Versteigerungsbedingungen in der Fassung vom 04.01.2023
Mit der Teilnahme an der Versteigerung, gleich ob im Wege persönlicher, telefonischer, schriftlicher, fernschriftlicher oder elektronischer Teilnahme, werden folgende Bedingungen anerkannt; die Bedingungen gelten für alle Auktionen und die zugehörigen verbundenen Geschäfte, den Verkauf sowie die Einlieferung. Gegenüber den Einlieferungsbedingungen haben diese Vorschriften Vorrang, soweit sie den gleichen Sachverhalt regeln; im Übrigen ergänzen die Versteigerungsbedingungen die Einlieferungsbedingungen:
Katalog und Beschaffenheit
1. Das Auktionshaus Kloss, Dietzgenstr. 51-53, 13156 Berlin versteigert in öffentlicher Versteigerung gemäß § 383 Abs. 3 S. 1 BGB im Namen und für Rechnung der Einlieferer (Agent). Die Versteigerung erfolgt freiwillig. Jeder Auftraggeber erhält eine Nummer, so dass aus dem Einlieferungsverzeichnis zu erkennen ist, welche Gegenstände von welchem Auftraggeber eingeliefert wurden.
2. Sämtliche zur Versteigerung gelangenden Gegenstände sind ausnahmslos gebraucht und haben einen ihrem Alter und ihrer Herkunft entsprechenden Erhaltungszustand. Sie können im Rahmen der Vorbesichtigung geprüft und besichtigt werden. Die Angaben im Katalog und in anderen Präsentationsformen (z.B. Internet), die in der Regel auf Angaben der Einbringer beruhen, werden nach bestem Wissen und Gewissen erstellt. Sie sind keine zugesicherten Eigenschaften im Sinne der §§ 459 ff. BGB, sondern grundsätzlich als Meinungsäußerung und nicht als Tatsachenbehauptung anzusehen. Auskünfte jedweder Art, sei es mündlich oder schriftlich, bringen lediglich eine subjektive Einschätzung des Auktionshauses zum Ausdruck und sind keine abweichende Individualabrede, Garantie- oder Beschaffenheitsvereinbarung. Werden zusätzlich zu dem Katalog noch andere Präsentationsformen genutzt, sind dennoch nur die im Katalog enthaltenen textlichen Angaben, nicht hingegen Abbildungen, maßgeblich. Es bleibt vorbehalten, Katalogangaben in der Auktion zu berichtigen. Der Erhaltungszustand wird im Katalog nicht durchgängig erwähnt, so dass fehlende Angaben ebenfalls keine Beschaffenheitsvereinbarung begründen. Beschädigungen finden im Katalog nur Erwähnung, wenn sie nach Einschätzung des Versteigerers den optischen Gesamteindruck des Versteigerungsobjekts deutlich beeinträchtigen. Insoweit ergibt sich aus fehlenden Hinweisen auf Reparaturen, Restaurierungen, Ergänzungen oder sonstigen Maßnahmen am
Versteigerungsobjekt nicht, dass sich die Sache in einem perfekten Zustand befindet. Gegenstände von geringem Wert können als Konvolute außerhalb des Katalogs versteigert werden.
Haftung und Verjährung
3. Eine Haftung des Versteigerers wegen etwaiger offener oder versteckter Mängel, wegen Verlust oder Beschädigung des versteigerten Objekts wird ausdrücklich ausgeschlossen, sofern eine gesetzliche Haftung nicht zwingend vorgeschrieben ist. Schadensersatzansprüche gegen den Versteigerer wegen Rechts- und Sachmängeln sowie aus sonstigen Rechtsgründen, inklusive Ersatz vergeblicher Aufwendungen sowie Ersatz von Gutachterkosten, sind ausgeschlossen, soweit sie nicht auf vorsätzlichen oder grob fahrlässigen Handeln des Versteigerers beruhen oder ihre Ursache in der Verletzung von Leben, Körper oder Gesundheit haben. Die Haftung für einfache Fahrlässigkeit ist betragsmäßig begrenzt auf die Höhe des jeweiligen Zuschlags. Für einfach fahrlässiges Verhalten des Versteigerers und der Personen, für die er einzutreten hat, besteht nur dann eine Haftung, wenn dieses die Verletzung von wesentlichen Vertragspflichten betrifft.
4. Gegenstände, die dem Versteigerer gehören, werden im Katalog und Versteigerungsverzeichnis gesondert aufgeführt und als solche gekennzeichnet.
5. Der Versteigerer erklärt sich bereit, unverzüglich vorgenommene begründete Rügen des Käufers an den Einlieferer der bemängelten Sache weiterzuleiten.
6. Alle Ansprüche gegen das Auktionshaus wegen gebrauchter Sachen verjähren 1 Jahr nach Übergabe des zugeschlagenen Objektes, soweit sie nicht auf einer vorsätzlichen Rechtsverletzung beruhen oder gesetzlich zwingend längere Verjährungsfristen vorgeschrieben sind. Soweit der Erwerber Kaufmann, Gewerbetreibender oder Freiberufler ist, verjähren die Gewährleistungsansprüche in 6 Monaten nach dem Tag des Zuschlages. Ausgenommen von der verkürzten Verjährung sind Ansprüche, die ihre Ursache in der Verletzung von Leben, Körper oder Gesundheit haben.
Ablauf der Versteigerung
7. Maßgeblich ist bei Geboten jeder Art ist die im Gebot genannte Katalognummer. Der Versteigerer hat das Recht, Nummern zu trennen oder zu vereinen, außerhalb der Reihe anzubieten oder zurückzuziehen.
8. Ebenso kann er Gebote ohne Begründung ablehnen; dies gilt insbesondere dann, wenn ein Bieter, der dem Versteigerer nicht bekannt ist, mit ihm eine
Geschäftsverbindung noch nicht besteht, oder der Bieter nicht spätestens bis zum Ende der Versteigerung Sicherheit leistet. Ein Anspruch auf Annahme eines Gebotes besteht auch im Falle der Sicherheitsleistung nicht. Wird ein Gebot abgelehnt, bleibt das unmittelbar vorher abgegebene Gebot verbindlich. Geben mehrere Personen das gleiche Gebot ab, so erhält das zuerst abgegebene Gebot den Zuschlag. Besteht Uneinigkeit über einen Zuschlag, so kann der Versteigerer nach freiem Ermessen den Zuschlag sofort zu Gunsten eines bestimmten Bieters wiederholen oder den Gegenstand nochmals aufrufen. Ein Anspruch auf Zuschlagserteilung besteht nicht. Ein Gebot erlischt außer im Falle seiner Ablehnung durch den Versteigerer dann, wenn die Versteigerung ohne Erteilung des Zuschlags geschlossen wird oder wenn der Versteigerer den Gegenstand erneut aufruft; ein Gebot erlischt nicht durch ein nachfolgendes unwirksames Übergebot.
9. Alle Gebote gelten als vom Bieter im eigenen Namen und für eigene Rechnung abgegeben. Will ein Bieter Gebote im Namen eines Dritten abgeben, muss er dies vor Versteigerungsbeginn unter Nennung von Namen und Anschrift des vertretenen und einer schriftlichen Vollmacht mitteilen, ansonsten wird er selbst verpflichtet.
