Arturo Martini Treviso 1889-Milan 1947 Choral 1934 ca. Terracotta sculpture Engraved signature "Martini". Donated by the artist to the journalist and literary critic Enrico Falqui (1901 - 1974), the work was modeled during the 1930s and perhaps used in 1936-37, a period in which Arturo Martini worked on designing the models (dispersed ) created for the Arco della Vittoria Competition to be placed in Piazza Fiume in Milan; competition won by Martini for the great monumental work designed with the architects Mazzoleni and Carminati, but not built (Gatalogo raisonné, Vicenza, Neri Pozza1998 n. 438). It depicts a compact group of twenty female figures in a standing position, caught in the act of singing out loud, huddled together so as to form a block which however is enlivened by the different poses of the individual figures, placed very effectively intuition on a sloping terrace which gives the scene a particular charm and unusual animation (a similar base is found in the Monaca of 1919 and in the Palinuro of 1946). In fact, the choral composition seems to allude to a theatrical scene, as happened in ancient theater, or in any case to a public event. The solution closely resembles other compositions such as the Brigands group (262) proposed in several versions, terracotta and majolica, and the Collegiate group (Catalogue raisonné no. 267), conceived in a circular composition with a void in the center, all works dating back to the early 1930s; finally, the unique terracotta entitled Greek Tragedy (Catalogue raisonné no. 317) also dates back to around 1932, probably connected to the present sculpture if only for the theatrical theme. In consideration of these evaluations and faced with the fact that we do not know the title assigned by the artist for the work in question here, the provisional title of: Female Choir is proposed. The present sculpture will be included in the next edition of the General Catalog of Arturo Martini's sculptures, currently under development. Obblighi di Arcadia nei confronti dell’ acquirente
- Casa d’aste Arcadia s.r.l. (di seguito “Arcadia”) svolge le vendite all’asta nella propria sede aperta al pubblico, in qualità di mandataria con rappresentanza in nome proprio e per conto del venditore, ai sensi dell’art. 1704 cod. civ. Arcadia pertanto non assume nei confronti degli acquirenti o di terzi in genere altre responsabilità oltre a quelle derivanti dalla propria qualità di mandataria.
Vendita all'asta
- Al fine di migliorare le procedure di vendita all’incanto, tutti gli interessati a concorrere all’asta sono tenuti a registrare le proprie generalità, indirizzo con esibizione e copia di un documento di identità per munirsi di “paletta” numerata per le offerte, prima dell’inizio dell’asta. Contestualmente gli interessati accettano le Condizioni di vendita e forniscono il consenso al trattamento dei suddetti dati personali.
- Arcadia si riserva il diritto di rifiutare le offerte di acquirenti non registrati e, in seguito a mancato o ritardato pagamento da parte di un acquirente, Arcadia potrà rifiutare qualsiasi offerta fatta dallo stesso o da suo rappresentante nel corso di successive aste.
- I lotti sono aggiudicati al miglior offerente. Il banditore conduce l’asta e può effettuare le prime offerte nell’interesse del mandante.
- L’avvenuta vendita tra il venditore e l’acquirente è sancita dal colpo di martello del banditore. In caso di contestazione su un’aggiudicazione, il lotto è rimesso all’incanto nella seduta stessa, sulla base dell’ultima offerta raccolta. Il banditore ha la facoltà di ritirare dall’asta, separare o abbinare i lotti ed eventualmente variarne l’ordine di vendita.
- Arcadia accetta offerte d’acquisto di lotti a prezzi determinati, su preciso mandato. Durante l’asta è possibile che vengano fatte offerte via internet e per telefono le quali sono accettate a insindacabile giudizio di Arcadia e trasmesse al banditore.
- Le conversazioni telefoniche potranno essere registrate.
Responsabilita’ del venditore e di Arcadia nei confronti dell’acquirente
- I lotti posti in vendita sono da considerarsi beni usati o d’antiquariato e quindi non qualificabili “prodottI” secondo la definizione di cui all’ar t. 3 lett. e) del Codice del consumo (D.Lgs. 6.09.2005 n. 206).
- Precederà l’asta un’esposizione delle opere, durante la quale Arcadia e i propri esperti saranno a disposizione per ogni chiarimento; l’esposizione ha lo scopo di far esaminare l’autenticità, l’attribuzione, lo stato di conservazione , la provenienza, il tipo e la qualità degli oggetti e chiarire eventuali errori o inesattezze del catalogo. Nell’impossibilità di prendere visione diretta degli oggetti è possibile richiedere un “Condition Report”. La mancanza di riferimenti espliciti in merito alle condizioni del lotto non implica che il bene sia senza imperfezioni. Tutti gli oggetti sono venduti come “visti” pertanto, prima di partecipare all’asta, i potenziali acquirenti s’impegnano ad esaminare approfonditamente i lotti d’interesse, eventualmente assistiti da un esperto di propria fiducia. Dopo l’aggiudicazione non sono ammesse contestazioni e né Arcadia, né il venditore potranno essere ritenuti responsabili per i vizi relativi alle informazioni concernenti gli oggetti in asta.
