code Pénal seront appliquées. Au cas où un prix limite a été fixé par l’apporteur/vendeur, la Société Anonyme Hôtel de Ventes Bernaerts S.A. a le droit d’enchérir pour le compte de l’apporteur/vendeur. La Société Anonyme Hôtel de Ventes Bernaerts S.A. se réserve le droit de refuser toute offre faite par des acquéreurs inconnus.
4. Acquéreur par mandat ou par porte-fort
L’acquéreur peut désigner un mandataire, à condition qu’il le signale au commissaire-priseur dès la fin de la vente. L’acquéreur se porte fort de la solvabilité et de la compétence de son mandataire; chacun reste responsable de son achat, même si une autre personne est indiquée comme acquéreur.
5. Garantie
L’adjudication se fera sans aucune garantie de la part du commissaire-priseur chargé de la vente et de l’huissier de justice instrumentant, entre autres concernant l’authenticité. Les lots et objets d’art sont vendus dans l’état dans lequel ils se trouvent à l’endroit de l’expositon et de la vente, et sans aucune garantie. Les acquéreurs sont censés avoir examiné les lots et objets d’art et avoir fait leur offre en toute connaissance de cause. Les prix d’estimation cités dans le catalogue ont une valeur strictement informative. Le cas échéant, le catalogue sur papier prévaut sur la version électronique (les catalogues sur papier peuvent être consultés et/ou téléchargés gratuitement sur www.bernaerts.be). Dans des cas exceptionnels, la vente d’un objet d’art peut être annulée et le prix d’ajudication remboursé à l’acquéreur s’il retourne l’objet acheté dans les trois semaines, avec la preuve qu’il s’agit d’une falsification, et pour autant que l’objet soit resté dans le même état qu’au moment de la vente.
6. Indivisibilité et particularité
Toutes les obligations découlant de la vente reposent de droit, conjointement et indivisiblement, tant pour les personnes juridiques que pour les personnes physiques, sur tous ceux qui achètent pour un compte commun, sur l’acquéreur final et ceux qui ont acheté pour lui, sur les cautions entre elles et ceux pour qui ils se portent caution, ainsi que sur les héritiers et ayants cause de chacune des personnes mentionnées ci-dessus.
7. Paiement du prix d’achat et des frais par l’acquéreur
L’acquéreur en salle et celui qui a enchéri par ordre d’achat doit payer le prix d’adjudication,
majoré de 25% sur le prix d’adjudication, majoré de 25% sur le prix d’adjudication par téléphone, TVA incluse, pour les frais, à la Société Anonyme Hôtel de Ventes Bernaerts S.A., immédiatement après la vente ou au moment de l’enlèvement des lots.
Les enchérisseurs de la vente simultanée en live (webcast) doivent payer le prix d’achat majoré de 28% sur le prix d’adjudication, TVA incluse.
Les enchérisseurs de la vente silencieuse et/ou de l’Après-vente doivent payer le prix d’achat majoré de 30% sur le prix d’adjudication, TVA incluse.
Chaque lot donne lieu en outre au paiement de frais administratifs d’un montant de € 2, majorés du droit de suite éventuel. Le droit de suite s’applique pour les artistes des pays membres de l’Union européenne et des pays en dehors de l’Union européenne où selon la loi le droit de suite est applicable, et cela jusqu’à 70 ans après l’année du décès de l’artiste, pour les lots dont le prix d’adjudication est de € 2.000 ou davantage.
Le droit de suite est calculé comme suit:
– 4 % sur la partie du prix d’adjudication jusqu’ à € 50.000 inclus;
– 3 % sur la partie du prix d’adjudication de € 50.000,01 jusqu’ à € 200.000 inclus;
– 1 % sur la partie du prix d’adjudication de € 200.000,01 jusqu’ à € 350.000 inclus;
– 0,5 % sur la partie du prix d’adjudication de € 350.000,01 jusqu’ à € 500.000 inclus;
– 0,25 % sur la partie du prix d’adjudication supérieur à € 500.000.
Le montant total de ce droit ne pourra pas excéder le montant de € 12.500. (Loi du 4 décembre 2006 et A.R. du 2 août 2007).
Seuls des billets de banque en euros (jusqu’à un montant de € 2.999 par objet, frais inclus) seront acceptés pour le paiement du prix d’achat et des frais.
8. Compensation – confusion
L’acquéreur ne peut invoquer ni la compensation, ni la confusion, ni l’article 1653 du Code Civil belge concernant le trouble de l’acquéreur.
9. Réadjudication – folle enchère
Si l’acquéreur, celui à qui un lot est adjugé, la caution et/ou le mandataire indiqué restent en défaut de remplir immédiatement les obligations prescrites dans les présentes conditions ou de satisfaire immédiatement à une des conditions de vente, le lot peut être remis en vente pour folle enchère à charge de celui à qui il a été adjugé. La remise en vente se fait par l’huissier de justice déjà prié, dans les mêmes conditions de vente. L’acquéreur resté en défaut est tenu de payer la différence entre le prix d’achat et celui de la réadjudication, sans qu’il puisse réclamer le solde éventuel au cas où la nouvelle vente atteint un prix de vente plus élevé. Ce solde revient à l’apporteur/vendeur ou à la masse des créanciers unis. Le fol enchérisseur est tenu en outre au paiement des frais provoqués par sa négligence et par la réadjudication, ainsi que des autres frais de toute nature, sans préjudice des dommages-intérêts pour quelque raison que ce soit. La remise d’un chèque bancaire qui n’est pas payé immédiatement à la première présentation, vaut comme omission de paiement,sans préjudice de l’application de la loi pénale s’il y a lieu, ni de l’indemnité pour frais de protêt, d’escompte et autres.
10. Transfert de propriété – mesures conservatoires
Dès l’adjudication, tous les risques afférents aux achats seront à la charge de l’adjudicataire. Le lot est transmis dans l’état dans lequel il se trouve au moment de l’adjudication, avec tous ses vices apparents et cachés. Dès l’adjudication, le lot doit être conservé avec le plus grand soin. L’acquéreur doit cependant prendre toutes les mesures utiles pour la conservation du lot. À partir de l’adjudication, les lots ne restent plus sur place qu’aux risques et à la charge de l’acquéreur, qui est seul responsable du lot qu’il a acheté.