10. Der Aufruf beginnt in der Regel zu dem im Katalog angegebenen Preis. Im Katalog angegebene Schätzpreise sind keine Mindest- oder Höchstpreise, sondern dienen nur als Anhaltspunkt für den Verkehrswert der Gegenstände ohne Gewähr für die Richtigkeit. Ist im Katalog kein Preis angegeben, beginnt der Aufruf mit dem vom Versteigerer geschätzten Richtpreis, es sei denn, dass bereits höhere schriftliche Gebote vorliegen oder dass der Versteigerer mit dem Einlieferer einen Mindestzuschlagpreis von mehr als 50 % des Schätzpreises vereinbart hat. Die Steigerungsstufen liegen im Ermessen des Versteigerers, im Allgemeinen um 10 % des vorangegangenen Gebots.
11. Gebote können persönlich im Auktionssaal sowie bei Abwesenheit schriftlich, telefonisch oder, soweit das Auktionshaus Kloss eine zugelassene Plattform im Internet angegeben hat, online abgegeben werden. Schriftliche Gebote müssen spätestens am Tag vor der Versteigerung eingegangen seien und den Gegenstand unter Aufführung der Katalognummer, des gebotenen Preises, der sich als Zuschlagspreis ohne Aufgeld und Mehrwertsteuer versteht, benennen. Bei schriftlichen Geboten beauftragt der Bieter den Versteigerer, für ihn Gebote abzugeben. Unklarheiten oder Ungenauigkeiten gehen zu Lasten des Bieters. Der Versteigerer ist nicht verpflichtet, den schriftlichen Bieter von der Nichtberücksichtigung seines Gebotes in Kenntnis zu setzen. Jedes schriftliche Gebot wird vom Versteigerer nur mit dem Betrag in Anspruch genommen, der erforderlich ist, um andere Gebote zu überbieten.
Bei telefonischen Geboten wird ein im Auktionssaal anwesender Telefonist beauftragt, nach Anweisung des zuvor identifizierten Bieters Angebote abzugeben. Die telefonischen Angebote sind bindend und stehen im Saal abgegebenen Geboten gleich. In dem telefonisch abgegebenen Gebot sind das Aufgeld, die gesetzliche Mehrwertsteuer oder andere Kosten nicht enthalten. Telefonische Gebote können vom Auktionshaus Kloss aufgezeichnet werden. Mit dem Antrag zum telefonischen Bieten erklärt sich der Antragsteller mit den Versteigerungsbedingungen und der Aufzeichnung von Telefongesprächen einverstanden. Das Auktionshaus haftet nicht für das Zustandekommen und die Aufrechterhaltung von Telekommunikationsverbindungen oder für Übermittlungsfehler.
12. Internet-Gebote können sowohl als Vorgebote vor Beginn einer Versteigerung als auch als Live-Gebote während einer im Internet live übertragenen Versteigerung nach Maßgabe der vorliegenden Versteigerungsbedingungen abgegeben werden. Gebote die während einer laufenden Versteigerung via Internet eingehen, werden nur dann berücksichtigt, wenn es sich um eine Live im Internet übertragene Versteigerung handelt. Im Übrigen sind Internet-Gebote nur dann zulässig, wenn der Bieter vom Auktionshaus Kloss zum Bieten über das Internet durch Zusendung eines Nutzernamens und eines Passwortes zugelassen worden ist und die Gebote auch zweifelsfrei zugeordnet werden können. Die über das Internet übertragenen Gebote werden elektronisch protokolliert. Live-Gebote werden wie Gebote aus dem Auktionssaal behandelt.
13. Das Widerrufs- und Rückgaberecht nach Maßgabe des Rechts für Fernabsatzverträge findet auf Schrift-, Telefon- und Internetgebote keine Anwendung.
14. Der Zuschlag erfolgt nach dreimaligem Aufruf an den Meistbietenden. Wird das zuvor gesetzte Limit nicht erreicht, sondern unter Vorbehalt zugeschlagen, so bleibt der Bieter für vier Wochen an sein Gebot gebunden. Wird ein Vorbehalt durch den Einlieferer nicht genehmigt oder bietet jemand das Limit, kann das in der Katalognummer bezeichnete Versteigerungsobjekt ohne Rückfrage bei dem Bieter des Vorbehalts an einen höheren Bieter abgegeben werden. Es ist Sache des Bieters, sich über die Genehmigung seines Gebots zu informieren. Ein Zuschlag unter Vorbehalt ist auch möglich, wenn rechtliche oder tatsächliche Zweifel bei einem Objekt während der Auktion angemeldet werden. Wenn trotz abgegebenen Gebots kein Zuschlag erteilt wird, haftet der Versteigerer dem Bieter nur bei Vorsatz oder grober Fahrlässigkeit. Hat der Versteigerer ein höheres Gebot übersehen oder bestehende Zweifel über den Zuschlag, kann er bis zum Abschluss der Auktion nach seiner Wahl den Zuschlag zu Gunsten eines bestimmten Gebietes wiederholen oder den Gegenstand erneut aus bieten; in diesen Fällen wird ein vorangegangener Zuschlag unwirksam.
15. Der Nachverkauf ist Teil der Versteigerung. Bei Nachgeboten kommt ein Vertrag erst zustande, wenn das Auktionshaus das Angebot annimmt. Im Übrigen gelten die Versteigerungsbedingungen auch für den freihändigen Verkauf.
Pflichten des Käufers, Risikoübergang
16. Der Zuschlag verpflichtet den persönlich anwesenden Bieter zur unverzüglichen Abnahme und sofortigen Bezahlung des Versteigerungsobjektes. Neben der Zuschlagssumme ist vom Käufer ein Aufgeld von 28,0 % zuzüglich der gesetzlichen Mehrwertsteuer von derzeit 19 % auf das Aufgeld (insgesamt also 33,32 %) zu zahlen. Auf den Nettorechnungspreis (Zuschlag und Aufgeld) wird die gesetzliche Umsatzsteuer von 7 % für Bilder, Originalgrafik, Plastik und Sammlungsstücke und für Kunstgewerbe und Photographie hinzugerechnet. Von der MwSt. befreit sind Ausfuhrlieferungen in Drittländer und – bei Angabe der USt-Id.-Nr. an Unternehmen in andere Mitgliedsstaaten.
17. Abwesende Erwerber sind verpflichtet, die Gegenstände unverzüglich nach Mitteilung des Zuschlages beim Auktionshaus gegen Barzahlung von Zuschlagssumme und Aufgeld inklusive der darauf entfallenden MwSt. abzuholen. Einer besonderen Aufforderung zur Abholung bedarf es nicht. Das Eigentum an den ersteigerten Gegenständen bleibt bis zur Erfüllung aller im Zeitpunkt des Zuschlages vom Erwerber geschuldeten Forderungen des Versteigerers vorbehalten. Mit der Erteilung des Zuschlags gehen alle Risiken, insbesondere die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung auf den Bieter über, auch wenn der Erwerber die Gegenstände nicht sofort im Auktionshaus abgeholt hat. Das Auktionshaus trägt in keinem Fall eine Haftung für Verlust oder Beschädigung nicht abgeholter oder mangels Bezahlung nicht übergebener Gegenstände, es sei denn, es läge Vorsatz oder grobe Fahrlässigkeit vor. Nicht abgeholte Gegenstände kann das Auktionshaus auf Kosten und Gefahr des Erwerbers bei einem Lagerhalter zur Aufbewahrung geben; der Erwerber wird über die Aufbewahrung unterrichtet.