- I lotti posti in asta sono venduti nello stato in cui si trovano al momento dell’esposizione, con ogni relativo difetto ed imperfezione quali rotture, restauri, mancanze o sostituzioni. Tali caratteristiche, anche se non espressamente indicate sul catalogo, non possono essere considerate determinanti per contestazioni sulla vendita. I beni d’antiquariato per loro stessa natura possono essere stati oggetto di restauri o sottoposti a modifiche di varia natura: interventi di tale tipo non possono mai esser considerati vizi occulti o contraffazione. I beni di natura elettrica o meccanica non sono verificati prima della vendita e sono acquistati dall’acquirente a suo rischio e pericolo. I movimenti degli orologi sono da considerarsi non revisionati.
- Le descrizioni o illustrazioni dei lotti contenute nei cataloghi ed in qualsiasi altro materiale illustrativo hanno carattere meramente indicativo e riflettono opinioni di Arcadia e dei propri esperti. Possono essere oggetto di revisione in qualsiasi momento prima che il lotto sia posto in vendita. Arcadia non potrà essere ritenuta responsabile di errori ed omissioni relative a tali descrizioni, ne’ in ipotesi di contraffazione, in quanto non è fornita alcuna garanzia sui lotti in asta. Inoltre, le illustrazioni degli oggetti presentati sui cataloghi, sugli schermi o altro materiale illustrativo hanno esclusivamente la finalità di identificare il lotto e non possono essere considerate rappresentazioni precise dello stato di conservazione dell’oggetto.
- I valori di stima indicati nel catalogo sono espressi in euro e costituiscono una mera indicazione. Tali valori possono essere uguali, superiori o inferiori ai prezzi di riserva dei lotti concordati con i mandanti.
Pagamento e ritiro; trasferimento di responsabilità
- Al prezzo di aggiudicazione è da aggiungere la commissione d'acquisto (diritti di asta) nella misura del 25,00 % del prezzo di aggiudicazione del lotto fino all’importo pari a euro 400.000,00. Per ogni parte del prezzo di aggiudicazione eccedente l’importo di euro 400.000,00 la commissione d'acquisto è stabilita nella misura del 21,00%. Le percentuali sopra indicate sono da intendersi IVA inclusa, ai sensi delle normative vigenti. Qualunque ulteriore onere o tributo relativo all'acquisto sarà comunque a carico dell’aggiudicatario.
- L’acquirente dovrà versare un acconto all’atto dell’aggiudicazione e completare il pagamento prima di ritirare la merce a sua cura, rischio e spesa non oltre quindici giorni dalla fine della vendita. In caso di mancato pagamento, in tutto o in parte, dell’ammontare totale dovuto dall’aggiudicatario entro tale termine, Arcadia avrà diritto, a propria discrezione, di: a) restituire il bene al mandante, esigendo a titolo di penale da parte del mancato acquirente il pagamento delle commissioni di vend ita perdute; b) agire in via giudiziale per ottenere l’esecuzione coattiva dell’obbligo d’acquisto; c) vendere il lotto tramite trattativa privata o in aste successive per conto ed a spese dell’aggiudicatario, ai sensi dell’art. 1515 cod.civ., salvo in ogni caso il diritto al risarcimento dei danni.
- Decorso il termine di cui sopra, Arcadia sarà comunque esonerata da ogni responsabilità nei confronti dell’aggiudicatario in relazione all’eventuale deterioramento o deperimento degli oggetti ed avrà diritto di farsi pagare per ogni singolo lotto i diritti di custodia oltre a eventuali rimborsi di spese per trasporto al magazzino. Qualunque rischio per perdita o danni al bene aggiudicato si trasferirà all’acquirente dal momento dell’aggiudicazione. L’acquirente potrà ottenere la consegna dei beni acquistati solamente previa corresponsione ad Arcadia del prezzo e di ogni altra commissione, costo o rimborso inerente.
Adempimenti: notifica, esportazione, specie protette e antiriciclaggio
- Per gli oggetti sottoposti alla notifica da parte dello Stato ai sensi del D.Lgs. 22.01.2004 n. 42 (c.d. Codice dei Beni Culturali) e ss.mm., gli acquirenti sono tenuti all’osservanza di tutte le disposizioni legislative vigenti in materia. L’aggiudicatario, in caso di esercizio del diritto di prelazione da parte dello Stato, non potrà pretendere da Arcadia o dal venditore alcun rimborso di eventuali interessi sul prezzo e sulle commissioni d’asta già corrisposte.