11. État des lots – exposition
Vu que les lots et les objets d’arts ont été exposés avant la vente publique, et que les conditions de vente ont été communiquées, l’acquéreur est censé être informé entièrement, personnellement et sur sa propre responsabilité de l’état des lots et des objets d’art. Il n’a aucun recours contre la Société Anonyme Hôtel de Ventes Bernaerts S.A., contre l’huissier de justice instrumentant ou contre le commissaire-priseur, pour erreur, imprécision ou négligence dans la description des lots et des objets d’art, ni pour dérangement, gêne, l’état des lots et objets d’art, leur réparation ou leur restauration. Toutes les données concernant les lots et les objets d’art dans les catalogues, annonces, brochures ou toute autre communication écrite ou numérique de la Société Anonyme Hôtel de Ventes Bernaerts S.A., et plus particulièrement leur description, ne sont fournies qu’à titre d’information et sous toute réserve. Ni la Société Anonyme Hôtel de Ventes Bernaerts S.A., ni l’huissier de justice instrumentant n’assume de responsabilité à cet égard. La vente est précédée d’une exposition pendant laquelle la Société Anonyme Hôtel de Ventes Bernaerts S.A. se tiendra à la disposition du public – physiquement ou de distance- pour lui fournir des renseignements au mieux de ses possibilités; l’exposition a pour but de permettre un examen minutieux de l’état de conservation et de la qualité des lots ainsi que de donner des indications sur les vices ou inexactitudes éventuels dans la description du catalogue. Le public peut en outre faire appel à la Société Anonyme Hôtel de Ventes Bernaerts S.A. ou à un expert choisi par l’amateur, en vue d’un examen approfondi et ce, pendant toute la durée de l’exposition. La Société Anonyme Hôtel de Ventes Bernaerts S.A. n’est pas disposée à reprendre le lot si la description du catalogue est révoquée pendant la vente et que la bonne description est donnée oralement au public. Chaque visiteur est responsable des dégâts qu’il cause aux objets et lots exposés, même s’ils sont la conséquence du hasard ou sont involontaires. De même, les dispositions de l’article 2280 du Code Civil s’appliquent à cette vente publique.
12. Entrée en jouissance – enlèvement
L’acquéreur qui a payé entièrement le prix d’achat et les frais entre en jouissance du lot vendu. Lors de l’enlèvement, il est tenu de présenter une preuve de paiement. Aucun lot ne peut être enlevé pendant la vente même. Sauf autorisation expresse de la Société Anonyme Hôtel de Ventes Bernaerts S.A., aucun lot ne sera livré avant le paiement intégral du prix d’achat et des frais. Les dommages occasionnés lors de l’enlèvement ou du déplacement des lots sont à charge et aux risques de l’acquéreur. Lorsque le délai d’enlèvement est passé, un intérêt de 1% par mois sur le prix d’adjudication sera porté en compte, avec un minimum de € 5 par jour et par lot. 13. Remboursement
Au cas où la Société Anonyme Hôtel de Ventes Bernaerts S.A., pour quelque raison que ce soit, est tenue de rembourser les fonds qui lui ont déjà été versés, aucun intérêt ne pourra être compté sur cette somme.
14. Offres écrites et par téléphone
Sur base d’un ordre écrit, la Société Anonyme Hôtel de Ventes Bernaerts S.A. se charge gratuitement des ordres d’achat de ses clients. L’achat des lots devra se faire de la façon la moins chère possible, pour autant que les prix limites ou les autres offres éventuelles le permettent. Les prix limites fixés par téléphone sont acceptés aux risques du vendeur. Ils doivent être confirmés par lettre ou par fax et munis de la signature de l’enchérisseur. Vous remplissez le formulaire ‘ordre d’achat’ pendant votre visite à la salle de vente, ou vous le téléchargez [link] et le remettez au plus tard 24 h avant la vente à un des collaborateurs de la Société Anonyme Hôtel de Ventes Bernaerts S.A.. Vous pouvez également l’envoyer par e-mail ([email protected]) ou par fax (+ 32 3 248.15.93), au plus tard 5 heures avant le début de la vente. Ces offres ne sont pas des ordres d’achat ni des commissions, mais des commandes d’acheter au prix indiqué. En cas d’enchère égale, l’offre orale a priorité sur l’offre écrite et l’offre numérique. Si plusieurs offres d’achat écrites d’un même montant sur le même lot atteignent la Société Anonyme Hôtel de Ventes Bernaerts S.A. et ces offres d’achat écrites représentent l’enchère la plus élevée pour le lot en question, le lot sera adjugé à la première offre d’achat écrite ayant atteint la Société Anonyme Hôtel de Ventes Bernaerts S.A.. Le commissaire-priseur n’est pas tenu d’en avertir au préalable le public. Ni la non-exécution d’un ordre par écrit pour quelconque raison, ni le manque d’exécuter un ordre par téléphone ou une enchère en ligne par erreur ou pour toute autre cause (technique ou autre) pourront être l’objet d’une demande de dommages-intérêts à charge de la Société Anonyme Hôtel de Ventes Bernaerts S.A.. Les ordres d’achat ainsi que des offres par téléphone et les enchères en ligne sont un service gratuit offert aux clients qui n’entraînent en aucun cas une quelconque responsabilité de la Société Anonyme Hôtel de Ventes Bernaerts S.A..
15. Dommages
Chaque visiteur est responsable des dommages qu’il cause aux objets et lots exposés.
16. Tribunal compétent
Tous les litiges portant sur la vente tombent, le cas échéant, sous la compétence exclusive des tribunaux d’Anvers, quel que soit le domicile des parties. Au cas où il est fait appel à des traductions des présentes conditions de vente, c’est le texte néerlandais qui prévaut.

General conditions buyer
The joint stock company Auction House Bernaerts JSC (hereafter BERNAERTS AUCTIONEERS) announces to the participants of the sale that the sale will be held according to the terms and conditions listed below and any participation in the auctions implies the unconditional acceptance of the present conditions of sale.
1. Auction day
The auction takes place through an oral or written bid. The highest bidder for each item is the successful bidder who will purchase the item against cash payment. At the time of the purchase and to the extent that he did not previously, the potential purchaser must register by presenting proof of identity and indicating his name, address, telephone number, the number of his identity card and his signature on the registration form of BERNAERTS AUCTIONEERS. In return, he will receive a paddle with its personal number to participate in the auction. In other cases, the purchaser presents himself to complete and sign his entry form, after which he will receive a paddle with his personal number. Online sale bidders must register at least 5 hours before the beginning of the auction by filling the form on My Account. For each new online sale, the buyer must register by accepting the Terms and Conditions of sale.
2. Commitment of the bidder
By its offer, the bidder commits himself to purchase the auction items for sale at the price he has proposed. He nevertheless has no say when the sale is suspended for any reason at all.
BERNAERTS AUCTIONEERS may, in case of a negligent buyer, decide to cancel the sale and sell the lot to the underbidder. BERNAERTS AUCTIONEERS may then recover any costs or lost revenue from the buyer.
3. Conduct of sale, order
The judicial officer maintains order during the sale. It is he who ultimately rules all possible disputes born of the sale, including the bidding increments and the designation of the highest bidder. The auctioneer has, among others, the right to set the minimum price of each offer, not to accept the bid of persons that he does not know or whose identity or creditworthiness not seemed proven – in which case, the previous bidder remains bound-, to suspend the sale, without having to explain thereon to the bidders, to split, join or withdraw any item. In case of obstruction or disruption of the auction by violence, threat or a fraudulent way, the provisions of article 314 of the Penal Code will be applied. In case a price limit has been set by the provider/seller, BERNAERTS AUCTIONEERS has the right to bid on behalf of the provider/seller. BERNAERTS AUCTIONEERS reserves the right to refuse any offer made by unknown buyers.