18. Zahlungen sind bar in Euro oder per EC-Karte an den Versteigerer zu leisten. Ab einem Rechnungsbetrag in Höhe von 500€ ist eine Zahlung vor Ort mit Kreditkarte zuzüglich 3 % plus gesetzlicher Mehrwertsteuer möglich. Statt Barzahlung kann auch Zahlung durch bankbestätigten Scheck erfolgen; Schecks werden nur erfüllungshalber angenommen. Die durch Überweisung oder Scheckeinlösungen anfallenden Kosten, Gebühren und Steuern gehen zu Lasten des Erwerbers. Bei Geboten in Abwesenheit gilt unbeschadet der sofortigen Fälligkeit die Zahlung binnen 7 Tagen nach Rechnungsdatum noch nicht als verspätet; danach tritt Zahlungsverzug ein. Der Versteigerer ist berechtigt, für jede Mahnung Mahngebühren in Höhe von 10 € zu verlangen, wobei dem Käufer
der Nachweis zusteht, das dem Versteigerer kein oder ein geringerer Schaden entstanden ist.
19. Bei Zahlungsverzug werden Verzugszinsen in Höhe von 1 Prozent pro Monat in Rechnung gestellt. Der Erwerber hat das Recht zum Nachweis eines geringeren oder keines Schadens beim Versteigerer. Des Weiteren kann das Auktionshaus bei Zahlungsverzug wahlweise Erfüllung des Kaufvertrages verlangen oder nach angemessener Fristsetzung vom Vertrag zurückzutreten. Im Falle des Rücktritts erlöschen alle Rechte des Bieters am Versteigerungsobjekt. Das Auktionshaus ist berechtigt, Schadenersatz in Höhe des entgangenen Aufgeldes zu verlangen. Wird der Gegenstand in einer neuen Auktion versteigert, so haftet der säumige Erwerber außerdem für jeglichen Mindererlös gegenüber der früheren Versteigerung sowie für die Kosten der wiederholten Versteigerung; auf einen etwaigen Mehrerlös hat er keinen Anspruch. Das Auktionshaus hat das Recht, säumige Erwerber von weiteren Geboten in Auktionen auszuschließen.
20. Kaufgelder und Kaufgeldrückstände sowie Nebenleistungen kann der Versteigerer im Namen des Einlieferers einziehen und einklagen.
21. Gegenüber dem Versteigerer kann der Erwerber nur mit unbestrittenen oder rechtskräftig festgestellten Forderungen aufrechnen. Zurückbehaltungsrechte des Erwerbers sind ausgeschlossen, soweit sie nicht auf demselben Vertragsverhältnis beruhen.
Schlussbestimmungen
22.
Der Bieter ist damit einverstanden, dass sein Name, seine Adresse und die Käufe für Zwecke der Durchführung und Abwicklung der Versteigerung, sowie zum Zwecke der Benachrichtigung über zukünftige Auktionen und Angebote, elektronisch vom Auktionshaus gespeichert und verarbeitet werden.
23.
Diese Versteigerungsbedingungen regeln sämtliche Beziehungen zwischen dem Käufer und dem Auktionshaus Kloss. Allgemeine Geschäftsbedingungen des Käufers haben keine Geltung. Mündlichen Nebenabreden bestehen nicht. Änderung in den Versteigerungsbedingungen bedürfen zu Ihrer Gültigkeit der Schriftform.
24.
Erfüllungsort und Gerichtsstand für den vollkaufmännischen Verkehr ist ausschließlich Berlin. Es gilt deutsches Recht; die Vorschriften des Internationalen Kaufrechts finden keine Anwendung.
25.
Solange das Auktionshaus, Auktionshaussteilnehmer und Bieter sich nicht gegenteilig äußern, versichern sie, dass sie den Katalog und die darin abgebildeten Gegenstände aus der Zeit des Dritten Reiches nur zu Zwecken der staatsbürgerlichen Aufklärung, der Abwehr verfassungswidriger Bestrebungen, der Kunst oder der Wissenschaft, der Forschung oder der Lehre, der

Berichterstattung über Vorgänge des Zeitgeschehens oder der Geschichte oder zu ähnlichen Zwecken versteigen bzw. erwerben (3386,86a StGB). Das Auktionshaus und der Einlieferer geben diese Objekte nur unter den vorgenannten Voraussetzungen ab. Gegenstände, deren Inhalt gegen §§ 130 130a und 131 StGB verstößt, sind von der Auktion ausgeschlossen.
26.
Sollten einer oder mehrerer Bestimmungen dieser Versteigerungsbedingungen unwirksam sein oder werden, bleibt die Gültigkeit der übrigen Bestimmung zu ersetzten die dem wirtschaftlichen Gehalt und dem Zweck der unwirksamen Bestimmung am nächsten kommt. Entsprechendes gilt, wenn der Vertrag eine ergänzungsbedürftige Lücke aufweist.

1. They are not guaranteed properties within the meaning of §§ 459 ff. BGB, but are fundamentally to be viewed as an expression of opinion and not as a statement of fact. Information of any kind, be it oral or written, only expresses a subjective assessment of the auction house and does not constitute a different individual agreement, guarantee or quality agreement. If other forms of presentation are used in addition to the catalog, only the textual information contained in the catalog is relevant, not the illustrations. We reserve the right to correct catalog information during the auction. The state of preservation is not consistently mentioned in the catalog, so missing information does not constitute an agreement on quality. Damage is only mentioned in the catalog if, in the auctioneer's opinion, it significantly impairs the overall visual impression of the auction item. In this respect, there is a lack of information about repairs, restorations, additions or other measures Auction item does not mean that the item is in perfect condition. Items of low value can be auctioned as bundles outside of the catalog.
Liability and statute of limitations
3. Liability of the auctioneer due to any obvious or hidden defects, loss of or damage to the auctioned object is expressly excluded, unless legal liability is mandatory. Claims for damages against the auctioneer due to legal and material defects as well as other legal reasons, including reimbursement of wasted expenses and reimbursement of expert costs, are excluded unless they are based on intentional or grossly negligent actions on the part of the auctioneer or are caused by injury to life, body or health have. Liability for simple negligence is limited to the amount of the respective surcharge. Liability exists for simply negligent behavior on the part of the auctioneer and the persons for whom he is responsible only if this relates to the violation of essential contractual obligations.
4. Items that belong to the auctioneer are listed separately in the catalog and auction directory and marked as such.
5. The auctioneer agrees to immediately forward any justified complaints made by the buyer to the consignor of the object in question.
6. All claims against the auction house for used items expire 1 year after the auctioned object has been handed over, unless they are based on an intentional violation of the law or longer limitation periods are required by law. If the purchaser is a merchant, tradesman or freelancer, the warranty claims expire 6 months after the day of the acceptance of the contract. Excluded from the shortened statute of limitations are claims that are caused by injury to life, body or health.
Auction process
7. The catalog number stated in the bid is decisive for bids of any kind. The auctioneer has the right to separate or combine numbers, to offer them out of sequence or to withdraw them.