- L’esportazione di oggetti da parte degli acquirenti residenti o non residenti in Italia è regolata della suddetta normativa, nonché dalle leggi doganali, valutarie e tributarie in vigore. Pertanto, l’esportazione di oggetti la cui datazione risale ad oltre cinquant’anni è sempre subordinata alla licenza di libera circolazione rilasciata dalla competente Autorità. Arcadia non assume alcuna responsabilità nei confronti dell’acquirente in ordine ad eventuali restrizioni all’esportazione dei lotti aggiudicati, ne’ in ordine ad eventuali licenze o attestati che lo stesso debba ottenere in base alla legislazione italiana.
- Per ogni lotto contenente materiali appartenenti a specie protette come, ad esempio, corallo, avorio, tartaruga, coccodrillo, ossi di balena, corni di rinoceronte, etc., è necessaria una licenza di esportazione CITES rilasciata dal Ministero dell’Ambiente e della Tutela del Territorio. Si invitano i potenziali acquirenti ad informarsi presso il Paese di destinazione sulle leggi che regolano tali importazioni.
- Il diritto di seguito sarà posto a carico del venditore ai sensi dell’art. 152 della L. 22.04.1941 n. 633, come sostituito dall’art. 10 del D.Lgs. 13.02.2006 n. 118.
- Ai sensi e per gli effetti dell’art. 22 D.Lgs n.231/2007 (Decreto Antiriciclaggio), i clienti si impegnano a fornire tutte le informazioni necessarie ed aggiornate per consentire a Casa d’Aste Arcadia S.r.l. l’adempimento degli obblighi di adeguata verifica della clientela. Resta inteso che il perfezionamento dell’operazione è subordinato al rilascio da parte del cliente delle informazioni richieste da Casa d’Aste Arcadia S.r.l. per l’adempimento dei suddetti obblighi. Ai sensi dell’art. 42 D.Lgs n. 231/07 la Casa d’Aste Arcadia S.r.l. si riserva la facoltà di astenersi e non concludere l’operazione nel caso di impossibilità oggettiva di effettuare l’adeguata verifica della clientela.
TUTELA DEI DATI PERSONALI
- Ai sensi dell’art. 13 D.Lgs. 196/2003 (Codice in materia di protezione dei dati personali), Arcadia, nella sua qualità di titolare del trattamento, informa che i dati forniti verranno utilizzati, con mezzi cartacei ed elettronici, per poter dare piena ed integrale esecuzione ai contratti di compravendita stipulati dalla stessa società, nonchè per il perseguimento di ogni altro servizio inerente l’oggetto sociale di Casa d’Aste Arcadia s.r.l.
- Il conferimento dei dati è facoltativo, ma si rende strettamente necessario per l’esecuzione dei contratti conclusi. La registrazione alle aste consente ad Arcadia di inviare i cataloghi delle aste successive ed altro materiale informativo relativo all’attività della stessa.

FORO
- Le presenti Condizioni di Vendita, regolate dalla legge italiana, sono accettate tacitamente da tutti i soggetti partecipanti alla procedura di vendita all’asta e restano a disposizione di chiunque ne faccia richiesta.
- Per qualsiasi controversia relativa all’attività di vendita all’asta presso Arcadia è stabilita la competenza esclusiva del foro di Roma.

- Qualsiasi comunicazione inerente alla vendita dovrà essere effettuata mediante lettera raccomandata A.R. indirizzata a:

Obligations of Arcadia towards the buyer
Auction House Arcadia s.r.l. (hereinafter "Arcadia") conducts sales by auction at its premises open to the public, as an agent with representation in its own name and on behalf of the seller, pursuant to art. 1704 of the Italian Civil Code. Arcadia therefore does not assume any liability towards buyers or third parties in general other than that arising from its capacity as agent.
Auction sale
In order to improve the auction sale procedures, all those interested in bidding are required to register their personal details, address and copy of an identity document in order to provide themselves with a numbered "paddle" for bidding, prior to the commencement of the auction. At the same time, interested parties accept the Conditions of Sale and give their consent to the processing of the aforementioned personal data.
Arcadia reserves the right to reject bids from unregistered purchasers and, as a result of non-payment or delayed payment by a purchaser, Arcadia may reject any bid made by such purchaser or its representative at subsequent auctions.
Lots are awarded to the highest bidder. The auctioneer conducts the auction and may make the first bids in the interest of the principal.