4. Buyer by mandate or third-party buyer
The purchaser may designate a proxy, provided that he signals it to the auctioneer at the end of the sale. The purchaser answers for the solvency and the competence of its proxy; each purchaser remains responsible for its purchase, even if another person is stated as (proxy) purchaser.
5. Guarantee
The successful bid does not imply any guarantee on the part of the auctioneer responsible for the sale nor on the part of the acting judicial officer, concerning among others the authenticity. Items and art objects are sold in the state in which they are at the auction exhibition and sale, and without any guarantee. Buyers are expected to have reviewed items and objects of art and to have made their offer being informed. The estimated prices quoted in the catalogue serve for information purposes only. If necessary, the catalogue on paper takes precedence over the electronic version (on paper catalogues can be consulted or downloaded free of charges on www.bernaerts.be ). In exceptional cases, the sale of an art object can be cancelled and the hammer price refunded to the purchaser if the object bought is returned within three weeks, with evidence that it is a falsification, and provided that the object remained in the same condition as at the time of the auction.
6. Indivisibility and particularity
All obligations of purchase are by law, jointly and indissolubly, both for legal persons as for physical persons, the responsibility of all those who buy for a joint account, the final purchaser and those who bought for him, on the securities between them and those for whom they act as guarantor, as well as the heirs and successors of each of the people mentioned above.
7. Payment of the purchase price and the additional costs by the purchaser
The purchaser in the room and the purchaser who has bid by purchase order must pay, immediately after the sale or at the time of the removal of the items,
the hammer price, plus 25% on the hammer price in the room, on the absentee bid and by telephone bid, including VAT, for costs.
The simultaneous sale in live (webcast) bidders must pay the purchase price increased by 28% on the hammer price, VAT included.
The silent sales and/or aftersales bidders must pay the purchase price increased by 30% on the hammer price, VAT included.
For each item, an additional administrative costs of € 2 will have to be paid and, if applicable, a droit de suite (right to follow or resale right). The droit de suite is an extension of the copyright law that entitles a compensation to the creator of a work of art in case of a resale of the work.
This right may apply both to sculptures and to graphic works of art. A droit the suite is charged in case of a resale of original works of art of living artists or artists who died less than 70 years ago and from a price of € 2,000.00 on.
It amounts to 4% of the price up to € 50,000.00;
to 3% of the auction price segment between € 50,000.01 and € 200,000.00;
to 1% of the auction price segment between € 200,000.01 and € 350,000.00;
to 0.50% of the auction price segment between € 350,000.01 and € 500,000.00;
to 0.25% of the auction price segment above € 500,000.01 price.
However, the droit de suite can never exceed € 12,500.00.
The rate of the first segment, i.e. 4%, should be applied to the entire amount that lies within this segment. (Law of 4 December 2006 and R.D. of 2 August 2007).
Only banknotes in euros (up to an amount of € 2,999 per object, fees included) will be accepted for payment of the purchase price and costs.
In case of payment through a non-certified cheque, delivery of the items may be suspended until the crediting.
8. Compensation – confusion
The buyer cannot claim nor compensation, nor confusion, nor article 1653 of the Belgian Civil Code in case of trouble of the purchaser.
9. Resale – irresponsible bidding
If the purchaser, the highest bidder, the guarantor and/or the indicated proxy have failed to immediately fulfil the obligations set out in these terms and conditions or to immediately meet one of the conditions of sale, the item may be resold on the basis of an irresponsible bidding, at the expense of the highest bidder. The resale is done by the judicial officer already requested, under the same conditions of sale. The failing purchaser shall pay the difference between the purchase price and the resale price, without being able to claim the balance between the purchase price and the resale price in case the resale price exceeds the purchase price. This balance will be to the benefit of the provider/seller or to the creditors. The irresponsible bidder is required in addition to the payment of expenses caused by its negligence and by the resale, as well as other charges of any kind, without prejudice to damages for any reason whatsoever. Delivery of a cheque which is not paid immediately at the first presentation, is considered failure to pay, without prejudice to the application of the criminal law if necessary, nor of the protest, discount and other grant.
10. Transfer of ownership – provisional measures
As soon as the highest bidder is determined, all risks related to the purchases will be the responsibility of the purchaser. The item is delivered in the state it is at the time of the auction, with all its apparent and hidden defects. At the auction, the item shall be kept with the utmost care. However, the buyer must take all measures for the preservation of the item. As soon as the highest bidder is determined, items only remain on-site at the risk and under the responsibility of the purchaser, which is solely responsible for the item he bought.
11. State of the items – exhibition
Since items and works of art are exhibited before the auction, and the terms and conditions have been communicated, the purchaser is supposed to be informed fully, personally and on his own responsibility of the state of the items and art objects. He has no recourse against BERNAERTS AUCTIONEERS, against the acting judicial officer or against the auctioneer, for error, inaccuracy, or negligence in the description of the items and works of art, nor for inconvenience, discomfort, the state of the items and works of art, their repair or restoration. All data concerning items and the works of art in catalogues, advertisements, brochures or any other written or digital communication from BERNAERTS AUCTIONEERS, and especially their description, are provided only for information purposes and without prejudice. Neither BERNAERTS AUCTIONEERS, nor the acting judicial officer assume any responsibility in this regard. The sale is preceded by an exhibition during which BERNAERTS AUCTIONEERS will be available – physically or virtually – to the public to provide information to the best of its possibilities; the exhibition is intended to allow the examination of the state of conservation and the quality of the items as well as to provide guidance on possible defects or inaccuracies in the description of the catalogue. The public can also appeal to BERNAERTS AUCTIONEERS or to an expert chosen by the interested person, for a thorough review and that, for the duration of the exhibition. BERNAERTS AUCTIONEERS is not prepared to take the item back if the description of the catalogue is revoked during the sale and that the right description is given orally to the public. Each visitor is responsible for the damage that he causes to the exposed objects and items, even if it happened coincidentally or involuntarily. Similarly, the provisions of article 2280 of the Civil Code apply to this auction.
12. Passing of possession – removal
The buyer who has paid the full purchase price and costs will pass in possession of the item sold. Upon removal, it is required to submit a proof of payment. No item can be removed during the live auction itself. Unless expressly authorized by BERNAERTS AUCTIONEERS, no item will be delivered until full payment of the purchase price and costs. The damage caused during the removal or displacement of items are at the charge and risk of the purchaser. When the time period for the removal is passed, an interest of 1% per month on the hammer price will be charged, with a minimum of € 5 per day and per item. For the removal dates we refer to the terms and conditions printed in the catalogue and on the web site.
13. Refund
In case BERNAERTS AUCTIONEERS, for whatever reason, is required to repay the funds that have already been paid, no interest can be counted on this sum.