8. He can also reject bids without giving reasons; This applies in particular if a bidder who is not known to the auctioneer enters into an agreement with him
The business relationship does not yet exist or the bidder does not provide security by the end of the auction at the latest. There is no entitlement to acceptance of a bid even if security is provided. If a bid is rejected, the bid made immediately beforehand remains binding. If several people place the same bid, the bid submitted first will be accepted. If there is disagreement about a knockdown, the auctioneer may, at his own discretion, immediately repeat the knockdown in favor of a specific bidder or call up the item again. There is no entitlement to the award of the contract. Unless the auctioneer rejects it, a bid expires if the auction is closed without the acceptance of the hammer or if the auctioneer calls up the item again; A bid does not expire due to a subsequent ineffective higher bid.
9. All bids are deemed to have been submitted by the bidder in his own name and for his own account. If a bidder wants to submit bids on behalf of a third party, he must notify this before the start of the auction, stating the name and address of the person represented and a written power of attorney, otherwise he will be obliged to do so himself.
10. The call usually begins at the price stated in the catalog. Estimated prices stated in the catalog are not minimum or maximum prices, but only serve as an indication of the market value of the items without guaranteeing their accuracy. If no price is stated in the catalogue, the call begins with the guide price estimated by the auctioneer, unless there are already higher written bids or the auctioneer has agreed with the consignor a minimum hammer price of more than 50% of the estimated price. The increments are at the discretion of the auctioneer, generally 10% of the previous bid.
11. Bids can be made in person in the auction room or, if absent, in writing, by telephone or, if the Kloss auction house has specified an approved platform on the Internet, online. Written bids must be received no later than the day before the auction and must name the item, stating the catalog number and the price offered, which is understood to be the hammer price without premium and VAT. In the case of written bids, the bidder instructs the auctioneer to submit bids on his behalf. Any ambiguities or inaccuracies are at the bidder’s expense. The auctioneer is not obliged to inform the written bidder that his bid has not been taken into account. Each written bid will only be used by the auctioneer for the amount necessary to outbid other bids.
In the case of telephone bids, a telephone operator present in the auction room is commissioned to submit offers according to the instructions of the previously identified bidder. Telephone offers are binding and are equivalent to bids made in the room. The bid made by telephone does not include the premium, statutory VAT or other costs. The auction house is not liable for the establishment and maintenance of telecommunications connections or for transmission errors.
12. Internet bids can be submitted both as preliminary bids before the start of an auction and as live bids during an auction broadcast live on the Internet in accordance with these auction conditions. Bids received via the Internet during an ongoing auction will only be taken into account if the auction is broadcast live on the Internet. Furthermore, internet bids are only permitted if the bidder has been approved by the Kloss auction house to bid via the internet by sending a user name and a password and the bids can also be assigned without any doubt. Bids transmitted over the Internet are recorded electronically. Live bids are treated like bids from the auction room.
13. The right of cancellation and return in accordance with the law for distance selling contracts does not apply to written, telephone and internet bids.
14. The contract will be awarded to the highest bidder after three calls. If the previously set limit is not reached but is accepted with reservations, the bidder remains bound to his bid for four weeks. If a reservation is not approved by the consignor or someone offers the limit, the auction item specified in the catalog number can be sold to a higher bidder without asking the bidder of the reservation. A conditional acceptance of the bid is also possible if legal or factual doubts are raised about an object during the auction. 15. The after-sale is part of the auction. In the case of additional bids, a contract is only concluded when the auction house accepts the offer. Furthermore, the auction conditions also apply to private sales.
Obligations of the buyer, transfer of risk
16. The acceptance of the bid obliges the personally present bidder to immediately accept and pay for the auction item. In addition to the hammer price, the buyer must pay a premium of 28.0% plus the statutory VAT of currently 19% on the premium (a total of 33.32%). 17. Absent purchasers are obliged to pick up the items from the auction house immediately after notification of the winning bid against cash payment of the hammer price and buyer's premium, including the applicable VAT. 18. Payments must be made to the auctioneer in cash in euros or by EC card. For invoice amounts over €500, payment on site with credit card plus 3% plus VAT is possible. Instead of cash payment, payment can also be made by bank confirmed check; Checks are only accepted as payment. The costs, fees and taxes incurred through bank transfer or check cashing are borne by the purchaser. In the case of absentee bids, payment within 7 days of the invoice date is not considered late, regardless of the immediate due date; Thereafter, payment default occurs. The auctioneer is entitled to charge reminder fees of €10 for each reminder, whereby the buyer proof that the auctioneer suffered no or lesser damage.
19. In the event of late payment, default interest of 1 percent per month will be charged. The purchaser has the right to prove that the auctioneer suffered less or no damage. Furthermore, in the event of late payment, the auction house can either demand fulfillment of the purchase contract or withdraw from the contract after setting a reasonable deadline. 20. The auctioneer can collect and sue for purchase money and purchase money arrears as well as additional services on behalf of the consignor.
21. The purchaser can only set off undisputed or legally established claims against the auctioneer. The purchaser's rights of retention are excluded unless they are based on the same contractual relationship.
Final provisions
22.
The bidder agrees that his name, address and purchases will be stored and processed electronically by the auction house for the purposes of conducting and processing the auction, as well as for the purpose of notification of future auctions and offers.
23.
These auction conditions regulate all relationships between the buyer and the Kloss auction house. The buyer's general terms and conditions do not apply. There are no oral additional agreements. Changes to the auction conditions must be made in writing to be valid.
24.
The place of performance and jurisdiction for commercial transactions is exclusively Berlin. German law applies; the regulations of international sales law do not apply.
25.
As long as the auction house, auction house participants and bidders do not express themselves to the contrary, they assure that they will use the catalog and the objects depicted in it from the Third Reich period only for the purposes of civic education, the defense of unconstitutional efforts, art or science, and research or the teaching, the

26.
If one or more provisions of these auction conditions are or become invalid, the validity of the remaining provision that comes closest to the economic content and purpose of the invalid provision remains to be replaced. The same applies if the contract has a gap that needs to be supplemented.
Versteigerungsbedingungen in der Fassung vom 04.01.2023
Mit der Teilnahme an der Versteigerung, gleich ob im Wege persönlicher, telefonischer, schriftlicher, fernschriftlicher oder elektronischer Teilnahme, werden folgende Bedingungen anerkannt; die Bedingungen gelten für alle Auktionen und die zugehörigen verbundenen Geschäfte, den Verkauf sowie die Einlieferung. Gegenüber den Einlieferungsbedingungen haben diese Vorschriften Vorrang, soweit sie den gleichen Sachverhalt regeln; im Übrigen ergänzen die Versteigerungsbedingungen die Einlieferungsbedingungen:
Katalog und Beschaffenheit
1. Das Auktionshaus Kloss, Dietzgenstr. 51-53, 13156 Berlin versteigert in öffentlicher Versteigerung gemäß § 383 Abs. 3 S. 1 BGB im Namen und für Rechnung der Einlieferer (Agent). Die Versteigerung erfolgt freiwillig. Jeder Auftraggeber erhält eine Nummer, so dass aus dem Einlieferungsverzeichnis zu erkennen ist, welche Gegenstände von welchem Auftraggeber eingeliefert wurden.