The sale between the seller and the buyer is sanctioned by the hammer blow of the auctioneer. In the event of a dispute over an adjudication, the lot is put up for auction again at the same session, on the basis of the last bid received. The auctioneer has the right to withdraw from the auction, separate or combine lots, and possibly change the order of sale.
Arcadia accepts bids for the purchase of lots at set prices, upon specific mandate. During the auction, bids may be made via the Internet and by telephone, which are accepted at the sole discretion of Arcadia and forwarded to the auctioneer.
Telephone conversations may be recorded.
Liability of the seller and of Arcadia towards the buyer
The lots offered for sale are to be considered as second-hand or antique goods and therefore do not qualify as "products" according to the definition set forth in art. 3 letter e) of the Consumer Code (Legislative Decree 6.09.2005 no. 206).
The auction shall be preceded by an exhibition of the works, during which Arcadia and its experts shall be at your disposal for any clarification; the exhibition shall be aimed at having you examine the authenticity, attribution, state of preservation, provenance, type and quality of the objects and to clarify any errors or inaccuracies in the catalogue. If it is impossible to view the objects directly, a 'Condition Report' can be requested. The lack of explicit reference to the condition of the lot does not imply that the item is without imperfections. All items are sold as "seen" and therefore, before participating in the auction, potential buyers undertake to examine the lots of interest thoroughly, possibly assisted by an expert of their choice. After adjudication, no objections may be made and neither Arcadia nor the seller may be held liable for any defects in the information concerning the items up for auction.
The lots put up for auction are sold in the state in which they are found at the time of display, with any related defects and imperfections such as breakages, restorations, missing or replacements. Such characteristics, even if not expressly indicated in the catalogue, cannot be considered decisive in any dispute over the sale. Antiques by their very nature may have undergone restoration or undergone modifications of various kinds: interventions of this kind can never be considered hidden defects or counterfeits. Goods of an electrical or mechanical nature are not checked before sale and are purchased by the buyer at his own risk. Watch movements are to be considered as not having been serviced.
The descriptions or illustrations of the lots contained in the catalogues and in any other illustrative material are purely indicative and reflect the opinions of Arcadia and its experts. They may be subject to revision at any time before the lot is offered for sale. Arcadia shall not be held liable for errors and omissions relating to such descriptions, nor in the event of counterfeiting, as no warranty is given on the lots at auction. Furthermore, the illustrations of the objects presented in the catalogues, on the screens or other illustrative material are solely for the purpose of identifying the lot and may not be considered accurate representations of the state of conservation of the object.
The appraisal values indicated in the catalogue are expressed in euros and are merely an indication. These values may be equal to, higher or lower than the reserve prices of the lots agreed upon with the principals.
Payment and collection; transfer of liability
A purchase commission (auction fee) in the amount of 25.00 % of the allotment price of the lot up to the amount of euro 400,000.00 shall be added to the allotment price. For any part of the adjudication price exceeding the amount of euro 400,000.00 the purchase commission is set at 21.00%. The above percentages are to be understood as VAT included, pursuant to the laws in force. Any further charges or taxes relating to the purchase shall in any case be borne by the successful bidder.
The purchaser shall make a down payment upon adjudication and complete payment before collecting the goods at his own care, risk and expense no later than fifteen days from the end of the sale. In the event of non-payment, in whole or in part, of the total amount owed by the successful bidder within this term, Arcadia shall be entitled, at its own discretion, to: a) return the goods to the buyer, demanding as a penalty from the unsuccessful buyer the payment of the lost sales commissions; b) take legal action to obtain the compulsory execution of the purchase obligation; c) sell the lot by private treaty or in subsequent auctions on behalf of and at the expense of the successful bidder, pursuant to art. 1515 of the Italian Civil Code, without prejudice to the right to compensation for damages for any loss suffered by the buyer as a result of the sale; d) sell the lot by private treaty or in subsequent auctions on behalf of the successful bidder, pursuant to art. 1515 of the Italian Civil Code, without prejudice to the right to compensation for damages for any loss suffered by the latter as a result of the sale, without prejudice in any case to the right to compensation for damages.
After the expiration of the above time limit, Arcadia shall in any case be exempt from any liability to the successful bidder in relation to any deterioration or deterioration of the items, and shall be entitled to be paid for each individual lot the custody fees as well as any reimbursement of expenses for transport to the warehouse. Any risk for loss or damage to the adjudicated goods shall be transferred to the purchaser from the moment of adjudication. The buyer shall be entitled to take delivery of the purchased goods only upon payment to Arcadia of the price and any other inherent fees, costs or reimbursements.
Requirements: notification, export, protected species and anti-money laundering
For items subject to notification by the State pursuant to Legislative Decree no. 42 of 22.01.2004 (the so-called Code of Cultural Assets) as amended and supplemented, purchasers shall comply with all applicable provisions of law. In the event of the State exercising its right of pre-emption, the successful bidder shall not be entitled to claim from Arcadia or the seller any reimbursement of any interest on the price and on the auction fees already paid.