14. Written and telephone bids
Through a written bid, BERNAERTS AUCTIONEERS takes care of its customers purchase bids, free of charge. The purchase of the items is done in the cheapest way possible, provided the price limits or other possible offers allow it. The price limits set by phone are accepted at the risk of the seller. They must be confirmed by letter or fax, undersigned by the bidder. You complete the ‘absentee bidding form’ [link] during your visit at the auction house, or you download [link] it and deliver it no later than 24 h prior to the auction to BERNAERTS AUCTIONEERS, or you send it by email (info(at)bernaerts.be) or by fax (+ 32 3 248 15 93), no later than 5 hours prior to the start of the auction. The auctioneer will try to purchase the item for you at the most beneficial price. These bids are no purchase orders nor commissions, but the orders to buy at the price indicated. In case of equal bid, the oral offer has priority on the written and digital ones. If several written bids of the same amount on the same item reach BERNAERTS AUCTIONEERS and the written bids are the highest bid for the item in question, the item will be awarded to the first written bid having reached BERNAERTS AUCTIONEERS. The auctioneer is not required to inform the public beforehand. The non-execution of a written bid, a telephone bid or an online bid by mistake or for any other cause (technical or otherwise) cannot be the subject of a claim for damages to BERNAERTS AUCTIONEERS. The written, telephone and online bids are a free service offered to customers and cannot result in any kind of responsibility of BERNAERTS AUCTIONEERS.
15. Damage
Each visitor is responsible for the damage caused to the exposed objects and items.
16. Court of jurisdiction
All disputes over the sale fall, as appropriate, under the exclusive competence of the courts of Antwerp, regardless of the domicile of the parties. In case these terms and conditions are a translation, the Dutch text will prevail.
General conditions buyer
The joint stock company Auction House Bernaerts JSC (hereafter BERNAERTS AUCTIONEERS) announces to the participants of the sale that the sale will be held according to the terms and conditions listed below and any participation in the auctions implies the unconditional acceptance of the present conditions of sale.
1. Auction day
The auction takes place through an oral or written bid. The highest bidder for each item is the successful bidder who will purchase the item against cash payment. At the time of the purchase and to the extent that he did not previously, the potential purchaser must register by presenting proof of identity and indicating his name, address, telephone number, the number of his identity card and his signature on the registration form of BERNAERTS AUCTIONEERS. In return, he will receive a paddle with its personal number to participate in the auction. In other cases, the purchaser presents himself to complete and sign his entry form, after which he will receive a paddle with his personal number. Online sale bidders must register at least 5 hours before the beginning of the auction by filling the form on My Account. For each new online sale, the buyer must register by accepting the Terms and Conditions of sale.
2. Commitment of the bidder
By its offer, the bidder commits himself to purchase the auction items for sale at the price he has proposed. He nevertheless has no say when the sale is suspended for any reason at all.
BERNAERTS AUCTIONEERS may, in case of a negligent buyer, decide to cancel the sale and sell the lot to the underbidder. BERNAERTS AUCTIONEERS may then recover any costs or lost revenue from the buyer.
3. Conduct of sale, order
The judicial officer maintains order during the sale. It is he who ultimately rules all possible disputes born of the sale, including the bidding increments and the designation of the highest bidder. The auctioneer has, among others, the right to set the minimum price of each offer, not to accept the bid of persons that he does not know or whose identity or creditworthiness not seemed proven – in which case, the previous bidder remains bound-, to suspend the sale, without having to explain thereon to the bidders, to split, join or withdraw any item. In case of obstruction or disruption of the auction by violence, threat or a fraudulent way, the provisions of article 314 of the Penal Code will be applied. In case a price limit has been set by the provider/seller, BERNAERTS AUCTIONEERS has the right to bid on behalf of the provider/seller. BERNAERTS AUCTIONEERS reserves the right to refuse any offer made by unknown buyers.
4. Buyer by mandate or third-party buyer
The purchaser may designate a proxy, provided that he signals it to the auctioneer at the end of the sale. The purchaser answers for the solvency and the competence of its proxy; each purchaser remains responsible for its purchase, even if another person is stated as (proxy) purchaser.
5. Guarantee
The successful bid does not imply any guarantee on the part of the auctioneer responsible for the sale nor on the part of the acting judicial officer, concerning among others the authenticity. Items and art objects are sold in the state in which they are at the auction exhibition and sale, and without any guarantee. Buyers are expected to have reviewed items and objects of art and to have made their offer being informed. The estimated prices quoted in the catalogue serve for information purposes only. If necessary, the catalogue on paper takes precedence over the electronic version (on paper catalogues can be consulted or downloaded free of charges on www.bernaerts.be ). In exceptional cases, the sale of an art object can be cancelled and the hammer price refunded to the purchaser if the object bought is returned within three weeks, with evidence that it is a falsification, and provided that the object remained in the same condition as at the time of the auction.
6. Indivisibility and particularity
All obligations of purchase are by law, jointly and indissolubly, both for legal persons as for physical persons, the responsibility of all those who buy for a joint account, the final purchaser and those who bought for him, on the securities between them and those for whom they act as guarantor, as well as the heirs and successors of each of the people mentioned above.
7. Payment of the purchase price and the additional costs by the purchaser
The purchaser in the room and the purchaser who has bid by purchase order must pay, immediately after the sale or at the time of the removal of the items,
the hammer price, plus 25% on the hammer price in the room, on the absentee bid and by telephone bid, including VAT, for costs.
The simultaneous sale in live (webcast) bidders must pay the purchase price increased by 28% on the hammer price, VAT included.
The silent sales and/or aftersales bidders must pay the purchase price increased by 30% on the hammer price, VAT included.
For each item, an additional administrative costs of € 2 will have to be paid and, if applicable, a droit de suite (right to follow or resale right). The droit de suite is an extension of the copyright law that entitles a compensation to the creator of a work of art in case of a resale of the work.
This right may apply both to sculptures and to graphic works of art. A droit the suite is charged in case of a resale of original works of art of living artists or artists who died less than 70 years ago and from a price of € 2,000.00 on.
It amounts to 4% of the price up to € 50,000.00;
to 3% of the auction price segment between € 50,000.01 and € 200,000.00;
to 1% of the auction price segment between € 200,000.01 and € 350,000.00;
to 0.50% of the auction price segment between € 350,000.01 and € 500,000.00;
to 0.25% of the auction price segment above € 500,000.01 price.
However, the droit de suite can never exceed € 12,500.00.
The rate of the first segment, i.e. 4%, should be applied to the entire amount that lies within this segment. (Law of 4 December 2006 and R.D. of 2 August 2007).
Only banknotes in euros (up to an amount of € 2,999 per object, fees included) will be accepted for payment of the purchase price and costs.
In case of payment through a non-certified cheque, delivery of the items may be suspended until the crediting.
8. Compensation – confusion
The buyer cannot claim nor compensation, nor confusion, nor article 1653 of the Belgian Civil Code in case of trouble of the purchaser.
