1. L’adjudication est en francs suisses. Le règlement des achats peut se faire par virement bancaire ou en espèces. Les cartes de crédit sont acceptées sur place et à distance à travers notre plateforme de paiement en lien avec le bordereau d’adjudication (frais en sus, à titre de participation aux frais perçus par l’émetteur de la carte, en fonction de la carte). Les chèques ne sont pas acceptés.
2. La vente se fait par numéro d’enchérisseur. Les personnes qui désirent enchérir sont priées de se légitimer avant la vacation auprès des organisateurs. Elles recevront un numéro destiné à les identifier. L’adjudication sera prononcée en faveur du dernier enchérisseur. En cas de litige entre deux enchérisseurs au moment de l’adjudication, celle-ci est annulée et le lot est immédiatement remis en vente. DognyAuction se réserve le droit de modifier l’ordre de vacation listé au catalogue, de séparer, regrouper ou exclure des lots durant la vente.
3. Les surenchères doivent avoir lieu à haute voix ou par lever du numéro traduisant sans équivoque la volonté de surenchérir.
4. Le présent catalogue a été confectionné avec soin afin que les in-dications portées soient correctes. Important: les dernières mises à jour du catalogue figurent exclusivement sur le site de référence www.dognyauction. ch, veuillez vous y référer pour toute information ou condition complémen-taire. Les objets sont vendus dans l’état où ils se trouvent au moment de l’adjudication, avec leurs défauts, imperfections et erreurs éventuelles de description. La description ainsi que le rapport de condition et l’évaluation ont été faits avec soin mais sont donnés à titre indicatif et ne constituent en aucun cas un élément de garantie. Il en est de même en ce qui concerne l’auteur, la signature, la date, la provenance, l’attribution, l’origine, l’authenticité et l’état des lots. L’acheteur se fera sa propre opinion sur le lot, en particulier pendant l’exposition. Une fois l’adjudication prononcée, aucune réclamation de quelque nature qu’elle soit ne sera admise, même si elle a pour objet la description au catalogue. Il n’est assumé aucune responsabilité pour les cadres et le verre ni avant ni après l’adjudication.
5. Tout visiteur est responsable à concurrence du prix d’estimation augmenté de la commission plus TVA des dommages qu’il cause aux objets et lots exposés.
6. Les ordres peuvent être déposés directement sur notre plateforme d’enchères live.dognyauction.ch à travers notre application pour les mobiles ou l’ordinateur. Ils peuvent également être déposés auprès de l’étude en remplissant le formulaire d’ordre ou à travers notre site dognyauction.ch. Les ordres doivent parvenir au plus tard avant 16h, le jour précédant la vente. Ils sont exécutés avec soin, en toute discrétion et sans frais. Le commissaire-pri-seur décline toute responsabilité pour d’éventuels problèmes de connexion ou tout manquement dans l’exécution d’une offre, quelle qu’en soit la raison. Les offres sont enregistrées en fonction de leur heure d’arrivée. Si plusieurs offres écrites sont reçues avec la même offre maximale pour le même lot, le lot sera adjugé à l’offre reçue en premier. Les ordres passant par l’étude font l’objet d’une confirmation d’ordre, veuillez prendre contact avec l’étude si vous ne l’avez pas reçue.
7. Les enchères par téléphone sont conseillées pour des lots dont l’estimation est supérieure à 5000.-. Elles sont acceptées pour des lots à partir de 550 CHF d’estimation basse. Pour des lots dont l’estimation basse est égale ou inférieure à 500 CHF, une enchère téléphonique est néanmoins susceptible d’être considérée dans le cas où il s’agit d’une offre ferme à l’es-timation basse, ainsi l’enchère débutera à l’estimation basse stricte et non négociable du lot.