2. Sämtliche zur Versteigerung gelangenden Gegenstände sind ausnahmslos gebraucht und haben einen ihrem Alter und ihrer Herkunft entsprechenden Erhaltungszustand. Sie können im Rahmen der Vorbesichtigung geprüft und besichtigt werden. Die Angaben im Katalog und in anderen Präsentationsformen (z.B. Internet), die in der Regel auf Angaben der Einbringer beruhen, werden nach bestem Wissen und Gewissen erstellt. Sie sind keine zugesicherten Eigenschaften im Sinne der §§ 459 ff. BGB, sondern grundsätzlich als Meinungsäußerung und nicht als Tatsachenbehauptung anzusehen. Auskünfte jedweder Art, sei es mündlich oder schriftlich, bringen lediglich eine subjektive Einschätzung des Auktionshauses zum Ausdruck und sind keine abweichende Individualabrede, Garantie- oder Beschaffenheitsvereinbarung. Werden zusätzlich zu dem Katalog noch andere Präsentationsformen genutzt, sind dennoch nur die im Katalog enthaltenen textlichen Angaben, nicht hingegen Abbildungen, maßgeblich. Es bleibt vorbehalten, Katalogangaben in der Auktion zu berichtigen. Der Erhaltungszustand wird im Katalog nicht durchgängig erwähnt, so dass fehlende Angaben ebenfalls keine Beschaffenheitsvereinbarung begründen. Beschädigungen finden im Katalog nur Erwähnung, wenn sie nach Einschätzung des Versteigerers den optischen Gesamteindruck des Versteigerungsobjekts deutlich beeinträchtigen. Insoweit ergibt sich aus fehlenden Hinweisen auf Reparaturen, Restaurierungen, Ergänzungen oder sonstigen Maßnahmen am
Versteigerungsobjekt nicht, dass sich die Sache in einem perfekten Zustand befindet. Gegenstände von geringem Wert können als Konvolute außerhalb des Katalogs versteigert werden.
Haftung und Verjährung
3. Eine Haftung des Versteigerers wegen etwaiger offener oder versteckter Mängel, wegen Verlust oder Beschädigung des versteigerten Objekts wird ausdrücklich ausgeschlossen, sofern eine gesetzliche Haftung nicht zwingend vorgeschrieben ist. Schadensersatzansprüche gegen den Versteigerer wegen Rechts- und Sachmängeln sowie aus sonstigen Rechtsgründen, inklusive Ersatz vergeblicher Aufwendungen sowie Ersatz von Gutachterkosten, sind ausgeschlossen, soweit sie nicht auf vorsätzlichen oder grob fahrlässigen Handeln des Versteigerers beruhen oder ihre Ursache in der Verletzung von Leben, Körper oder Gesundheit haben. Die Haftung für einfache Fahrlässigkeit ist betragsmäßig begrenzt auf die Höhe des jeweiligen Zuschlags. Für einfach fahrlässiges Verhalten des Versteigerers und der Personen, für die er einzutreten hat, besteht nur dann eine Haftung, wenn dieses die Verletzung von wesentlichen Vertragspflichten betrifft.
4. Gegenstände, die dem Versteigerer gehören, werden im Katalog und Versteigerungsverzeichnis gesondert aufgeführt und als solche gekennzeichnet.
5. Der Versteigerer erklärt sich bereit, unverzüglich vorgenommene begründete Rügen des Käufers an den Einlieferer der bemängelten Sache weiterzuleiten.
6. Alle Ansprüche gegen das Auktionshaus wegen gebrauchter Sachen verjähren 1 Jahr nach Übergabe des zugeschlagenen Objektes, soweit sie nicht auf einer vorsätzlichen Rechtsverletzung beruhen oder gesetzlich zwingend längere Verjährungsfristen vorgeschrieben sind. Soweit der Erwerber Kaufmann, Gewerbetreibender oder Freiberufler ist, verjähren die Gewährleistungsansprüche in 6 Monaten nach dem Tag des Zuschlages. Ausgenommen von der verkürzten Verjährung sind Ansprüche, die ihre Ursache in der Verletzung von Leben, Körper oder Gesundheit haben.
Ablauf der Versteigerung
7. Maßgeblich ist bei Geboten jeder Art ist die im Gebot genannte Katalognummer. Der Versteigerer hat das Recht, Nummern zu trennen oder zu vereinen, außerhalb der Reihe anzubieten oder zurückzuziehen.
8. Ebenso kann er Gebote ohne Begründung ablehnen; dies gilt insbesondere dann, wenn ein Bieter, der dem Versteigerer nicht bekannt ist, mit ihm eine
Geschäftsverbindung noch nicht besteht, oder der Bieter nicht spätestens bis zum Ende der Versteigerung Sicherheit leistet. Ein Anspruch auf Annahme eines Gebotes besteht auch im Falle der Sicherheitsleistung nicht. Wird ein Gebot abgelehnt, bleibt das unmittelbar vorher abgegebene Gebot verbindlich. Geben mehrere Personen das gleiche Gebot ab, so erhält das zuerst abgegebene Gebot den Zuschlag. Besteht Uneinigkeit über einen Zuschlag, so kann der Versteigerer nach freiem Ermessen den Zuschlag sofort zu Gunsten eines bestimmten Bieters wiederholen oder den Gegenstand nochmals aufrufen. Ein Anspruch auf Zuschlagserteilung besteht nicht. Ein Gebot erlischt außer im Falle seiner Ablehnung durch den Versteigerer dann, wenn die Versteigerung ohne Erteilung des Zuschlags geschlossen wird oder wenn der Versteigerer den Gegenstand erneut aufruft; ein Gebot erlischt nicht durch ein nachfolgendes unwirksames Übergebot.
9. Alle Gebote gelten als vom Bieter im eigenen Namen und für eigene Rechnung abgegeben. Will ein Bieter Gebote im Namen eines Dritten abgeben, muss er dies vor Versteigerungsbeginn unter Nennung von Namen und Anschrift des vertretenen und einer schriftlichen Vollmacht mitteilen, ansonsten wird er selbst verpflichtet.
10. Der Aufruf beginnt in der Regel zu dem im Katalog angegebenen Preis. Im Katalog angegebene Schätzpreise sind keine Mindest- oder Höchstpreise, sondern dienen nur als Anhaltspunkt für den Verkehrswert der Gegenstände ohne Gewähr für die Richtigkeit. Ist im Katalog kein Preis angegeben, beginnt der Aufruf mit dem vom Versteigerer geschätzten Richtpreis, es sei denn, dass bereits höhere schriftliche Gebote vorliegen oder dass der Versteigerer mit dem Einlieferer einen Mindestzuschlagpreis von mehr als 50 % des Schätzpreises vereinbart hat. Die Steigerungsstufen liegen im Ermessen des Versteigerers, im Allgemeinen um 10 % des vorangegangenen Gebots.
11. Gebote können persönlich im Auktionssaal sowie bei Abwesenheit schriftlich, telefonisch oder, soweit das Auktionshaus Kloss eine zugelassene Plattform im Internet angegeben hat, online abgegeben werden. Schriftliche Gebote müssen spätestens am Tag vor der Versteigerung eingegangen seien und den Gegenstand unter Aufführung der Katalognummer, des gebotenen Preises, der sich als Zuschlagspreis ohne Aufgeld und Mehrwertsteuer versteht, benennen. Bei schriftlichen Geboten beauftragt der Bieter den Versteigerer, für ihn Gebote abzugeben. Unklarheiten oder Ungenauigkeiten gehen zu Lasten des Bieters. Der Versteigerer ist nicht verpflichtet, den schriftlichen Bieter von der Nichtberücksichtigung seines Gebotes in Kenntnis zu setzen. Jedes schriftliche Gebot wird vom Versteigerer nur mit dem Betrag in Anspruch genommen, der erforderlich ist, um andere Gebote zu überbieten.