9. Resale – irresponsible bidding
If the purchaser, the highest bidder, the guarantor and/or the indicated proxy have failed to immediately fulfil the obligations set out in these terms and conditions or to immediately meet one of the conditions of sale, the item may be resold on the basis of an irresponsible bidding, at the expense of the highest bidder. The resale is done by the judicial officer already requested, under the same conditions of sale. The failing purchaser shall pay the difference between the purchase price and the resale price, without being able to claim the balance between the purchase price and the resale price in case the resale price exceeds the purchase price. This balance will be to the benefit of the provider/seller or to the creditors. The irresponsible bidder is required in addition to the payment of expenses caused by its negligence and by the resale, as well as other charges of any kind, without prejudice to damages for any reason whatsoever. Delivery of a cheque which is not paid immediately at the first presentation, is considered failure to pay, without prejudice to the application of the criminal law if necessary, nor of the protest, discount and other grant.
10. Transfer of ownership – provisional measures
As soon as the highest bidder is determined, all risks related to the purchases will be the responsibility of the purchaser. The item is delivered in the state it is at the time of the auction, with all its apparent and hidden defects. At the auction, the item shall be kept with the utmost care. However, the buyer must take all measures for the preservation of the item. As soon as the highest bidder is determined, items only remain on-site at the risk and under the responsibility of the purchaser, which is solely responsible for the item he bought.
11. State of the items – exhibition
Since items and works of art are exhibited before the auction, and the terms and conditions have been communicated, the purchaser is supposed to be informed fully, personally and on his own responsibility of the state of the items and art objects. He has no recourse against BERNAERTS AUCTIONEERS, against the acting judicial officer or against the auctioneer, for error, inaccuracy, or negligence in the description of the items and works of art, nor for inconvenience, discomfort, the state of the items and works of art, their repair or restoration. All data concerning items and the works of art in catalogues, advertisements, brochures or any other written or digital communication from BERNAERTS AUCTIONEERS, and especially their description, are provided only for information purposes and without prejudice. Neither BERNAERTS AUCTIONEERS, nor the acting judicial officer assume any responsibility in this regard. The sale is preceded by an exhibition during which BERNAERTS AUCTIONEERS will be available – physically or virtually – to the public to provide information to the best of its possibilities; the exhibition is intended to allow the examination of the state of conservation and the quality of the items as well as to provide guidance on possible defects or inaccuracies in the description of the catalogue. The public can also appeal to BERNAERTS AUCTIONEERS or to an expert chosen by the interested person, for a thorough review and that, for the duration of the exhibition. BERNAERTS AUCTIONEERS is not prepared to take the item back if the description of the catalogue is revoked during the sale and that the right description is given orally to the public. Each visitor is responsible for the damage that he causes to the exposed objects and items, even if it happened coincidentally or involuntarily. Similarly, the provisions of article 2280 of the Civil Code apply to this auction.
12. Passing of possession – removal
The buyer who has paid the full purchase price and costs will pass in possession of the item sold. Upon removal, it is required to submit a proof of payment. No item can be removed during the live auction itself. Unless expressly authorized by BERNAERTS AUCTIONEERS, no item will be delivered until full payment of the purchase price and costs. The damage caused during the removal or displacement of items are at the charge and risk of the purchaser. When the time period for the removal is passed, an interest of 1% per month on the hammer price will be charged, with a minimum of € 5 per day and per item. For the removal dates we refer to the terms and conditions printed in the catalogue and on the web site.
13. Refund
In case BERNAERTS AUCTIONEERS, for whatever reason, is required to repay the funds that have already been paid, no interest can be counted on this sum.
14. Written and telephone bids
Through a written bid, BERNAERTS AUCTIONEERS takes care of its customers purchase bids, free of charge. The purchase of the items is done in the cheapest way possible, provided the price limits or other possible offers allow it. The price limits set by phone are accepted at the risk of the seller. They must be confirmed by letter or fax, undersigned by the bidder. You complete the ‘absentee bidding form’ [link] during your visit at the auction house, or you download [link] it and deliver it no later than 24 h prior to the auction to BERNAERTS AUCTIONEERS, or you send it by email (info(at)bernaerts.be) or by fax (+ 32 3 248 15 93), no later than 5 hours prior to the start of the auction. The auctioneer will try to purchase the item for you at the most beneficial price. These bids are no purchase orders nor commissions, but the orders to buy at the price indicated. In case of equal bid, the oral offer has priority on the written and digital ones. La Société Anonyme Hôtel de Ventes Bernaerts S.A. annonce aux participants de la vente que la vente sera organisée aux conditions générales et spécifiques mentionnées ci-dessous et que toute participation aux ventes aux enchères implique l’acceptation inconditionnelle des présentes conditions de vente.
1. Jour de la vente
La vente publique a lieu par le biais d’une offre orale ou écrite. L’adjudication se fait au plus offrant, par lot, contre paiement comptant. Au moment de la vente et pour autant qu’il ne l’ait pas fait auparavant, l’acquéreur potentiel doit s’inscrire en présentant une pièce d’identité et en indiquant son nom, son adresse, son numéro de téléphone, le numéro de sa pièce d’identité et en apposant sa signature sur le formulaire d’inscription de la Société Anonyme Hôtel de Ventes Bernaerts S.A.. En retour, il recevra une plaquette avec son numéro personnel pour participer aux enchères. Dans les autres cas, l’acquéreur se présente our remplir et signer son formulaire de participation, après quoi il recevra une plaquette avec son numéro personnel. Les enchérisseurs pour la vente en ligne doivent s’enregistrer au minimum 5 h avant le début des sessions. Pour chaque nouvelle vente en ligne, l’acquéreur devra s’enregistrer en acceptant les conditions générales de vente.
2. Engagement de l’enchérisseur
Par son offre, l’enchérisseur s’engage à acheter les lots mis en vente au prix qu’il a proposé. Il n’a néanmoins pas voix au chapitre lorsque la vente est suspendue pour des raisons quelconques.
Hôtel de Ventes Bernaerts S.A. peut, en cas de négligence de l’acheteur, décider d’annuler la vente et de vendre le lot au sous-enchérisseur. Hôtel de Ventes Bernaerts S.A. peut alors récupérer les coûts ou les revenus perdus auprès de l’acheteur.
3. Conduite de la vente, ordre
L’huissier de justice maintient l’ordre pendant la vente. C’est lui qui règle en dernier ressort tous les litiges possibles, nés de la vente, notamment concernant le montant des offres et la personne du plus offrant. Le commissaire-priseur a, entre autres, le droit de fixer le prix minimum de chaque offre, de ne pas accepter l’offre de personnes qu’il ne connaît pas ou dont l’identité ou la solvabilité ne lui semblent pas prouvées – dans ce cas, l’enchérisseur précédent reste lié -, de suspendre la vente, sans devoir s’en expliquer à ce sujet aux enchérisseurs, de diviser, joindre ou retirer n’importe quel lot. En cas d’obstruction ou de perturbation de l’enchère par violence, par menace ou par un moyen frauduleux, les dispositions de l’article 314 du Code Pénal seront appliquées. Au cas où un prix limite a été fixé par l’apporteur/vendeur, la Société Anonyme Hôtel de Ventes Bernaerts S.A. a le droit d’enchérir pour le compte de l’apporteur/vendeur. La Société Anonyme Hôtel de Ventes Bernaerts S.A. se réserve le droit de refuser toute offre faite par des acquéreurs inconnus.