8. L’acheteur paie une prime acheteur de 23 % + TVA de 8.1% sur l’échute. Les enchérisseurs utilisant une autre plateforme que live.dognyauc-tion.ch pour enchérir sont soumis à une surtaxe dont le montant dépend de la plateforme choisie (de 3 à 5% + TVA ). Pour les lots marqués d’une astérisque, la TVA due par l’acheteur est calculée sur le prix d’adjudication augmenté de l’échute. Pour un montant de TVA sur le prix d’adjudication supérieur à 100 CHF, tout acheteur exportant son lot peut faire une demande de remboursement sur envoi des documents d’exportation, validés par les douanes suisses dans les trois mois après l’adjudication. La TVA sur le service n’est pas remboursable quel que soit le lieu d’exportation du bien acquis.
9. Les profits et risques passent à l’acheteur dès l’adjudication pronon-cée. Aucune réserve financière n’est autorisée après adjudication. Le vendeur conserve la propriété de l’objet jusqu’au règlement intégral du bien. Les lots ne peuvent être délivrés à l’acheteur avant le paiement complet de ceux-ci. Certains lots peuvent être soumis à des restrictions d’exportation de Suisse selon le mode de transport ou être considérés comme marchandise dange-reuse ou marchandise interdite d’exportation libre. Il peut en être de même en ce qui concerne le pays d’importation. Certains lots nécessitent un per-mis ou une licence d’exportation ou d’importation des autorités locales. Ces démarches administratives relèvent de la seule responsabilité de l’acheteur même si aucune mention n’est décrite au catalogue. Le délai d’obtention de la licence ou sa non obtention ne justifie en rien une annulation de la vente ou une obtention de délai de paiement du prix total de ces lots.
10. Celui qui intentionnellement entrave ou fausse le libre jeu des en-chères sera passible de poursuites judiciaires.
11. Tout bordereau d’adjudication doit être payé dans les 10 jours, le non-respect de cette clause peut entraîner des frais de rappel, des poursuites judiciaires ainsi que l’annulation de la vente selon réquisition du vendeur, tous frais et commissions demeurant à la charge de l’acheteur.
Tout bordereau d’adjudication impayé ou en retard de paiement expose l’acheteur à une inscription au fichier Temis consultable par les structures de vente abonnées. Cette inscription peut entraîner des restrictions telles que des suspensions de participation à leurs ventes aux enchères.
12. Les lots seront enlevés aux frais et risques de l’acquéreur dans les meilleurs délais. Pour tout lot non retiré dans les 14 jours après la vente, il sera facturé un montant de CHF 50 par semaine pour gardiennage et frais administratifs. Sur demande de l’acheteur et pour son propre compte, nous pouvons organiser un envoi de son lot ou l’aider à trouver un transporteur. Pour cela, contacter [email protected]. De son côté, l’acheteur comprend les risques encourus lors de cette opération et prend à sa charge l’entière responsabilité de cette procédure. Il décharge DognyAuction de toute res-ponsabilité pour une quelconque perte ou dommage pouvant survenir lors de l’emballage, du transit ou de l’envoi du lot (voir §9).
13. Si, une fois les lots entièrement acquittés, l’acquéreur ne donne plus aucun signe de vie, reste inatteignable et ne laisse aucune instruction dans les 6 mois après la vente, les lots pourront être remis en vente pour le compte de l’acheteur, selon les conditions usuelles. Le montant obtenu pourra être exigé dans un délai de 3 ans. Passé ce délai, le montant devient propriété de EnchèresDognySA.
14. Tout litige relatif à la vente est soumis à l’application exclusive du droit suisse et à la juridiction des tribunaux du canton de Vaud, quel que soit le domicile des parties.

- The sale will be expressed in Swiss francs and without warranty. Payment shall be made in cash or via bank transfer in Swiss Francs. Cheques are not accepted, credit cards are accepted when you attend the sale in person or through our platform of payment. If you like to transfer the amount in Euros, you must first claim for an invoice in Euros and for the proper account number.