Bei telefonischen Geboten wird ein im Auktionssaal anwesender Telefonist beauftragt, nach Anweisung des zuvor identifizierten Bieters Angebote abzugeben. Die telefonischen Angebote sind bindend und stehen im Saal abgegebenen Geboten gleich. In dem telefonisch abgegebenen Gebot sind das Aufgeld, die gesetzliche Mehrwertsteuer oder andere Kosten nicht enthalten. Telefonische Gebote können vom Auktionshaus Kloss aufgezeichnet werden. Mit dem Antrag zum telefonischen Bieten erklärt sich der Antragsteller mit den Versteigerungsbedingungen und der Aufzeichnung von Telefongesprächen einverstanden. Das Auktionshaus haftet nicht für das Zustandekommen und die Aufrechterhaltung von Telekommunikationsverbindungen oder für Übermittlungsfehler.
12. Internet-Gebote können sowohl als Vorgebote vor Beginn einer Versteigerung als auch als Live-Gebote während einer im Internet live übertragenen Versteigerung nach Maßgabe der vorliegenden Versteigerungsbedingungen abgegeben werden. Gebote die während einer laufenden Versteigerung via Internet eingehen, werden nur dann berücksichtigt, wenn es sich um eine Live im Internet übertragene Versteigerung handelt. Im Übrigen sind Internet-Gebote nur dann zulässig, wenn der Bieter vom Auktionshaus Kloss zum Bieten über das Internet durch Zusendung eines Nutzernamens und eines Passwortes zugelassen worden ist und die Gebote auch zweifelsfrei zugeordnet werden können. Die über das Internet übertragenen Gebote werden elektronisch protokolliert. Live-Gebote werden wie Gebote aus dem Auktionssaal behandelt.
13. Das Widerrufs- und Rückgaberecht nach Maßgabe des Rechts für Fernabsatzverträge findet auf Schrift-, Telefon- und Internetgebote keine Anwendung.
14. Der Zuschlag erfolgt nach dreimaligem Aufruf an den Meistbietenden. Wird das zuvor gesetzte Limit nicht erreicht, sondern unter Vorbehalt zugeschlagen, so bleibt der Bieter für vier Wochen an sein Gebot gebunden. Wird ein Vorbehalt durch den Einlieferer nicht genehmigt oder bietet jemand das Limit, kann das in der Katalognummer bezeichnete Versteigerungsobjekt ohne Rückfrage bei dem Bieter des Vorbehalts an einen höheren Bieter abgegeben werden. Es ist Sache des Bieters, sich über die Genehmigung seines Gebots zu informieren. Ein Zuschlag unter Vorbehalt ist auch möglich, wenn rechtliche oder tatsächliche Zweifel bei einem Objekt während der Auktion angemeldet werden. Wenn trotz abgegebenen Gebots kein Zuschlag erteilt wird, haftet der Versteigerer dem Bieter nur bei Vorsatz oder grober Fahrlässigkeit. Hat der Versteigerer ein höheres Gebot übersehen oder bestehende Zweifel über den Zuschlag, kann er bis zum Abschluss der Auktion nach seiner Wahl den Zuschlag zu Gunsten eines bestimmten Gebietes wiederholen oder den Gegenstand erneut aus bieten; in diesen Fällen wird ein vorangegangener Zuschlag unwirksam.
15. Der Nachverkauf ist Teil der Versteigerung. Bei Nachgeboten kommt ein Vertrag erst zustande, wenn das Auktionshaus das Angebot annimmt. Im Übrigen gelten die Versteigerungsbedingungen auch für den freihändigen Verkauf.
Pflichten des Käufers, Risikoübergang
16. Der Zuschlag verpflichtet den persönlich anwesenden Bieter zur unverzüglichen Abnahme und sofortigen Bezahlung des Versteigerungsobjektes. Neben der Zuschlagssumme ist vom Käufer ein Aufgeld von 28,0 % zuzüglich der gesetzlichen Mehrwertsteuer von derzeit 19 % auf das Aufgeld (insgesamt also 33,32 %) zu zahlen. Auf den Nettorechnungspreis (Zuschlag und Aufgeld) wird die gesetzliche Umsatzsteuer von 7 % für Bilder, Originalgrafik, Plastik und Sammlungsstücke und für Kunstgewerbe und Photographie hinzugerechnet. Von der MwSt. befreit sind Ausfuhrlieferungen in Drittländer und – bei Angabe der USt-Id.-Nr. an Unternehmen in andere Mitgliedsstaaten.
17. Abwesende Erwerber sind verpflichtet, die Gegenstände unverzüglich nach Mitteilung des Zuschlages beim Auktionshaus gegen Barzahlung von Zuschlagssumme und Aufgeld inklusive der darauf entfallenden MwSt. abzuholen. Einer besonderen Aufforderung zur Abholung bedarf es nicht. Das Eigentum an den ersteigerten Gegenständen bleibt bis zur Erfüllung aller im Zeitpunkt des Zuschlages vom Erwerber geschuldeten Forderungen des Versteigerers vorbehalten. Mit der Erteilung des Zuschlags gehen alle Risiken, insbesondere die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung auf den Bieter über, auch wenn der Erwerber die Gegenstände nicht sofort im Auktionshaus abgeholt hat. Das Auktionshaus trägt in keinem Fall eine Haftung für Verlust oder Beschädigung nicht abgeholter oder mangels Bezahlung nicht übergebener Gegenstände, es sei denn, es läge Vorsatz oder grobe Fahrlässigkeit vor. Nicht abgeholte Gegenstände kann das Auktionshaus auf Kosten und Gefahr des Erwerbers bei einem Lagerhalter zur Aufbewahrung geben; der Erwerber wird über die Aufbewahrung unterrichtet.
18. Zahlungen sind bar in Euro oder per EC-Karte an den Versteigerer zu leisten. Ab einem Rechnungsbetrag in Höhe von 500€ ist eine Zahlung vor Ort mit Kreditkarte zuzüglich 3 % plus gesetzlicher Mehrwertsteuer möglich. Statt Barzahlung kann auch Zahlung durch bankbestätigten Scheck erfolgen; Schecks werden nur erfüllungshalber angenommen. Die durch Überweisung oder Scheckeinlösungen anfallenden Kosten, Gebühren und Steuern gehen zu Lasten des Erwerbers. Bei Geboten in Abwesenheit gilt unbeschadet der sofortigen Fälligkeit die Zahlung binnen 7 Tagen nach Rechnungsdatum noch nicht als verspätet; danach tritt Zahlungsverzug ein. Der Versteigerer ist berechtigt, für jede Mahnung Mahngebühren in Höhe von 10 € zu verlangen, wobei dem Käufer
der Nachweis zusteht, das dem Versteigerer kein oder ein geringerer Schaden entstanden ist.