The exportation of objects by purchasers resident or non-resident in Italy is regulated by the aforementioned regulations, as well as by the customs, currency and tax laws in force. Therefore, the exportation of objects dating back more than fifty years is always subject to a free circulation licence issued by the competent Authority. Arcadia accepts no liability towards the purchaser in respect of any restrictions on the export of the lots awarded, nor in respect of any licences or certificates to be obtained by the same under Italian law.
For each lot containing materials belonging to protected species such as, for example, coral, ivory, turtle, crocodile, whalebone, rhinoceros horn, etc., a CITES export licence issued by the Ministry for the Environment and Territory Protection is required. Potential buyers are urged to inquire at the country of destination about the laws governing such imports.
The following right shall be charged to the seller pursuant to art. 152 of L. 22.04.1941 no. 633, as replaced by art. 10 of L.D. 13.02.2006 no. 118.
Pursuant to Art. 22 of Legislative Decree n.231/2007 (Anti-Money Laundering Decree), customers undertake to provide all necessary and updated information to allow Casa d'Aste Arcadia S.r.l. to fulfill its obligations of customer due diligence. It is understood that the finalization of the transaction is subject to the release by the customer of the information requested by Casa d'Aste Arcadia S.r.l. for the fulfillment of the above obligations. Pursuant to Art. 42 D.Lgs n. 231/07, Casa d'Aste Arcadia S.r.l. reserves the right to abstain and not to conclude the transaction in case of objective impossibility to perform the customer due diligence.
PROTECTION OF PERSONAL DATA
Pursuant to art. 13 Legislative Decree 196/2003 (Personal Data Protection Code), Arcadia, in its capacity as data controller, informs you that the data provided will be used, by paper and electronic means, to fully and completely execute the sale and purchase contracts entered into by the same company, as well as for the pursuit of any other service inherent to the corporate purpose of Casa d'Aste Arcadia s.r.l.
The provision of data is optional, but is strictly necessary for the execution of the contracts concluded. Registration for auctions allows Arcadia to send catalogues of upcoming auctions and other information material relating to its activity.

FORUM
These Conditions of Sale, governed by Italian law, are tacitly accepted by all parties participating in the auction procedure and remain available to anyone who requests them.
The Court of Rome shall have exclusive jurisdiction over any and all disputes arising in connection with Arcadia's auctions.

Dopo l’aggiudicazione non sono ammesse contestazioni e né Arcadia, né il venditore potranno essere ritenuti responsabili per i vizi relativi alle informazioni concernenti gli oggetti in asta.
- I lotti posti in asta sono venduti nello stato in cui si trovano al momento dell’esposizione, con ogni relativo difetto ed imperfezione quali rotture, restauri, mancanze o sostituzioni. Tali caratteristiche, anche se non espressamente indicate sul catalogo, non possono essere considerate determinanti per contestazioni sulla vendita. I beni d’antiquariato per loro stessa natura possono essere stati oggetto di restauri o sottoposti a modifiche di varia natura: interventi di tale tipo non possono mai esser considerati vizi occulti o contraffazione. I beni di natura elettrica o meccanica non sono verificati prima della vendita e sono acquistati dall’acquirente a suo rischio e pericolo. I movimenti degli orologi sono da considerarsi non revisionati.
- Le descrizioni o illustrazioni dei lotti contenute nei cataloghi ed in qualsiasi altro materiale illustrativo hanno carattere meramente indicativo e riflettono opinioni di Arcadia e dei propri esperti. Possono essere oggetto di revisione in qualsiasi momento prima che il lotto sia posto in vendita. Arcadia non potrà essere ritenuta responsabile di errori ed omissioni relative a tali descrizioni, ne’ in ipotesi di contraffazione, in quanto non è fornita alcuna garanzia sui lotti in asta. Inoltre, le illustrazioni degli oggetti presentati sui cataloghi, sugli schermi o altro materiale illustrativo hanno esclusivamente la finalità di identificare il lotto e non possono essere considerate rappresentazioni precise dello stato di conservazione dell’oggetto.
- I valori di stima indicati nel catalogo sono espressi in euro e costituiscono una mera indicazione. Tali valori possono essere uguali, superiori o inferiori ai prezzi di riserva dei lotti concordati con i mandanti.