4. Acquéreur par mandat ou par porte-fort
L’acquéreur peut désigner un mandataire, à condition qu’il le signale au commissaire-priseur dès la fin de la vente. L’acquéreur se porte fort de la solvabilité et de la compétence de son mandataire; chacun reste responsable de son achat, même si une autre personne est indiquée comme acquéreur.
5. Garantie
L’adjudication se fera sans aucune garantie de la part du commissaire-priseur chargé de la vente et de l’huissier de justice instrumentant, entre autres concernant l’authenticité. Les lots et objets d’art sont vendus dans l’état dans lequel ils se trouvent à l’endroit de l’expositon et de la vente, et sans aucune garantie. Les acquéreurs sont censés avoir examiné les lots et objets d’art et avoir fait leur offre en toute connaissance de cause. Les prix d’estimation cités dans le catalogue ont une valeur strictement informative. Le cas échéant, le catalogue sur papier prévaut sur la version électronique (les catalogues sur papier peuvent être consultés et/ou téléchargés gratuitement sur www.bernaerts.be). Dans des cas exceptionnels, la vente d’un objet d’art peut être annulée et le prix d’ajudication remboursé à l’acquéreur s’il retourne l’objet acheté dans les trois semaines, avec la preuve qu’il s’agit d’une falsification, et pour autant que l’objet soit resté dans le même état qu’au moment de la vente.
6. Indivisibilité et particularité
Toutes les obligations découlant de la vente reposent de droit, conjointement et indivisiblement, tant pour les personnes juridiques que pour les personnes physiques, sur tous ceux qui achètent pour un compte commun, sur l’acquéreur final et ceux qui ont acheté pour lui, sur les cautions entre elles et ceux pour qui ils se portent caution, ainsi que sur les héritiers et ayants cause de chacune des personnes mentionnées ci-dessus.
7. Paiement du prix d’achat et des frais par l’acquéreur
L’acquéreur en salle et celui qui a enchéri par ordre d’achat doit payer le prix d’adjudication,
majoré de 25% sur le prix d’adjudication, majoré de 25% sur le prix d’adjudication par téléphone, TVA incluse, pour les frais, à la Société Anonyme Hôtel de Ventes Bernaerts S.A., immédiatement après la vente ou au moment de l’enlèvement des lots.
Les enchérisseurs de la vente simultanée en live (webcast) doivent payer le prix d’achat majoré de 28% sur le prix d’adjudication, TVA incluse.
Les enchérisseurs de la vente silencieuse et/ou de l’Après-vente doivent payer le prix d’achat majoré de 30% sur le prix d’adjudication, TVA incluse.
Chaque lot donne lieu en outre au paiement de frais administratifs d’un montant de € 2, majorés du droit de suite éventuel. Le droit de suite s’applique pour les artistes des pays membres de l’Union européenne et des pays en dehors de l’Union européenne où selon la loi le droit de suite est applicable, et cela jusqu’à 70 ans après l’année du décès de l’artiste, pour les lots dont le prix d’adjudication est de € 2.000 ou davantage.
Le droit de suite est calculé comme suit:
– 4 % sur la partie du prix d’adjudication jusqu’ à € 50.000 inclus;
– 3 % sur la partie du prix d’adjudication de € 50.000,01 jusqu’ à € 200.000 inclus;
– 1 % sur la partie du prix d’adjudication de € 200.000,01 jusqu’ à € 350.000 inclus;
– 0,5 % sur la partie du prix d’adjudication de € 350.000,01 jusqu’ à € 500.000 inclus;
– 0,25 % sur la partie du prix d’adjudication supérieur à € 500.000.
Le montant total de ce droit ne pourra pas excéder le montant de € 12.500. (Loi du 4 décembre 2006 et A.R. du 2 août 2007).
Seuls des billets de banque en euros (jusqu’à un montant de € 2.999 par objet, frais inclus) seront acceptés pour le paiement du prix d’achat et des frais.
8. Compensation – confusion
L’acquéreur ne peut invoquer ni la compensation, ni la confusion, ni l’article 1653 du Code Civil belge concernant le trouble de l’acquéreur.
9. Réadjudication – folle enchère
Si l’acquéreur, celui à qui un lot est adjugé, la caution et/ou le mandataire indiqué restent en défaut de remplir immédiatement les obligations prescrites dans les présentes conditions ou de satisfaire immédiatement à une des conditions de vente, le lot peut être remis en vente pour folle enchère à charge de celui à qui il a été adjugé. La remise en vente se fait par l’huissier de justice déjà prié, dans les mêmes conditions de vente. L’acquéreur resté en défaut est tenu de payer la différence entre le prix d’achat et celui de la réadjudication, sans qu’il puisse réclamer le solde éventuel au cas où la nouvelle vente atteint un prix de vente plus élevé. Ce solde revient à l’apporteur/vendeur ou à la masse des créanciers unis. Le fol enchérisseur est tenu en outre au paiement des frais provoqués par sa négligence et par la réadjudication, ainsi que des autres frais de toute nature, sans préjudice des dommages-intérêts pour quelque raison que ce soit. La remise d’un chèque bancaire qui n’est pas payé immédiatement à la première présentation, vaut comme omission de paiement,sans préjudice de l’application de la loi pénale s’il y a lieu, ni de l’indemnité pour frais de protêt, d’escompte et autres.
10. Transfert de propriété – mesures conservatoires
Dès l’adjudication, tous les risques afférents aux achats seront à la charge de l’adjudicataire. Le lot est transmis dans l’état dans lequel il se trouve au moment de l’adjudication, avec tous ses vices apparents et cachés. Dès l’adjudication, le lot doit être conservé avec le plus grand soin. L’acquéreur doit cependant prendre toutes les mesures utiles pour la conservation du lot. À partir de l’adjudication, les lots ne restent plus sur place qu’aux risques et à la charge de l’acquéreur, qui est seul responsable du lot qu’il a acheté.