19. Bei Zahlungsverzug werden Verzugszinsen in Höhe von 1 Prozent pro Monat in Rechnung gestellt. Der Erwerber hat das Recht zum Nachweis eines geringeren oder keines Schadens beim Versteigerer. Des Weiteren kann das Auktionshaus bei Zahlungsverzug wahlweise Erfüllung des Kaufvertrages verlangen oder nach angemessener Fristsetzung vom Vertrag zurückzutreten. Im Falle des Rücktritts erlöschen alle Rechte des Bieters am Versteigerungsobjekt. Das Auktionshaus ist berechtigt, Schadenersatz in Höhe des entgangenen Aufgeldes zu verlangen. Wird der Gegenstand in einer neuen Auktion versteigert, so haftet der säumige Erwerber außerdem für jeglichen Mindererlös gegenüber der früheren Versteigerung sowie für die Kosten der wiederholten Versteigerung; auf einen etwaigen Mehrerlös hat er keinen Anspruch. Das Auktionshaus hat das Recht, säumige Erwerber von weiteren Geboten in Auktionen auszuschließen.
20. Kaufgelder und Kaufgeldrückstände sowie Nebenleistungen kann der Versteigerer im Namen des Einlieferers einziehen und einklagen.
21. Gegenüber dem Versteigerer kann der Erwerber nur mit unbestrittenen oder rechtskräftig festgestellten Forderungen aufrechnen. Zurückbehaltungsrechte des Erwerbers sind ausgeschlossen, soweit sie nicht auf demselben Vertragsverhältnis beruhen.
Schlussbestimmungen
22.
Der Bieter ist damit einverstanden, dass sein Name, seine Adresse und die Käufe für Zwecke der Durchführung und Abwicklung der Versteigerung, sowie zum Zwecke der Benachrichtigung über zukünftige Auktionen und Angebote, elektronisch vom Auktionshaus gespeichert und verarbeitet werden.
23.
Diese Versteigerungsbedingungen regeln sämtliche Beziehungen zwischen dem Käufer und dem Auktionshaus Kloss. Allgemeine Geschäftsbedingungen des Käufers haben keine Geltung. Mündlichen Nebenabreden bestehen nicht. Änderung in den Versteigerungsbedingungen bedürfen zu Ihrer Gültigkeit der Schriftform.
24.
Erfüllungsort und Gerichtsstand für den vollkaufmännischen Verkehr ist ausschließlich Berlin. Es gilt deutsches Recht; die Vorschriften des Internationalen Kaufrechts finden keine Anwendung.
25.
Solange das Auktionshaus, Auktionshaussteilnehmer und Bieter sich nicht gegenteilig äußern, versichern sie, dass sie den Katalog und die darin abgebildeten Gegenstände aus der Zeit des Dritten Reiches nur zu Zwecken der staatsbürgerlichen Aufklärung, der Abwehr verfassungswidriger Bestrebungen, der Kunst oder der Wissenschaft, der Forschung oder der Lehre, der

Berichterstattung über Vorgänge des Zeitgeschehens oder der Geschichte oder zu ähnlichen Zwecken versteigen bzw. erwerben (3386,86a StGB). Das Auktionshaus und der Einlieferer geben diese Objekte nur unter den vorgenannten Voraussetzungen ab. Gegenstände, deren Inhalt gegen §§ 130 130a und 131 StGB verstößt, sind von der Auktion ausgeschlossen.
26.
Sollten einer oder mehrerer Bestimmungen dieser Versteigerungsbedingungen unwirksam sein oder werden, bleibt die Gültigkeit der übrigen Bestimmung zu ersetzten die dem wirtschaftlichen Gehalt und dem Zweck der unwirksamen Bestimmung am nächsten kommt. Entsprechendes gilt, wenn der Vertrag eine ergänzungsbedürftige Lücke aufweist.

By participating in the auction, whether in person, by telephone, in writing, by telex or electronically, the following conditions are accepted; the conditions apply to all auctions and the associated related transactions, sales and consignment. conditions: catalog and condition
1. The Kloss auction house, Dietzgenstr. 51-53, 13156 Berlin auctions in public auction in accordance with Section 383 Paragraph 3 Sentence 1 BGB in the name and for the account of the consignor (agent). The auction is voluntary. Each client receives a number so that the consignment list shows which items were delivered by which client.
2. All items up for auction are, without exception, used and are in a state of preservation commensurate with their age and origin. They can be checked and viewed as part of the preview. The information in the catalog and in other forms of presentation (e.g. Internet), which are generally based on information provided by the consignor, is created to the best of our knowledge and belief. They are not guaranteed properties within the meaning of §§ 459 ff. BGB, but are fundamentally to be viewed as an expression of opinion and not as a statement of fact. Information of any kind, be it oral or written, only expresses a subjective assessment of the auction house and does not constitute a different individual agreement, guarantee or quality agreement. If other forms of presentation are used in addition to the catalog, only the textual information contained in the catalog is relevant, not the illustrations. We reserve the right to correct catalog information during the auction. The state of preservation is not consistently mentioned in the catalog, so missing information does not constitute an agreement on quality. Damage is only mentioned in the catalog if, in the auctioneer's opinion, it significantly impairs the overall visual impression of the auction item. In this respect, there is a lack of information about repairs, restorations, additions or other measures Auction item does not mean that the item is in perfect condition. Items of low value can be auctioned as bundles outside of the catalog.
Liability and statute of limitations
3. Liability of the auctioneer due to any obvious or hidden defects, loss of or damage to the auctioned object is expressly excluded, unless legal liability is mandatory. Claims for damages against the auctioneer due to legal and material defects as well as other legal reasons, including reimbursement of wasted expenses and reimbursement of expert costs, are excluded unless they are based on intentional or grossly negligent actions on the part of the auctioneer or are caused by injury to life, body or health have. Liability for simple negligence is limited to the amount of the respective surcharge. Liability exists for simply negligent behavior on the part of the auctioneer and the persons for whom he is responsible only if this relates to the violation of essential contractual obligations.
4. Items that belong to the auctioneer are listed separately in the catalog and auction directory and marked as such.
5. The auctioneer agrees to immediately forward any justified complaints made by the buyer to the consignor of the object in question.
6. All claims against the auction house for used items expire 1 year after the auctioned object has been handed over, unless they are based on an intentional violation of the law or longer limitation periods are required by law. If the purchaser is a merchant, tradesman or freelancer, the warranty claims expire 6 months after the day of the acceptance of the contract. Excluded from the shortened statute of limitations are claims that are caused by injury to life, body or health.
Auction process
7. The catalog number stated in the bid is decisive for bids of any kind. The auctioneer has the right to separate or combine numbers, to offer them out of sequence or to withdraw them.
8. He can also reject bids without giving reasons; This applies in particular if a bidder who is not known to the auctioneer enters into an agreement with him
The business relationship does not yet exist or the bidder does not provide security by the end of the auction at the latest. There is no entitlement to acceptance of a bid even if security is provided. If a bid is rejected, the bid made immediately beforehand remains binding. If several people place the same bid, the bid submitted first will be accepted. If there is disagreement about a knockdown, the auctioneer may, at his own discretion, immediately repeat the knockdown in favor of a specific bidder or call up the item again. There is no entitlement to the award of the contract. Unless the auctioneer rejects it, a bid expires if the auction is closed without the acceptance of the hammer or if the auctioneer calls up the item again; A bid does not expire due to a subsequent ineffective higher bid.