Pagamento e ritiro; trasferimento di responsabilità
- Al prezzo di aggiudicazione è da aggiungere la commissione d'acquisto (diritti di asta) nella misura del 25,00 % del prezzo di aggiudicazione del lotto fino all’importo pari a euro 400.000,00. Per ogni parte del prezzo di aggiudicazione eccedente l’importo di euro 400.000,00 la commissione d'acquisto è stabilita nella misura del 21,00%. Le percentuali sopra indicate sono da intendersi IVA inclusa, ai sensi delle normative vigenti. Qualunque ulteriore onere o tributo relativo all'acquisto sarà comunque a carico dell’aggiudicatario.
- L’acquirente dovrà versare un acconto all’atto dell’aggiudicazione e completare il pagamento prima di ritirare la merce a sua cura, rischio e spesa non oltre quindici giorni dalla fine della vendita. In caso di mancato pagamento, in tutto o in parte, dell’ammontare totale dovuto dall’aggiudicatario entro tale termine, Arcadia avrà diritto, a propria discrezione, di: a) restituire il bene al mandante, esigendo a titolo di penale da parte del mancato acquirente il pagamento delle commissioni di vend ita perdute; b) agire in via giudiziale per ottenere l’esecuzione coattiva dell’obbligo d’acquisto; c) vendere il lotto tramite trattativa privata o in aste successive per conto ed a spese dell’aggiudicatario, ai sensi dell’art. 1515 cod.civ., salvo in ogni caso il diritto al risarcimento dei danni.
- Decorso il termine di cui sopra, Arcadia sarà comunque esonerata da ogni responsabilità nei confronti dell’aggiudicatario in relazione all’eventuale deterioramento o deperimento degli oggetti ed avrà diritto di farsi pagare per ogni singolo lotto i diritti di custodia oltre a eventuali rimborsi di spese per trasporto al magazzino. Qualunque rischio per perdita o danni al bene aggiudicato si trasferirà all’acquirente dal momento dell’aggiudicazione. L’acquirente potrà ottenere la consegna dei beni acquistati solamente previa corresponsione ad Arcadia del prezzo e di ogni altra commissione, costo o rimborso inerente.
Adempimenti: notifica, esportazione, specie protette e antiriciclaggio
- Per gli oggetti sottoposti alla notifica da parte dello Stato ai sensi del D.Lgs. 22.01.2004 n. 42 (c.d. Codice dei Beni Culturali) e ss.mm., gli acquirenti sono tenuti all’osservanza di tutte le disposizioni legislative vigenti in materia. L’aggiudicatario, in caso di esercizio del diritto di prelazione da parte dello Stato, non potrà pretendere da Arcadia o dal venditore alcun rimborso di eventuali interessi sul prezzo e sulle commissioni d’asta già corrisposte.
- L’esportazione di oggetti da parte degli acquirenti residenti o non residenti in Italia è regolata della suddetta normativa, nonché dalle leggi doganali, valutarie e tributarie in vigore. Pertanto, l’esportazione di oggetti la cui datazione risale ad oltre cinquant’anni è sempre subordinata alla licenza di libera circolazione rilasciata dalla competente Autorità. Arcadia non assume alcuna responsabilità nei confronti dell’acquirente in ordine ad eventuali restrizioni all’esportazione dei lotti aggiudicati, ne’ in ordine ad eventuali licenze o attestati che lo stesso debba ottenere in base alla legislazione italiana.
- Per ogni lotto contenente materiali appartenenti a specie protette come, ad esempio, corallo, avorio, tartaruga, coccodrillo, ossi di balena, corni di rinoceronte, etc., è necessaria una licenza di esportazione CITES rilasciata dal Ministero dell’Ambiente e della Tutela del Territorio. Si invitano i potenziali acquirenti ad informarsi presso il Paese di destinazione sulle leggi che regolano tali importazioni.
- Il diritto di seguito sarà posto a carico del venditore ai sensi dell’art. 152 della L. 22.04.1941 n. 633, come sostituito dall’art. 10 del D.Lgs. 13.02.2006 n. 118.
- Ai sensi e per gli effetti dell’art. 22 D.Lgs n.231/2007 (Decreto Antiriciclaggio), i clienti si impegnano a fornire tutte le informazioni necessarie ed aggiornate per consentire a Casa d’Aste Arcadia S.r.l. l’adempimento degli obblighi di adeguata verifica della clientela. Resta inteso che il perfezionamento dell’operazione è subordinato al rilascio da parte del cliente delle informazioni richieste da Casa d’Aste Arcadia S.r.l. per l’adempimento dei suddetti obblighi. Ai sensi dell’art. 42 D.Lgs n. 231/07 la Casa d’Aste Arcadia S.r.l. si riserva la facoltà di astenersi e non concludere l’operazione nel caso di impossibilità oggettiva di effettuare l’adeguata verifica della clientela.