11. État des lots – exposition
Vu que les lots et les objets d’arts ont été exposés avant la vente publique, et que les conditions de vente ont été communiquées, l’acquéreur est censé être informé entièrement, personnellement et sur sa propre responsabilité de l’état des lots et des objets d’art. Il n’a aucun recours contre la Société Anonyme Hôtel de Ventes Bernaerts S.A., contre l’huissier de justice instrumentant ou contre le commissaire-priseur, pour erreur, imprécision ou négligence dans la description des lots et des objets d’art, ni pour dérangement, gêne, l’état des lots et objets d’art, leur réparation ou leur restauration. Toutes les données concernant les lots et les objets d’art dans les catalogues, annonces, brochures ou toute autre communication écrite ou numérique de la Société Anonyme Hôtel de Ventes Bernaerts S.A., et plus particulièrement leur description, ne sont fournies qu’à titre d’information et sous toute réserve. Ni la Société Anonyme Hôtel de Ventes Bernaerts S.A., ni l’huissier de justice instrumentant n’assume de responsabilité à cet égard. La vente est précédée d’une exposition pendant laquelle la Société Anonyme Hôtel de Ventes Bernaerts S.A. se tiendra à la disposition du public – physiquement ou de distance- pour lui fournir des renseignements au mieux de ses possibilités; l’exposition a pour but de permettre un examen minutieux de l’état de conservation et de la qualité des lots ainsi que de donner des indications sur les vices ou inexactitudes éventuels dans la description du catalogue. Le public peut en outre faire appel à la Société Anonyme Hôtel de Ventes Bernaerts S.A. ou à un expert choisi par l’amateur, en vue d’un examen approfondi et ce, pendant toute la durée de l’exposition. La Société Anonyme Hôtel de Ventes Bernaerts S.A. n’est pas disposée à reprendre le lot si la description du catalogue est révoquée pendant la vente et que la bonne description est donnée oralement au public. Chaque visiteur est responsable des dégâts qu’il cause aux objets et lots exposés, même s’ils sont la conséquence du hasard ou sont involontaires. De même, les dispositions de l’article 2280 du Code Civil s’appliquent à cette vente publique.
12. Entrée en jouissance – enlèvement
L’acquéreur qui a payé entièrement le prix d’achat et les frais entre en jouissance du lot vendu. Lors de l’enlèvement, il est tenu de présenter une preuve de paiement. Aucun lot ne peut être enlevé pendant la vente même. Sauf autorisation expresse de la Société Anonyme Hôtel de Ventes Bernaerts S.A., aucun lot ne sera livré avant le paiement intégral du prix d’achat et des frais. Les dommages occasionnés lors de l’enlèvement ou du déplacement des lots sont à charge et aux risques de l’acquéreur. Lorsque le délai d’enlèvement est passé, un intérêt de 1% par mois sur le prix d’adjudication sera porté en compte, avec un minimum de € 5 par jour et par lot. 13. Remboursement
Au cas où la Société Anonyme Hôtel de Ventes Bernaerts S.A., pour quelque raison que ce soit, est tenue de rembourser les fonds qui lui ont déjà été versés, aucun intérêt ne pourra être compté sur cette somme.
14. Offres écrites et par téléphone
Sur base d’un ordre écrit, la Société Anonyme Hôtel de Ventes Bernaerts S.A. se charge gratuitement des ordres d’achat de ses clients. L’achat des lots devra se faire de la façon la moins chère possible, pour autant que les prix limites ou les autres offres éventuelles le permettent. Les prix limites fixés par téléphone sont acceptés aux risques du vendeur. Ils doivent être confirmés par lettre ou par fax et munis de la signature de l’enchérisseur. 15. Dommages
Chaque visiteur est responsable des dommages qu’il cause aux objets et lots exposés.
16. Tribunal compétent
Tous les litiges portant sur la vente tombent, le cas échéant, sous la compétence exclusive des tribunaux d’Anvers, quel que soit le domicile des parties. Au cas où il est fait appel à des traductions des présentes conditions de vente, c’est le texte néerlandais qui prévaut.

General conditions buyer
The joint stock company Auction House Bernaerts JSC (hereafter BERNAERTS AUCTIONEERS) announces to the participants of the sale that the sale will be held according to the terms and conditions listed below and any participation in the auctions implies the unconditional acceptance of the present conditions of sale.
1. Auction day
The auction takes place through an oral or written bid. The highest bidder for each item is the successful bidder who will purchase the item against cash payment. At the time of the purchase and to the extent that he did not previously, the potential purchaser must register by presenting proof of identity and indicating his name, address, telephone number, the number of his identity card and his signature on the registration form of BERNAERTS AUCTIONEERS. In return, he will receive a paddle with its personal number to participate in the auction. In other cases, the purchaser presents himself to complete and sign his entry form, after which he will receive a paddle with his personal number. Online sale bidders must register at least 5 hours before the beginning of the auction by filling the form on My Account. For each new online sale, the buyer must register by accepting the Terms and Conditions of sale.
2. Commitment of the bidder
By its offer, the bidder commits himself to purchase the auction items for sale at the price he has proposed. He nevertheless has no say when the sale is suspended for any reason at all.
BERNAERTS AUCTIONEERS may, in case of a negligent buyer, decide to cancel the sale and sell the lot to the underbidder. BERNAERTS AUCTIONEERS may then recover any costs or lost revenue from the buyer.
3. Conduct of sale, order
The judicial officer maintains order during the sale. It is he who ultimately rules all possible disputes born of the sale, including the bidding increments and the designation of the highest bidder. The auctioneer has, among others, the right to set the minimum price of each offer, not to accept the bid of persons that he does not know or whose identity or creditworthiness not seemed proven – in which case, the previous bidder remains bound-, to suspend the sale, without having to explain thereon to the bidders, to split, join or withdraw any item. In case of obstruction or disruption of the auction by violence, threat or a fraudulent way, the provisions of article 314 of the Penal Code will be applied. In case a price limit has been set by the provider/seller, BERNAERTS AUCTIONEERS has the right to bid on behalf of the provider/seller. BERNAERTS AUCTIONEERS reserves the right to refuse any offer made by unknown buyers.
4. Buyer by mandate or third-party buyer
The purchaser may designate a proxy, provided that he signals it to the auctioneer at the end of the sale. The purchaser answers for the solvency and the competence of its proxy; each purchaser remains responsible for its purchase, even if another person is stated as (proxy) purchaser.
5. Guarantee
The successful bid does not imply any guarantee on the part of the auctioneer responsible for the sale nor on the part of the acting judicial officer, concerning among others the authenticity. Items and art objects are sold in the state in which they are at the auction exhibition and sale, and without any guarantee. Buyers are expected to have reviewed items and objects of art and to have made their offer being informed. The estimated prices quoted in the catalogue serve for information purposes only. If necessary, the catalogue on paper takes precedence over the electronic version (on paper catalogues can be consulted or downloaded free of charges on www.bernaerts.be ). In exceptional cases, the sale of an art object can be cancelled and the hammer price refunded to the purchaser if the object bought is returned within three weeks, with evidence that it is a falsification, and provided that the object remained in the same condition as at the time of the auction.
6. Indivisibility and particularity
All obligations of purchase are by law, jointly and indissolubly, both for legal persons as for physical persons, the responsibility of all those who buy for a joint account, the final purchaser and those who bought for him, on the securities between them and those for whom they act as guarantor, as well as the heirs and successors of each of the people mentioned above.
7. Payment of the purchase price and the additional costs by the purchaser
The purchaser in the room and the purchaser who has bid by purchase order must pay, immediately after the sale or at the time of the removal of the items,
the hammer price, plus 25% on the hammer price in the room, on the absentee bid and by telephone bid, including VAT, for costs.