- Bidders are requested to give their first name, last name, phone numbers, address and e-mail address in order to receive a paddle number, before the beginning of the auction. New customers are kindly asked to legitimate their identity by presenting their identity card and a proof of residence. As a general rule, bidding starts with the price stated in the catalogue. The price listed next to the description is not an estimate price but a starting price. If a reserve price has been set, the auctioneer may bid on account of the vendor up to the one increment under the reserve price, even if this one is higher than the starting price. No lot can be sold under the reserve price. ****The auctioneer may vary the increments at his discretion. The auctioneer reserves the right to refuse any bid and to sell lots in a different order than the one listed in the catalogue. He also reserves the right, in his absolute discretion, to divide, combine or withdraw lots.
- The bids must clearly and unequivocally express the will of the bidder. The highest bid will be eligible for the lot. Any doubt connected with the fall of the hammer should be expressed without delay. In case of dispute between two bidders that cannot be settled immediately, the auctioneer reserves the right, whether immediately during or after the sale, to restart or continue the bidding or to re-offer the lot.

The auctioneer or his staff is not responsible for any connection problems or failure in executing a bid for whatever reason. The bids are registered according to their order of reception. If we receive several written bids for the same lot at the same amount, the lot will be awarded to the first bidder.
- Phone bids are accepted at the low estimate price mentioned in the catalogue. For lots with a low estimate price under or equal to 550 Swiss francs, the phone bid, even not reachable, is considered as a firm offer at the low estimate price.
- Buyer’s premium is 23 % (plus VAT of 8.1% on the commission). Buyer’s premium may differ with online bidding (please refer to appropriate online bidding terms). If the winning bid is placed on a live platform different than LIVE.DognyAuction or on a still platform including a surcharge, the surcharge of 3-5% + a VAT of 8.1% on the surcharge will be added to the regular commission. For “online only auctions”, buyer’s premium is 23% + VAT of 8.1% on the premium. In case of export, the VAT will be refunded to purchasers providing a valid stamped export declaration within three months after the sale. An administrative fee of CHF30 is charged for this service.
- The risks and rewards pass to the buyer upon the fall of the hammer. However, he becomes the owner of the object upon full payment. The goods may not be handed over to the buyer until full payment has been achieved. Some property that is sold at auction can be subject to import restrictions or to Swiss export restrictions, such as items considered as dangerous or goods forbidden for exportation. Having a valid export or import license or any other required permit is the sole responsibility of the buyer, even if no mention is made in the catalogue. Failure or delay of licensing will not justify rescission of any sale nor delay in payment.
- Whoever intentionally obstructs or distorts the free play of the auction will be subject to the penalties of the law.
- Auction invoices must be paid within 10 days. Failure to comply with this clause may result in reminder fees, legal action, and the cancellation of the sale at the seller's request, with all costs and commissions remaining the buyer's responsibility. Any unpaid or delayed paid invoice exposes the buyer to registration in the Temis file, which can be consulted by subscribing auction houses. This registration may lead to restrictions, such as suspension from participating in their auctions.
- The auctioned items must be collected at the purchaser’s own cost and risk within 14 days from the end of the auction during official opening hours.
- If the auctioned items are not collected within 14 days, DognyAuction will store the works at the purchaser’s own risk and expense at a weekly rate of CHF 50 per object.
- Large objects not removed 20 days after the sale will be transferred to a storehouse which will charge the buyer for moving and storing his objects. The warehouse is not affiliated to Dognyauction.
- On behalf and request of the buyer, we gladly arrange the sending of his lot(s), but Dognyauction accepts no liability for any damage or loss that may occur during the packing or shipping of the items.
- In the event that one or more lots purchased at an auction have not been collected by the buyer within 6 months and the storage costs exceed the value of the lot(s), SA reserves the right to sell the lot(s) in order to recover all costs incurred.
- Any dispute relating to the sale is subject to the exclusive application of the Swiss law and the jurisdiction of the Courts of the Canton of Vaud, regardless of the place of residence of the parties.
- Only the French version of the auction terms and conditions is decisive and legally valid.