TUTELA DEI DATI PERSONALI
- Ai sensi dell’art. 13 D.Lgs. 196/2003 (Codice in materia di protezione dei dati personali), Arcadia, nella sua qualità di titolare del trattamento, informa che i dati forniti verranno utilizzati, con mezzi cartacei ed elettronici, per poter dare piena ed integrale esecuzione ai contratti di compravendita stipulati dalla stessa società, nonchè per il perseguimento di ogni altro servizio inerente l’oggetto sociale di Casa d’Aste Arcadia s.r.l.
- Il conferimento dei dati è facoltativo, ma si rende strettamente necessario per l’esecuzione dei contratti conclusi. La registrazione alle aste consente ad Arcadia di inviare i cataloghi delle aste successive ed altro materiale informativo relativo all’attività della stessa.

FORO
- Le presenti Condizioni di Vendita, regolate dalla legge italiana, sono accettate tacitamente da tutti i soggetti partecipanti alla procedura di vendita all’asta e restano a disposizione di chiunque ne faccia richiesta.
- Per qualsiasi controversia relativa all’attività di vendita all’asta presso Arcadia è stabilita la competenza esclusiva del foro di Roma.

Obligations of Arcadia towards the buyer
Auction House Arcadia s.r.l. (hereinafter "Arcadia") conducts sales by auction at its premises open to the public, as an agent with representation in its own name and on behalf of the seller, pursuant to art. 1704 of the Italian Civil Code. Arcadia therefore does not assume any liability towards buyers or third parties in general other than that arising from its capacity as agent.
Auction sale
In order to improve the auction sale procedures, all those interested in bidding are required to register their personal details, address and copy of an identity document in order to provide themselves with a numbered "paddle" for bidding, prior to the commencement of the auction. At the same time, interested parties accept the Conditions of Sale and give their consent to the processing of the aforementioned personal data.
Arcadia reserves the right to reject bids from unregistered purchasers and, as a result of non-payment or delayed payment by a purchaser, Arcadia may reject any bid made by such purchaser or its representative at subsequent auctions.
Lots are awarded to the highest bidder. The auctioneer conducts the auction and may make the first bids in the interest of the principal.
The sale between the seller and the buyer is sanctioned by the hammer blow of the auctioneer. In the event of a dispute over an adjudication, the lot is put up for auction again at the same session, on the basis of the last bid received. The auctioneer has the right to withdraw from the auction, separate or combine lots, and possibly change the order of sale.
Arcadia accepts bids for the purchase of lots at set prices, upon specific mandate. During the auction, bids may be made via the Internet and by telephone, which are accepted at the sole discretion of Arcadia and forwarded to the auctioneer.
Telephone conversations may be recorded.
Liability of the seller and of Arcadia towards the buyer
The lots offered for sale are to be considered as second-hand or antique goods and therefore do not qualify as "products" according to the definition set forth in art. 3 letter e) of the Consumer Code (Legislative Decree 6.09.2005 no. 206).
The auction shall be preceded by an exhibition of the works, during which Arcadia and its experts shall be at your disposal for any clarification; the exhibition shall be aimed at having you examine the authenticity, attribution, state of preservation, provenance, type and quality of the objects and to clarify any errors or inaccuracies in the catalogue. If it is impossible to view the objects directly, a 'Condition Report' can be requested. The lack of explicit reference to the condition of the lot does not imply that the item is without imperfections. All items are sold as "seen" and therefore, before participating in the auction, potential buyers undertake to examine the lots of interest thoroughly, possibly assisted by an expert of their choice. After adjudication, no objections may be made and neither Arcadia nor the seller may be held liable for any defects in the information concerning the items up for auction.
The lots put up for auction are sold in the state in which they are found at the time of display, with any related defects and imperfections such as breakages, restorations, missing or replacements. Such characteristics, even if not expressly indicated in the catalogue, cannot be considered decisive in any dispute over the sale. Antiques by their very nature may have undergone restoration or undergone modifications of various kinds: interventions of this kind can never be considered hidden defects or counterfeits. Goods of an electrical or mechanical nature are not checked before sale and are purchased by the buyer at his own risk. Watch movements are to be considered as not having been serviced.
The descriptions or illustrations of the lots contained in the catalogues and in any other illustrative material are purely indicative and reflect the opinions of Arcadia and its experts. They may be subject to revision at any time before the lot is offered for sale. Arcadia shall not be held liable for errors and omissions relating to such descriptions, nor in the event of counterfeiting, as no warranty is given on the lots at auction. Furthermore, the illustrations of the objects presented in the catalogues, on the screens or other illustrative material are solely for the purpose of identifying the lot and may not be considered accurate representations of the state of conservation of the object.
The appraisal values indicated in the catalogue are expressed in euros and are merely an indication. These values may be equal to, higher or lower than the reserve prices of the lots agreed upon with the principals.