The simultaneous sale in live (webcast) bidders must pay the purchase price increased by 28% on the hammer price, VAT included.
The silent sales and/or aftersales bidders must pay the purchase price increased by 30% on the hammer price, VAT included.
For each item, an additional administrative costs of € 2 will have to be paid and, if applicable, a droit de suite (right to follow or resale right). The droit de suite is an extension of the copyright law that entitles a compensation to the creator of a work of art in case of a resale of the work.
This right may apply both to sculptures and to graphic works of art. A droit the suite is charged in case of a resale of original works of art of living artists or artists who died less than 70 years ago and from a price of € 2,000.00 on.
It amounts to 4% of the price up to € 50,000.00;
to 3% of the auction price segment between € 50,000.01 and € 200,000.00;
to 1% of the auction price segment between € 200,000.01 and € 350,000.00;
to 0.50% of the auction price segment between € 350,000.01 and € 500,000.00;
to 0.25% of the auction price segment above € 500,000.01 price.
However, the droit de suite can never exceed € 12,500.00.
The rate of the first segment, i.e. 4%, should be applied to the entire amount that lies within this segment. (Law of 4 December 2006 and R.D. of 2 August 2007).
Only banknotes in euros (up to an amount of € 2,999 per object, fees included) will be accepted for payment of the purchase price and costs.
In case of payment through a non-certified cheque, delivery of the items may be suspended until the crediting.
8. Compensation – confusion
The buyer cannot claim nor compensation, nor confusion, nor article 1653 of the Belgian Civil Code in case of trouble of the purchaser.
9. Resale – irresponsible bidding
If the purchaser, the highest bidder, the guarantor and/or the indicated proxy have failed to immediately fulfil the obligations set out in these terms and conditions or to immediately meet one of the conditions of sale, the item may be resold on the basis of an irresponsible bidding, at the expense of the highest bidder. The resale is done by the judicial officer already requested, under the same conditions of sale. The failing purchaser shall pay the difference between the purchase price and the resale price, without being able to claim the balance between the purchase price and the resale price in case the resale price exceeds the purchase price. This balance will be to the benefit of the provider/seller or to the creditors. The irresponsible bidder is required in addition to the payment of expenses caused by its negligence and by the resale, as well as other charges of any kind, without prejudice to damages for any reason whatsoever. Delivery of a cheque which is not paid immediately at the first presentation, is considered failure to pay, without prejudice to the application of the criminal law if necessary, nor of the protest, discount and other grant.
10. Transfer of ownership – provisional measures
As soon as the highest bidder is determined, all risks related to the purchases will be the responsibility of the purchaser. The item is delivered in the state it is at the time of the auction, with all its apparent and hidden defects. At the auction, the item shall be kept with the utmost care. However, the buyer must take all measures for the preservation of the item. As soon as the highest bidder is determined, items only remain on-site at the risk and under the responsibility of the purchaser, which is solely responsible for the item he bought.
11. State of the items – exhibition
Since items and works of art are exhibited before the auction, and the terms and conditions have been communicated, the purchaser is supposed to be informed fully, personally and on his own responsibility of the state of the items and art objects. He has no recourse against BERNAERTS AUCTIONEERS, against the acting judicial officer or against the auctioneer, for error, inaccuracy, or negligence in the description of the items and works of art, nor for inconvenience, discomfort, the state of the items and works of art, their repair or restoration. All data concerning items and the works of art in catalogues, advertisements, brochures or any other written or digital communication from BERNAERTS AUCTIONEERS, and especially their description, are provided only for information purposes and without prejudice. Neither BERNAERTS AUCTIONEERS, nor the acting judicial officer assume any responsibility in this regard. The sale is preceded by an exhibition during which BERNAERTS AUCTIONEERS will be available – physically or virtually – to the public to provide information to the best of its possibilities; the exhibition is intended to allow the examination of the state of conservation and the quality of the items as well as to provide guidance on possible defects or inaccuracies in the description of the catalogue. The public can also appeal to BERNAERTS AUCTIONEERS or to an expert chosen by the interested person, for a thorough review and that, for the duration of the exhibition. BERNAERTS AUCTIONEERS is not prepared to take the item back if the description of the catalogue is revoked during the sale and that the right description is given orally to the public. Each visitor is responsible for the damage that he causes to the exposed objects and items, even if it happened coincidentally or involuntarily. Similarly, the provisions of article 2280 of the Civil Code apply to this auction.
12. Passing of possession – removal
The buyer who has paid the full purchase price and costs will pass in possession of the item sold. Upon removal, it is required to submit a proof of payment. No item can be removed during the live auction itself. Unless expressly authorized by BERNAERTS AUCTIONEERS, no item will be delivered until full payment of the purchase price and costs. The damage caused during the removal or displacement of items are at the charge and risk of the purchaser. When the time period for the removal is passed, an interest of 1% per month on the hammer price will be charged, with a minimum of € 5 per day and per item. For the removal dates we refer to the terms and conditions printed in the catalogue and on the web site.
13. Refund
In case BERNAERTS AUCTIONEERS, for whatever reason, is required to repay the funds that have already been paid, no interest can be counted on this sum.
14. Written and telephone bids
Through a written bid, BERNAERTS AUCTIONEERS takes care of its customers purchase bids, free of charge. The purchase of the items is done in the cheapest way possible, provided the price limits or other possible offers allow it. The price limits set by phone are accepted at the risk of the seller. They must be confirmed by letter or fax, undersigned by the bidder. You complete the ‘absentee bidding form’ [link] during your visit at the auction house, or you download [link] it and deliver it no later than 24 h prior to the auction to BERNAERTS AUCTIONEERS, or you send it by email (info(at)bernaerts.be) or by fax (+ 32 3 248 15 93), no later than 5 hours prior to the start of the auction. The auctioneer will try to purchase the item for you at the most beneficial price. These bids are no purchase orders nor commissions, but the orders to buy at the price indicated. In case of equal bid, the oral offer has priority on the written and digital ones. If several written bids of the same amount on the same item reach BERNAERTS AUCTIONEERS and the written bids are the highest bid for the item in question, the item will be awarded to the first written bid having reached BERNAERTS AUCTIONEERS. The auctioneer is not required to inform the public beforehand. The non-execution of a written bid, a telephone bid or an online bid by mistake or for any other cause (technical or otherwise) cannot be the subject of a claim for damages to BERNAERTS AUCTIONEERS. The written, telephone and online bids are a free service offered to customers and cannot result in any kind of responsibility of BERNAERTS AUCTIONEERS.
15. Damage

16. Court of jurisdiction
All disputes over the sale fall, as appropriate, under the exclusive competence of the courts of Antwerp, regardless of the domicile of the parties. In case these terms and conditions are a translation, the Dutch text will prevail.

The viewing days run from Thursday 13 June to Monday 17 June from 10am to 6pm.

By appointment and after receipt of payment, you can collect your works from Monday 24 June to Friday 5 July, between 9am-12pm and 1pm-17pm and on Saturday 29 June between 10am and 1pm.