9. All bids are deemed to have been submitted by the bidder in his own name and for his own account. If a bidder wants to submit bids on behalf of a third party, he must notify this before the start of the auction, stating the name and address of the person represented and a written power of attorney, otherwise he will be obliged to do so himself.
10. The call usually begins at the price stated in the catalog. Estimated prices stated in the catalog are not minimum or maximum prices, but only serve as an indication of the market value of the items without guaranteeing their accuracy. If no price is stated in the catalogue, the call begins with the guide price estimated by the auctioneer, unless there are already higher written bids or the auctioneer has agreed with the consignor a minimum hammer price of more than 50% of the estimated price. The increments are at the discretion of the auctioneer, generally 10% of the previous bid.
11. Bids can be made in person in the auction room or, if absent, in writing, by telephone or, if the Kloss auction house has specified an approved platform on the Internet, online. Written bids must be received no later than the day before the auction and must name the item, stating the catalog number and the price offered, which is understood to be the hammer price without premium and VAT. In the case of written bids, the bidder instructs the auctioneer to submit bids on his behalf. Any ambiguities or inaccuracies are at the bidder’s expense. The auctioneer is not obliged to inform the written bidder that his bid has not been taken into account. Each written bid will only be used by the auctioneer for the amount necessary to outbid other bids.
In the case of telephone bids, a telephone operator present in the auction room is commissioned to submit offers according to the instructions of the previously identified bidder. Telephone offers are binding and are equivalent to bids made in the room. The bid made by telephone does not include the premium, statutory VAT or other costs. Telephone bids can be recorded by the Kloss auction house. By applying for telephone bidding, the applicant agrees to the auction conditions and the recording of telephone conversations. The auction house is not liable for the establishment and maintenance of telecommunications connections or for transmission errors.
12. Internet bids can be submitted both as preliminary bids before the start of an auction and as live bids during an auction broadcast live on the Internet in accordance with these auction conditions. Bids received via the Internet during an ongoing auction will only be taken into account if the auction is broadcast live on the Internet. Furthermore, internet bids are only permitted if the bidder has been approved by the Kloss auction house to bid via the internet by sending a user name and a password and the bids can also be assigned without any doubt. Bids transmitted over the Internet are recorded electronically. Live bids are treated like bids from the auction room.
13. The right of cancellation and return in accordance with the law for distance selling contracts does not apply to written, telephone and internet bids.
14. The contract will be awarded to the highest bidder after three calls. If the previously set limit is not reached but is accepted with reservations, the bidder remains bound to his bid for four weeks. If a reservation is not approved by the consignor or someone offers the limit, the auction item specified in the catalog number can be sold to a higher bidder without asking the bidder of the reservation. It is the bidder's responsibility to ensure that his or her bid is approved. A conditional acceptance of the bid is also possible if legal or factual doubts are raised about an object during the auction. If the bid is not accepted despite the bid being submitted, the auctioneer is only liable to the bidder in the event of intent or gross negligence. If the auctioneer has overlooked a higher bid or has doubts about the acceptance, he can, at his discretion, repeat the acceptance in favor of a specific area or offer the item again until the end of the auction; In these cases, a previous award becomes ineffective.
15. The after-sale is part of the auction. In the case of additional bids, a contract is only concluded when the auction house accepts the offer. Furthermore, the auction conditions also apply to private sales.
Obligations of the buyer, transfer of risk
16. The acceptance of the bid obliges the personally present bidder to immediately accept and pay for the auction item. In addition to the hammer price, the buyer must pay a premium of 28.0% plus the statutory VAT of currently 19% on the premium (a total of 33.32%). The statutory sales tax of 7% is added to the net invoice price (surcharge and premium) for pictures, original graphics, plastic and collector's items and for decorative arts and photography. Export deliveries to third countries are exempt from VAT and – if the VAT ID number is provided. to companies in other member states.
17. Absent purchasers are obliged to pick up the items from the auction house immediately after notification of the winning bid against cash payment of the hammer price and buyer's premium, including the applicable VAT. There is no need for a special request for collection. Ownership of the auctioned items remains reserved until all claims owed by the purchaser at the time of the bid have been fulfilled by the auctioneer. With the award of the contract, all risks, in particular the risk of accidental loss and accidental deterioration, are transferred to the bidder, even if the purchaser did not immediately pick up the items from the auction house. Under no circumstances will the auction house be liable for loss or damage to items that are not collected or are not handed over due to lack of payment, unless there is intent or gross negligence. The auction house may place unclaimed items in storage at the purchaser's expense and risk with a warehouse keeper; the purchaser will be informed about storage.
18. Payments must be made to the auctioneer in cash in euros or by EC card. For invoice amounts over €500, payment on site with credit card plus 3% plus VAT is possible. Instead of cash payment, payment can also be made by bank confirmed check; Checks are only accepted as payment. The costs, fees and taxes incurred through bank transfer or check cashing are borne by the purchaser. In the case of absentee bids, payment within 7 days of the invoice date is not considered late, regardless of the immediate due date; Thereafter, payment default occurs. The auctioneer is entitled to charge reminder fees of €10 for each reminder, whereby the buyer proof that the auctioneer suffered no or lesser damage.
19. In the event of late payment, default interest of 1 percent per month will be charged. The purchaser has the right to prove that the auctioneer suffered less or no damage. Furthermore, in the event of late payment, the auction house can either demand fulfillment of the purchase contract or withdraw from the contract after setting a reasonable deadline. In the event of withdrawal, all of the bidder's rights to the auction item expire. The auction house is entitled to demand compensation in the amount of the lost premium. If the item is auctioned in a new auction, the defaulting purchaser is also liable for any shortfall in proceeds compared to the previous auction as well as for the costs of the repeated auction; He has no claim to any additional proceeds. The auction house has the right to exclude defaulting buyers from further bids in auctions.
20. The auctioneer can collect and sue for purchase money and purchase money arrears as well as additional services on behalf of the consignor.
21. The purchaser can only set off undisputed or legally established claims against the auctioneer. The purchaser's rights of retention are excluded unless they are based on the same contractual relationship.
Final provisions
22.
The bidder agrees that his name, address and purchases will be stored and processed electronically by the auction house for the purposes of conducting and processing the auction, as well as for the purpose of notification of future auctions and offers.
23.
These auction conditions regulate all relationships between the buyer and the Kloss auction house. The buyer's general terms and conditions do not apply. There are no oral additional agreements. Changes to the auction conditions must be made in writing to be valid.
24.
The place of performance and jurisdiction for commercial transactions is exclusively Berlin. German law applies; the regulations of international sales law do not apply.
25.
As long as the auction house, auction house participants and bidders do not express themselves to the contrary, they assure that they will use the catalog and the objects depicted in it from the Third Reich period only for the purposes of civic education, the defense of unconstitutional efforts, art or science, and research or the teaching, the
Auction or purchase reporting on current events or history or for similar purposes (3386.86a StGB). The auction house and the consignor will only sell these objects under the aforementioned conditions. Items whose contents violate §§ 130 130a and 131 StGB are excluded from the auction.
26.
If one or more provisions of these auction conditions are or become invalid, the validity of the remaining provision that comes closest to the economic content and purpose of the invalid provision remains to be replaced. The same applies if the contract has a gap that needs to be supplemented.