Payment and collection; transfer of liability
A purchase commission (auction fee) in the amount of 25.00 % of the allotment price of the lot up to the amount of euro 400,000.00 shall be added to the allotment price. For any part of the adjudication price exceeding the amount of euro 400,000.00 the purchase commission is set at 21.00%. The above percentages are to be understood as VAT included, pursuant to the laws in force. Any further charges or taxes relating to the purchase shall in any case be borne by the successful bidder.
The purchaser shall make a down payment upon adjudication and complete payment before collecting the goods at his own care, risk and expense no later than fifteen days from the end of the sale. In the event of non-payment, in whole or in part, of the total amount owed by the successful bidder within this term, Arcadia shall be entitled, at its own discretion, to: a) return the goods to the buyer, demanding as a penalty from the unsuccessful buyer the payment of the lost sales commissions; b) take legal action to obtain the compulsory execution of the purchase obligation; c) sell the lot by private treaty or in subsequent auctions on behalf of and at the expense of the successful bidder, pursuant to art. 1515 of the Italian Civil Code, without prejudice to the right to compensation for damages for any loss suffered by the buyer as a result of the sale; d) sell the lot by private treaty or in subsequent auctions on behalf of the successful bidder, pursuant to art. 1515 of the Italian Civil Code, without prejudice to the right to compensation for damages for any loss suffered by the latter as a result of the sale, without prejudice in any case to the right to compensation for damages.
After the expiration of the above time limit, Arcadia shall in any case be exempt from any liability to the successful bidder in relation to any deterioration or deterioration of the items, and shall be entitled to be paid for each individual lot the custody fees as well as any reimbursement of expenses for transport to the warehouse. Any risk for loss or damage to the adjudicated goods shall be transferred to the purchaser from the moment of adjudication. The buyer shall be entitled to take delivery of the purchased goods only upon payment to Arcadia of the price and any other inherent fees, costs or reimbursements.
Requirements: notification, export, protected species and anti-money laundering
For items subject to notification by the State pursuant to Legislative Decree no. 42 of 22.01.2004 (the so-called Code of Cultural Assets) as amended and supplemented, purchasers shall comply with all applicable provisions of law. In the event of the State exercising its right of pre-emption, the successful bidder shall not be entitled to claim from Arcadia or the seller any reimbursement of any interest on the price and on the auction fees already paid.
The exportation of objects by purchasers resident or non-resident in Italy is regulated by the aforementioned regulations, as well as by the customs, currency and tax laws in force. Therefore, the exportation of objects dating back more than fifty years is always subject to a free circulation licence issued by the competent Authority. Arcadia accepts no liability towards the purchaser in respect of any restrictions on the export of the lots awarded, nor in respect of any licences or certificates to be obtained by the same under Italian law.
For each lot containing materials belonging to protected species such as, for example, coral, ivory, turtle, crocodile, whalebone, rhinoceros horn, etc., a CITES export licence issued by the Ministry for the Environment and Territory Protection is required. Potential buyers are urged to inquire at the country of destination about the laws governing such imports.
The following right shall be charged to the seller pursuant to art. 152 of L. 22.04.1941 no. 633, as replaced by art. 10 of L.D. 13.02.2006 no. 118.
Pursuant to Art. 22 of Legislative Decree n.231/2007 (Anti-Money Laundering Decree), customers undertake to provide all necessary and updated information to allow Casa d'Aste Arcadia S.r.l. to fulfill its obligations of customer due diligence. It is understood that the finalization of the transaction is subject to the release by the customer of the information requested by Casa d'Aste Arcadia S.r.l. for the fulfillment of the above obligations. Pursuant to Art. 42 D.Lgs n. 231/07, Casa d'Aste Arcadia S.r.l. reserves the right to abstain and not to conclude the transaction in case of objective impossibility to perform the customer due diligence.
PROTECTION OF PERSONAL DATA
Pursuant to art. 13 Legislative Decree 196/2003 (Personal Data Protection Code), Arcadia, in its capacity as data controller, informs you that the data provided will be used, by paper and electronic means, to fully and completely execute the sale and purchase contracts entered into by the same company, as well as for the pursuit of any other service inherent to the corporate purpose of Casa d'Aste Arcadia s.r.l.
The provision of data is optional, but is strictly necessary for the execution of the contracts concluded. Registration for auctions allows Arcadia to send catalogues of upcoming auctions and other information material relating to its activity.

FORUM
These Conditions of Sale, governed by Italian law, are tacitly accepted by all parties participating in the auction procedure and remain available to anyone who requests them.
The Court of Rome shall have exclusive jurisdiction over any and all disputes arising in connection with Arcadia's auctions.
